Common requirements for products in the EAEU are formulated in special documents – technical regulations. They are developed separately for each type of product. The first technical regulations began to operate in 2012. In total, more than 40 of them have now been accepted. A few dozen more are in development. Each of them contains:

• the list of products to which it applies;
• a list of exceptions that are not covered by it;
• quality parameters of the goods;
• safety criteria, including limits on the presence of harmful substances;
• requirements for manufacturing, transportation, storage and disposal;
• the methodology of control for compliance with the standards;
• conformity assessment forms;
• applicable verification schemes;
• the procedure for issuing supporting documents and marking objects;
• appendices containing specific standards for this product.

The legislation of the EAEС indicates that such confirmation is carried out in two forms:

• certification
• declaration

Certification is a more rigorous option: it requires careful testing in the laboratory according to certain methods. The declaration is in fact a manufacturer's statement that the product meets the applicable regulations. However, it may also require testing. The manufacturer or the seller can apply for certification. The specific composition of the package of documents submitted with the application differs for different types of goods. It is prescribed in the technical regulations. The standard set includes documents containing:

• product description and its characteristics;
• information about the applicable standards-GOST or TU;
• operating rules;
• data on the quality management system;
• information about raw materials and materials;
• information about the tests performed;
• other data indicating the safety of the product;
• information about the applicant;

Its main purpose is to make sure that the parameters of the product meet the requirements imposed on it. The certification process of the Customs Union includes the following phases:

• analysis of documents and product information to determine the form of conformity assessment and verification scheme;
• selection of standard samples. This stage is carried out if you need to get a TR CU certificate for a batch or serial production. If the document is issued for a separate unit of production, it is sent for verification;
• performing tests provided for by the technical regulations. They are performed in a testing laboratory. There, the most common types of loads on the product are simulated in order to understand how it will behave in real conditions;
• analysis and registration of test results;
• issuance of a confirmation document for the product that has passed the inspection;

Product control is carried out according to a certain algorithm. Their characteristics are given in the decision of the CU Commission No. 621. It includes 9 possible schemes. They are marked with codes from 1c to 9c, where the digit is an ordinal number, and the letter is a variant of confirmation of compliance. Each of them is a set of control procedures suitable for this product. Such a set may include:

• object research. This role is played by a specific product, a standard copy of the object under study, a product project or technical documentation;
• monitoring the state of production;
• verification of the quality management system certificate, if it is provided as part of a set of documents with an application;
• inspection control of production during the period of validity of the document;
• inspection control of product parameters during the validity period of the document;
• other procedures;

To issue a certificate of the Customs Union, an established sample is used. It is given in the decision of the EAEC Board No. 293. The form includes the following information:

• series and number;
• data of the organization that issued it;
• information about the applicant and the manufacturer;
• HS code;
• the regulations for compliance with which the product was checked;
• the basis of the decision on compliance;
• the period of validity of the certificate of conformity of the Customs Union;

The form of the CU/EAC certificate has several levels of protection. This is a holographic sticker, a special guilloche frame, a microtext around its perimeter, and others. Decision No. 293 also contains a sample declaration. It is compiled on an ordinary sheet of paper without protection.

The validity period of the document confirming the product's compliance with the EAEU standards is established by the technical regulations. The maximum period of its validity is five years. If it is issued for a batch of goods or a specific product, its validity period is not set: it is limited to the period of use of this product.

According to the rules of the EAEU, the applicant can only be a person registered in the territory of one of the participating states. Therefore, in order to issue a certificate of conformity for a product according to the standards of the Union, a foreign manufacturer needs to have an authorized person in Russia. His right to represent the interests of the manufacturer is confirmed by the contract. A legal entity or an individual entrepreneur can get the status of an authorized person. The parties will share the functions within the framework of conformity assessment during certification and declaration:

• the foreign manufacturer will be indicated in the TR CU certificate as the manufacturer;
• the authorized person will be indicated as the applicant;

The applicant assumes full responsibility for the quality and reliability of the product. Its powers are valid throughout Russia and on the territory of the member states of the Customs Union.
