This technical regulation has been developed in accordance with Article 52 of the Treaty on the Eurasian Economic Union of May 29, 2014.
This technical regulation establishes the safety requirements for mineral fertilizers put into circulation on the Union market and the processes of storage, transportation and labeling of mineral fertilizers related to the requirements for mineral fertilizers that are mandatory for application and execution on the territory of the Eurasian Economic Union (hereinafter - the Union).
1. This technical regulation is designed to protect the life and (or) health of humans, animals and plants, the environment, property on the territory of the Union, to prevent actions that mislead consumers of mineral fertilizers regarding their purpose and safety.
2. This technical regulation applies to:
a) mineral fertilizers according to the list according to Annex N 1, produced, imported (imported) into the customs territory of the Union;
b) the processes of storage, transportation and labeling of mineral fertilizers related to the requirements for mineral fertilizers.
3. The requirements of this technical regulation do not apply to organic and organic-mineral fertilizers.
4. In relation to mineral fertilizers and their components, dangerous factors are:
a) fire and explosion hazard;
b) oxidizing properties;
c) corrosion properties;
d) danger to humans: oral, dermal and inhalation toxicity, irritant effect on the skin and mucous membranes, skin-resorptive effect, allergenicity, the ability to bioaccumulate in the human body and to accumulate in environmental objects (water, soil, plants);
e) radioactive hazard;
(e) Impact on ecosystems.
5. For the purposes of applying this technical regulation, the concepts that mean the following are used:
"manufacturer" - a legal entity or an individual registered as an individual entrepreneur, including a foreign manufacturer, who carry out the production or production and sale of mineral fertilizers on their own behalf and are responsible for their compliance with the requirements of this technical regulation;
"importer" - a resident of a Member state of the Union who has concluded a foreign trade agreement with a non - resident of a Member state of the Union for the import of mineral fertilizers into the territory of the Union, implements mineral fertilizers and is responsible for their compliance with the requirements of this technical regulation;
"micro-fertilizer" is a mineral fertilizer in which the nutrients are trace elements;
"mineral fertilizer" is a fertilizer of industrial or fossil origin containing nutrients in mineral form;
"safety data sheet" - a document of the established form containing information about the hazardous properties of mineral fertilizer, information about the manufacturer (the person authorized by the manufacturer), the importer of this mineral fertilizer, warning measures and safety requirements to ensure safe handling on the territory of the Union of mineral fertilizers;
"nutrient element, active substance" - a chemical element of fertilizer necessary for the growth and development of plants;
"warning marking" is a component part of information, which is a set of information (in the form of a short text, individual graphic or color symbols and their combinations) applied to the package or on the label;
"fertilizer" - a substance for plant nutrition and increasing soil fertility;
"fertilizer with trace elements" - mineral fertilizer containing macro-and microelements;
"person authorized by the manufacturer" - registered in accordance with the legislation of the state - a legal entity or an individual as an individual entrepreneur, who, on the basis of an agreement with a manufacturer, including a foreign manufacturer, perform actions on behalf of this manufacturer when assessing compliance and putting into circulation mineral fertilizers on the territory of the Union, and are also responsible for non-compliance of mineral fertilizers with the requirements of the technical regulations of the Union (Customs Union), which apply to them.
6. Identification of mineral fertilizers is carried out by the manufacturer (the person authorized by the manufacturer), the importer, the body of the member state of the Union (hereinafter-the Member state) on the implementation of state control( supervision), by other interested parties.
7. The identification of mineral fertilizers is carried out by establishing the compliance of the appearance and composition of the mineral fertilizer, the content of nutrients, including macro - and microelements, indicated on the package, label or label and in the accompanying documentation, with the data obtained during a laboratory study of a sample of mineral fertilizer.
8. Mineral fertilizers are put into circulation on the Union market if they comply with the requirements of this technical regulation and other technical regulations of the Union (Customs Union) that have entered into force, which apply to them, and provided that they have passed the conformity assessment according to section IX of this technical regulation.
9. Mineral fertilizers, the compliance of which with the requirements of this technical regulation and other technical regulations of the Union (Customs Union) that have entered into force, which apply to them, is not confirmed, should not be marked with a single product circulation mark on the Union market.
10. Mineral fertilizers that are not marked with a single product circulation mark on the Union market are not allowed to be put into circulation on the Union market.
11. Mineral fertilizers must meet the safety requirements established by this section, as well as radiation and chemical safety standards in accordance with Annex N 2.
12. Mineral fertilizers should be classified according to dangerous factors, information about which is provided in the safety data sheet and warning labeling.
13. Mineral fertilizers intended for sale through a retail network (enterprises or organizations of wholesale and retail trade) must be packaged. It is not allowed to sell mineral fertilizers with broken packaging in retail trade.
14. Storage of mineral fertilizers is carried out in accordance with the legislation of the Member States.
15. Solid mineral fertilizers are transported in covered railway cars, gondola cars, closed transport containers of ships (holds, tanks) and by road with their mandatory shelter in the body. Solid mineral fertilizers packed in soft containers with polymer liners can be transported in gondola cars, on open deck ships and by road without shelter in the back. Solid mineral fertilizers packed in polymer bags are allowed to be transported by road without shelter in the back.
16. It is not allowed to transport in bulk in one car, the transport capacity of the vessel (hold, tank) or the car body of other goods simultaneously with mineral fertilizers.
17. The transportation of mineral fertilizers classified as dangerous goods, including those with fire and explosive properties, must be carried out in accordance with the norms and rules for the transportation of dangerous goods in force on the territories of the Member States.
18. Transportation of liquid mineral fertilizers (ammonia water, carbon dioxide, liquid complex mineral fertilizers) in bulk is carried out by rail and road transport, in containers or containers in accordance with the provisions set out in the safety data sheet.
Transportation of liquid mineral fertilizers in bulk by water transport is carried out in accordance with the requirements provided for by regulatory and technical documents for a specific type of mineral fertilizer.
Transportation of liquid complex mineral fertilizers packaged in consumer containers is carried out by rail and road transport, transport packages on pallets, in containers or containers in accordance with the provisions set out in the safety data sheet.
19. The degree of filling of containers for the transportation of liquid mineral fertilizers is determined taking into account the volume expansion of the product with a possible temperature difference in the route.
20. Transportation of mineral fertilizers by air is carried out in accordance with the requirements provided for by regulatory and technical documents for a specific type of mineral fertilizer.
21. The marking of mineral fertilizers should contain the following information:
a) the name of the mineral fertilizer and its purpose;
b) the name and content of nutrients, including micro-and macronutrients;
c) the name (brand name) of the manufacturer and its location (address of a legal entity, actual address - for a legal entity, surname, first name and patronymic (if any), place of residence, information about the state registration of an individual registered as an individual entrepreneur - for an individual), the name of the country where mineral fertilizers are manufactured;
d) the manufacturer's trademark (if available);
e) the designation of the document according to which the mineral fertilizer is produced and delivered;
f) brand and (or) grade of mineral fertilizer (if available);
g) batch number (for packaged mineral fertilizers);
h) nominal amount of mineral fertilizers (mass or volume) (for packaged mineral fertilizers);
i) recommendations for the transportation, use and storage of mineral fertilizers;
j) the registration number of a mineral fertilizer registered in a member State;
l) date of manufacture or date of shipment of mineral fertilizer (month, year);
m) the date of packaging (month, year - for packaged mineral fertilizers, if their packaging is not made by the manufacturer of these mineral fertilizers);
h) storage conditions of mineral fertilizer;
o) the guaranteed shelf life of mineral fertilizer;
p) the bar identification code of a mineral fertilizer (a code representing signs using sets of parallel strokes of different thickness and pitch, which are optically read by cross-scanning) - for mineral fertilizers sold through a retail trade network;
p) restrictions on the use of mineral fertilizers (compatibility with plant protection products, phytotoxicity);
(c) precautionary measures when handling, transporting and storing mineral fertilizers, including methods for neutralizing spilled or spilled mineral fertilizers;
t) methods of neutralization and disposal of containers from under mineral fertilizer;
y) a description of the clinical picture of acute poisoning (if available), medical recommendations, including an indication of the antidote (if available) and first aid measures in case of poisoning.
22. The marking of mineral fertilizers should contain an appropriate warning label if the mineral fertilizer is classified as dangerous.
23. The labeling of packaged mineral fertilizers is applied to the package or to a label or label attached to the package in a way that ensures their safety.
If there is not enough space for marking in full on the package, label or label, part of the information is applied to the leaflet attached to each unit of the package, label or label and on which the information is provided in accordance with paragraph 21 of this technical regulation, or the marking is applied to the package on both sides.
24. When delivering unpacked mineral fertilizers, the information specified in paragraph 21 of this technical regulation (with the exception of sub-paragraphs "g", "z", " m " and "p") is provided as part of a set of accompanying documents.
25. The transport marking of mineral fertilizers must comply with the norms and rules for the transport of dangerous goods in force on the territories of the Member States.
26. The marking of mineral fertilizers is applied in Russian and, if there are relevant requirements in the legislation of the Member states, in the state (state) language (s) of the member state on whose territory mineral fertilizers are sold.
27. The marking of mineral fertilizers should be clear and legible and located in an accessible place for inspection.
28. Compliance of mineral fertilizers with this technical regulation is ensured by meeting its requirements and the requirements of other technical regulations of the Union (Customs Union) that have entered into force, which apply to mineral fertilizers, directly or by meeting the requirements of standards included in the list of standards, as a result of which compliance with the requirements of this technical regulation is ensured on a voluntary basis.
29. The methods of research (testing) and measurement of mineral fertilizers are established in the standards included in the list of standards containing the rules and methods of research (testing) and measurement, including the rules of sampling necessary for the application and fulfillment of the requirements of this technical regulation and the assessment of compliance with technical regulation objects.
30. The assessment of compliance of mineral fertilizers with the requirements of this technical regulation is carried out in the form of registration.
31. The registration of mineral fertilizers is carried out by the authorized bodies of the Member states (hereinafter referred to as the authorized bodies) in accordance with the procedure established by the Eurasian Economic Commission. Mineral fertilizers must be included in the unified register of mineral fertilizers allowed for circulation on the Union market.
The unified register of mineral fertilizers allowed for circulation on the Union market is formed from national parts.
The procedure for registering mineral fertilizers, forming and maintaining a unified register of mineral fertilizers allowed for circulation on the Union market is developed and approved by the Eurasian Economic Commission.
32. When registering mineral fertilizers, applicants may be a legal entity or an individual registered in the territory of a Member state in accordance with its legislation as an individual entrepreneur, who is a manufacturer, or a person authorized by the manufacturer, or an importer.
33. Authorized body:
a) review and verify the submitted documents and the information contained therein;
b) makes a decision on the registration of a mineral fertilizer;
c) assigns an individual registration number to the mineral fertilizer;
d) includes mineral fertilizer in the national part of the unified register of mineral fertilizers allowed for circulation on the Union market;
e) issue a certificate of registration of mineral fertilizer in the form according to appendix N 3.
34. The validity period of the certificate of registration of mineral fertilizers is not limited.
35. Mineral fertilizers that meet the requirements of this technical regulation and other technical regulations of the Union (Customs Union) that have entered into force, which apply to them, have passed the conformity assessment according to section IX of this technical regulation, are marked with a single product circulation mark on the Union market.
36. Marking with a single sign of circulation of products on the Union market is carried out before the release of mineral fertilizers into circulation on the Union market.
37. A single product circulation mark on the Union market is applied to each unit of mineral fertilizer packaging or on the label (if it is impossible to apply the mark on the packaging), and is also given in the accompanying documents attached to the batch of mineral fertilizer.
38. A single product circulation mark on the Union market is applied in any way that provides a clear and clear image that remains until the full use of mineral fertilizer or its disposal.
39. The authorized bodies of the Member state shall take all measures to restrict and prohibit the release into circulation on the Union market of mineral fertilizers that do not meet the requirements of this technical regulation and other technical regulations of the Union (Customs Union) that have entered into force, which apply to them, as well as to withdraw them from circulation.
In this case, the authorized body of the Member State shall immediately inform the other Member States of the emergency measures taken and begin the process of consultations and negotiations on this issue.

a) solid (powdery, granular, crystalline);
b) liquid (solution, suspension).
2. Mineral fertilizers by nutrient elements:
a) simple mineral fertilizers with the declared content of one main nutrient element (nitrogen, phosphorus, potassium):
nitric;
phosphoric;
potash;
b) complex (complex, mixed, complex mixed) mineral fertilizers with the declared content of several basic nutrients:
nitrogen-phosphorus-potassium;
