Technical Regulations of the Eurasian Economic Union "On the safety of chemical products "(TR EAEU 041/2017)

Preface

This technical regulation has been developed in accordance with Article 52 of the Treaty on the Eurasian Economic Union of May 29, 2014, as well as taking into account the Globally Harmonized System of Hazard Classification and Labelling of Chemical Products (GHS) (2011) in terms of establishing:


criteria for classifying the hazards of chemicals and mixtures for human health and the environment, as well as hazards caused by their physico-chemical properties;


elements of the information system, including requirements for labeling and a safety data sheet.


This technical regulation is designed to establish uniform mandatory requirements for the application and execution of chemical products in the customs territory of the Eurasian Economic Union (hereinafter - the Union), to ensure their free movement when released into circulation in the customs territory of the Union.

I. Scope of application

1. This technical regulation has been adopted in order to protect human life and health, property, the environment, the life and health of animals and plants, and to prevent actions that mislead consumers (purchasers).


2. This technical regulation establishes uniform mandatory requirements for the application and execution in the customs territory of the Union for chemical products put into circulation in the customs territory of the Union, as well as rules and forms for assessing their compliance, identification rules, requirements for terminology, labeling and rules for its application.


Requirements for the processes of production, storage, transportation( transportation), sale and disposal (processing) of chemical products are established in the technical regulations of the Union (Customs Union), which apply to certain types of chemical products.


3. This technical regulation applies to all chemical products put into circulation in the customs territory of the Union, with the exception of products according to the list according to Annex N 1.


With respect to certain types of chemical products that are subject to regulation by other technical regulations of the Union (Customs Union) that establish specific requirements for these types of chemical products, this technical regulation applies in terms of requirements for classification, warning labeling and safety data sheet of chemical products, if these requirements are not established by other technical regulations of the Union (Customs Union).

II. Basic concepts

4. For the purposes of applying this technical regulation, the following concepts and their definitions are used:


"bioaccumulation" - the ability of chemicals to accumulate in biological objects;


"explosive chemical products" - solid or liquid chemical products that are themselves capable of a chemical reaction with the release of gases at such a temperature and pressure and at such a speed that it causes damage to surrounding objects;


"flammable liquid" - a liquid having an ignition temperature not exceeding 93°C;


"flammable chemical products in a solid state" - products that can easily catch fire or cause ignition or gorenje combustion as a result of friction;


"danger sign" is a colorographic image of a certain geometric shape using contrasting colors, graphic symbols and explanatory inscriptions intended to warn citizens about an immediate or potential danger, prohibit, prescribe or allow certain actions;


"selective toxicity" is a type of exposure that causes violations of the functions of individual organs (target organs) and (or) systems of a living organism with a single and short-term or with repeated and prolonged exposure;


"importer" - a resident of a Member state of the Union who has concluded a foreign trade agreement with a non - resident of a Member state of the Union for the import of chemical products into the customs territory of the Union, sells chemical products and is responsible for its compliance with the requirements of this technical regulation;


"carcinogenicity" - the ability of chemical products to cause mutations (changes in the genetic structure of a living cell) that can lead to the development of malignant neoplasms (tumors);


"carcinogens" - chemical products that can cause or accelerate the development of malignant neoplasms (tumors);


"classification" - determination of the conformity of chemical products to a specific hazard class (subclass, type) according to the hazard criteria;


"corrosive chemical products" - products that, as a result of chemical exposure, can significantly damage or destroy materials;


"hazard criteria" - quantitative and (or) qualitative values of the state of chemical products from the point of view of safety for humans, animals, the environment, as well as property, on the basis of which an assessment of the type and level of hazardous exposure is formed;


"mutagen" is a chemical product that can cause an increase in the number of cases of mutation in the population of living cells and living organisms;


"mutagenicity" - the ability of chemical products to cause mutations;


"new chemical products" - chemical products that are a new chemical substance or contain new chemicals;


"new chemical substance" - a chemical substance whose information is not included in the register of chemical substances and mixtures of the Union;


"notification" - the procedure for including information about new chemicals in the register of chemicals and mixtures of the Union;


"oxidizing chemical products" - chemical products that support and intensify gorenje, causing ignition of other substances as a result of an exothermic redox reaction or contributing to such ignition (oxidizing chemical products themselves are not necessarily flammable (combustible));


"organic peroxides" - organic substances in a liquid or solid state that contain a divalent structure and can be considered as a derivative product of hydrogen peroxide, in which one or both hydrogen atoms are replaced by organic radicals (organic peroxides and their mixtures are thermally unstable, which can lead to their self-accelerating exothermic decomposition);


"basic chemical substance" is a component of a chemical product that is not an additive or impurity, makes up a significant part of this product and is therefore used as the name of the chemical product and its detailed identification;


"acute toxicity" - negative consequences that occur after the introduction of a substance into the stomach, or applying a single dose of a substance to the skin, or repeated exposure to a substance for 24 hours, or ingestion of a substance with inhaled air for 4 hours;


"safety data sheet" - a safety data sheet of chemical products of the established form containing information about the hazardous properties of chemical products, information about the manufacturer (authorized by the manufacturer), the importer of these products, preventive measures and safety requirements to ensure safe handling of chemical products in the customs territory of the Union;


"persistence" - the resistance of chemical products to the processes of decomposition and transformation;


"pyrophoric chemical products" - chemical products that (even in small quantities) can ignite within 5 minutes after contact with air;


"consumer (acquirer)" - a registered legal entity or an individual as an individual entrepreneur, as well as an individual who intends to purchase (acquire) chemical products;


"preventive measures" - measures that must be taken to minimize or prevent adverse effects caused by exposure to dangerous chemical products;


"register of chemicals and mixtures of the Union" is an information resource containing information about the properties of chemicals and mixtures, including information about their prohibition, restriction or permission for their use in the customs territory of the Union;


"self-heating chemical products" - chemical products in a liquid or solid aggregate state (with the exception of pyrophoric chemical products), which, when in contact with air without external energy supply, is capable of self-heating (self-heating chemical products differ from pyrophoric products in that they ignite only in large quantities (kilograms) and after a long period of time (hours, days));


"sensitizing effect" - increasing the sensitivity of the body to the effects of xenobiotics that cause an allergic reaction;


"mixture" - a mixture or solution consisting of two or more chemicals in which the chemicals do not react with each other;


"toxicity" is the ability of a chemical product to cause damage or death of an organism by acting on it in a non-mechanical way;


"chemical products" - a chemical substance or mixture;


"chemical substance" - chemical elements and (or) their compounds that are in a natural state or obtained as a result of any production process, including any additives necessary to ensure stability, and any impurities caused by the process of obtaining chemical products, excluding any solvent that can be separated without disturbing the stability of the chemical substance or changing its composition (chemicals include chemical products in which the chemical substance is present in a concentration of 80 percent (by weight) or more, at the same time, the remaining 20 percent (by weight) and less are considered impurities and (or) additives);


"chronic toxicity" is a type of toxicity that causes disease and (or) death of a living organism with repeated and (or) prolonged exposure;


"ecotoxic chemical" is a chemical that can cause adverse effects in the environment.

III. Rules for the identification of chemical products

5. Identification of chemical products is carried out by the manufacturer (a person authorized by the manufacturer), the importer of these products.


6. Identification of chemical products includes:


a) establishment of the name of the chemical product;


b) classification of chemical products as chemical substances or mixtures;


c) establishment of a name for a chemical substance according to the nomenclature of the International Union for Theoretical and Applied Chemistry (hereinafter referred to as the IUPAC nomenclature) and the identifier of the chemical substance (CAC) entered in the register of the Chemical Reference Service of the American Chemical Society (hereinafter referred to as the CAC number) (if available);


d) determination of the chemical composition of the mixture with the establishment for each of the identifiable components of the name according to the IUPAC nomenclature and the CAS number (if available);


e) determination of the presence of new chemicals in the composition of chemical products in concentrations greater than 0.1%;


f) classification of chemicals in the composition of chemical products as:


new chemicals;


chemicals prohibited for use in the customs territory of the Union;


chemicals restricted for use in the customs territory of the Union;


g) determination of the scope of application of chemical products;


h) other necessary information.


7. When determining the chemical composition of a chemical substance, it is necessary to identify:


a) the main chemical substance;


b) dangerous chemicals in the composition of additives and impurities, if they are present in quantities exceeding the concentrations specified in the standards included in the list of standards, as a result of the application of which compliance with the requirements of this technical regulation is ensured on a voluntary basis.


8. When determining the chemical composition of the mixture, it is necessary to identify:


a) chemicals present in concentrations greater than 10%;


b) dangerous chemicals present in quantities exceeding the concentration values specified in the standards included in the list of standards, as a result of the application of which compliance with the requirements of this technical regulation is ensured on a voluntary basis.


9. Manufacturers (persons authorized by the manufacturer), importers of chemical products for their identification use information about chemicals and mixtures contained in the register of chemicals and mixtures of the Union.

IV. Rules for the circulation of chemical products on the Union market

10. Chemical products are put into circulation in the customs territory of the Union if they comply with the requirements of this technical regulation, as well as the requirements of other technical regulations of the Union (Customs Union), which apply to them, and provided that they have passed the assessment of compliance with the technical regulations of the Union (Customs Union), which apply to them.


11. If there is no information about chemical products in the register of chemical substances and mixtures of the Union, chemical products must be identified as new chemical products, and new chemicals that are part of it must be notified in accordance with paragraphs 46-48 of this technical regulation before the release into circulation in the customs territory of the Union of chemical products containing such chemicals.


12. The procedure for forming and maintaining the register of chemical substances and mixtures of the Union is established by the Eurasian Economic Commission.


13. Chemical products that meet the requirements of this technical regulation and other technical regulations of the Union (Customs Union), which apply to it, and have passed the conformity assessment, are marked with a single product circulation mark on the Union market.

V. Requirements for the classification of chemical products

14. The classification of chemical products is carried out by the manufacturer (a person authorized by the manufacturer), the importer of such products.


Classification of chemical products is carried out in accordance with the list of international and regional (interstate) standards, and in their absence - national (state) standards, as a result of the application of which compliance with the requirements of this technical regulation is ensured on a voluntary basis.


15. Classification of chemical products by hazardous properties is carried out taking into account data on the hazardous properties of chemicals and mixtures:


a) contained in the register of chemicals and mixtures of the Union;


b) obtained as a result of their studies (tests) for compliance with the criteria specified in the standards included in the list of standards, as a result of the application of which compliance with the requirements of this technical regulation is ensured on a voluntary basis.


16. According to the types of dangerous effects on human life and health, property, the environment, the life and health of animals and plants associated with the physical and chemical properties of chemical products, chemical products are divided into:


a) explosive chemical products;


b) compressed gas (liquefied gas);


c) flammable gaseous chemical products (flammable gas);


d) flammable chemical products in aerosol packaging;


e) a flammable (combustible) liquid;


f) flammable chemical products in a solid state;


g) self-decomposing (self-reactive) chemical products;


h) pyrophoric chemical products;


i) self-heating chemical products (with the exception of pyrophoric chemical products);


j) chemical products that are dangerous in contact with water;


l) oxidizing chemical products;


m) organic peroxides;


h) corrosion-active chemical products.


17. The following chemical products, which contain dangerous chemicals and mixtures in an amount exceeding the concentration values specified in the standards included in the list of international and regional (interstate) standards, and in their absence - national (state) standards, as a result of the application of which compliance with the requirements of this technical regulation is ensured on a voluntary basis, belong to chemical products that exhibit dangerous properties with respect to human and animal life and health:


a) having acute toxicity with respect to exposure to a living organism;


b) causing corrosion (necrosis) and skin irritation;


c) causing serious damage (irritation) to the eyes;


d) having a sensitizing effect;


e) having mutagenic properties (mutagens);


f) having carcinogenic properties (carcinogens);


g) affecting the reproductive function;


h) having selective toxicity to individual organs (target organs) and (or) systems of a living organism with a single and short-term exposure or with repeated and prolonged exposure;


i) presenting a danger during aspiration;


k) resistant, capable of accumulation of toxic substances in biological objects;


l) characterized by special resistance and the ability to bioaccumulate;


m) the level of danger of which corresponds to the level of danger of such compounds, such as, in particular, "destroyers" of the endocrine system, for which there is scientifically substantiated evidence of their likely serious impact on the environment and human health.


18. Chemical products dangerous to the environment include the following chemical products, which contain dangerous chemicals and mixtures in an amount exceeding the concentration values specified in the standards included in the list of international and regional (interstate) standards, and in their absence-national (state) standards, as a result of the application of which compliance with the requirements of this technical regulation is ensured on a voluntary basis:


a) destroying the ozone layer;


b) having acute and chronic toxicity to the aquatic environment;


c) having the ability to bioaccumulate;


d) resistant to the processes of decomposition and transformation (persistence);


e) having toxicity to the soil.


19. The main elements of the classification of chemical products hazardous to the aquatic environment are:


a) acute toxicity in the aquatic environment;


b) chronic toxicity in the aquatic environment;


c) bioaccumulation potential or actual bioaccumulation;


d) decomposition (biotic and abiotic) - in relation to organic chemicals.


20. Chemical products are products that destroy the ozone layer if they contain at least one substance from the list of chemicals that destroy the ozone layer. The list of chemicals that deplete the ozone layer is determined by interstate agreements of the Member States of the Union (hereinafter referred to as the Member States) and international agreements, to which all Member States have joined, in the field of regulating the import of such chemical products into the customs territory of the Union.


21. The classification of chemical products that are dangerous for soils is carried out on the basis of a set of hazard indicators for chemical products, which includes:


a) toxicity to soil organisms;


b) persistence in the soil;


c) persistence in plants;


d) the ability to migrate chemical products;


e) the impact on the nutritional value of agricultural products.


22. Classification of chemical products by hazardous properties is carried out on the basis of data obtained as a result of studies (tests) of chemical substances that are part of it, or mixtures as a whole, or according to the results of data obtained using calculation methods for chemical products that are mixtures.


23. The results of the classification of chemical products by hazardous properties, carried out using data obtained as a result of studies (tests) of chemical substances or mixtures that are part of it, have priority over the classification results obtained using calculation methods.


24. The established class (subclass, type) of hazard of chemical products is indicated by the manufacturer (a person authorized by the manufacturer), the importer of these products in the safety data sheet.


25. Studies (tests) of chemical products for classification purposes are carried out by the manufacturer (a person authorized by the manufacturer), the importer of these products in laboratories (centers) of their choice.


26. The classification of mixtures by hazardous properties is carried out in accordance with the following principles:


a) if there are research (test) data on chemicals in the composition of mixtures or mixtures as a whole, the classification is carried out on the basis of these data;


b) in the absence of research (test) data on chemicals in mixtures or mixtures in general, interpolation or extrapolation methods are used (hazard assessment methods using available data on mixtures similar to those classified);


c) in the absence of research (test) data on mixtures as a whole and there is no information that would allow the use of interpolation or extrapolation methods, hazard assessment methods based on data on individual chemicals in the mixture are used for classification.


27. Chemical products, when changing their component composition, are subject to re-classification if, with such a change, the concentration of the chemicals included in it in relation to their initial concentration exceeded the permissible deviations of the content of dangerous chemicals in the composition of chemical products according to Annex N 2.

VI. Chemical product safety requirements

28. The safety of the handling of chemical products should be ensured by:


a) compliance by the manufacturer (the person authorized by the manufacturer), the importer of chemical products with the requirements of this technical regulation;


b) the use (application) by the consumer (buyer) of chemical products for their intended purpose;


c) assessment of compliance of chemical products with the requirements of this technical regulation;


d) implementation by the manufacturer (a person authorized by the manufacturer), the importer and the consumer (buyer) of chemical products of preventive measures when handling chemical products;


e) replacement of hazardous chemicals with chemicals of a lower hazard class or with those not classified as dangerous (if possible);


f) informing the consumer (acquirer) about the dangerous properties of chemical products in relation to human life and health, property, the environment, the life and health of animals and plants, as well as measures for its safe handling in the customs territory of the Union, including in the event of expiration or unsuitability of use;


g) informing the consumer (buyer) about the methods of safe disposal and neutralization of chemical products.

VII. Requirements for the labeling of chemical products

29. The labeling of chemical products should include the following information:


a) the name of the chemical product established during its identification (the name of the chemical product may additionally include a trade (brand) name);


b) the name, location (address of the legal entity), including the country, and telephone number of the manufacturer (authorized by the manufacturer), importer of chemical products;


c) the name of chemicals and mixtures classified as dangerous and contained in the composition of chemical products in quantities exceeding the concentration values specified in the standards included in the list of international and regional (interstate) standards, and in their absence-national (state) standards, as a result of the application of which compliance with the requirements of this technical regulation is ensured on a voluntary basis;


d) storage conditions and warranty obligations of the manufacturer (shelf life, shelf life, etc.);


e) the designation of the document according to which the chemical products are manufactured (if available);


(e) Information on the hazardous properties of chemical products, including warning labels.


30. The marking of chemical products put into circulation in the customs territory of the Union must be applied in Russian and, if there are relevant requirements in the legislation of the Member states, in the official languages of the member state on whose territory the chemical products are sold.


31. The marking must be clear and easy to read, resistant to mechanical stress, to the effects of chemicals, climatic factors and must be preserved until the full use and (or) disposal (processing) of chemical products.


32. The labeling of chemical products may contain additional information.


33. The marking of chemical products is applied directly to the product packaging or to its label attached to the package. The elements of the warning label should be distinguished in comparison with other information contained in the labeling of chemical products, and must comply with GOST 31340-2013.


34. If there is not enough space for marking on the package, the chemical products are accompanied by a label or insert, where the information specified in paragraph 29 of this technical regulation is given in full.

VIII. Requirements for warning labels

35. The warning marking is applied in the form of a danger sign, a danger symbol, a signal word and contains a description of measures to prevent danger in accordance with GOST 31340-2013.

IX. Requirements for the safety data sheet

36. The manufacturer (the person authorized by the manufacturer), the importer of chemical products, who release chemical products into circulation in the customs territory of the Union, draw up a safety data sheet.


When drawing up a safety data sheet, information on the properties of chemicals and mixtures contained in the register of chemicals and mixtures of the Union can be used.


37. The safety data sheet for the supply of chemical products should be included in the accompanying documentation for chemical products.


38. The safety data sheet is issued before the release of chemical products into circulation in the customs territory of the Union.


39. The requirements for the information that should be contained in the safety data sheet are specified in GOST 30333-2007.


40. The original of the safety data sheet is kept by the manufacturer (a person authorized by the manufacturer), the importer of chemical products.


41. The validity period of the safety data sheet is not limited.


42. The safety data sheet is subject to updating and reissue in the following cases:


a) change of the name and (or) address of the manufacturer (the person authorized by the manufacturer), the importer of chemical products;


b) a change in the composition of chemical products, leading to the re-classification of these products in accordance with paragraph 27 of this technical regulation;


c) the receipt of additional or new information that increases the completeness and reliability of the data.


43. At the request of consumers (purchasers) of chemical products and any interested registered legal entities or individuals as individual entrepreneurs, as well as individuals, a copy of the safety data sheet must be provided to them free of charge by the manufacturer (a person authorized by the manufacturer), the importer of these products.

X. Ensuring compliance of chemical products with the requirements of technical regulations

44. Compliance of chemical products with this technical regulation is ensured by the fulfillment of its requirements.


45. The methods of research (testing) of chemical products are established in the standards included in the list of international and regional (interstate) standards, and in their absence-national (state) standards containing the rules and methods of research (testing) and measurements, including the rules of sampling necessary for the application and fulfillment of the requirements of this technical regulation and the implementation of conformity assessment of chemical products.

XI. Notification of new chemicals

46. Notification of new chemicals is carried out by entering information about them in the register of chemicals and mixtures of the Union.


47. Notification is carried out by the authorized bodies of the Member States (hereinafter referred to as the authorized bodies) in respect of new chemicals released into circulation in the customs territory of the Union after the entry into force of this technical regulation, in accordance with the procedure established by the Eurasian Economic Commission.


48. Information sent to the authorized body for the purpose of notifying new chemicals should include:


a) chemical safety report in accordance with the structure according to Annex N 3;


b) the name of the chemical substance according to the IUPAC nomenclature, including in English;


c) the structural formula of the chemical substance;


d) CAS number;


e) data of instrumental analysis of the chemical substance;


e) the degree of purity of the chemical substance;


g) intended applications of the chemical substance;


h) proposed methods of disposal (processing) of the chemical substance;


i) the method of transportation of the chemical substance and measures to prevent and eliminate the emergency situations that have arisen;


k) analytical methods of control;


l) physical and chemical data of the chemical substance;


m) data on the toxicity of the chemical substance;


h) data on the ecotoxicity of the chemical;


o) copies of the data (protocols) of studies (tests) of a chemical substance to determine bioaccumulation, carcinogenicity, mutagenicity, toxicity conducted in laboratories (centers) recognized as corresponding to the principles of good laboratory practice by the authorized body in accordance with the legislation of the member state( )(it is allowed to conduct studies (tests) in other laboratories (centers) within 2 years from the date of entry into force of this technical regulation).

XII. Assessment of compliance of chemical products with the requirements of technical regulations

49. Chemical products are subject to conformity assessment before being put into circulation in the customs territory of the Union.


50. The assessment of compliance of chemical products with the requirements of this technical regulation is carried out in the following forms:


a) notification state registration;


b) permissive state registration.


51. In the case of notification state registration and permissive state registration of chemical products, applicants may be legal entities registered in accordance with the legislation of a Member state on its territory or individuals as individual entrepreneurs who are manufacturers (persons authorized by the manufacturer), importers of these products.


52. Notification state registration and permissive state registration of chemical products are carried out by the authorized body.


53. The notification state registration of chemical products is carried out if the information about chemical products is included in the register of chemical substances and mixtures of the Union and one of the following requirements is met:


a) the composition of chemical products does not include prohibited and (or) restricted for use chemicals and mixtures included in the register of chemicals and mixtures of the Union;


b) chemical products contain restricted chemicals and mixtures, information about which is included in the register of chemicals and mixtures of the Union, in concentrations below the established limit content according to Annex N 4.


54. For the notification state registration of chemical products with the issuance of a certificate of notification state registration of chemical products, the applicant submits the following documents to the authorized body:


a) an application for the notification state registration of chemical products in the form according to annex N 5;


b) a safety data sheet issued in accordance with paragraphs 36-43 of this technical regulation;


c) protocols of studies (tests) conducted in testing (research) laboratories (centers), and (or) documents containing information obtained from official information sources. Research (test) protocols are not submitted for chemical products included in the register of chemical substances and mixtures of the Union, as well as for chemical products that can be classified using calculation methods.


55. The notification state registration of chemical products can be carried out in electronic form.


56. In order to carry out the notification state registration of chemical products in accordance with paragraph 55 of this technical regulation, the applicant submits to the authorized body in electronic form the documents specified in paragraph 54 of this technical regulation.


57. Consideration of the documents submitted by the applicant both in electronic form and on paper, making a decision on the notification state registration of chemical products or on refusal thereof, assigning an individual registration number to chemical products, issuing a certificate of notification state registration of chemical products in accordance with Annex N 6, as well as marking the registration in electronic form, are carried out by the authorized body within 10 working days from the date of receipt of the documents, specified in paragraph 54 of this technical regulation.


58. The validity period of the certificate of notification state registration of chemical products and the electronic registration mark is not limited.


59. Permissive state registration is carried out in respect of:


a) new chemical products;


b) chemical products that contain chemicals and mixtures restricted for use, information about which is included in the register of chemicals and mixtures of the Union, in concentrations exceeding the maximum content established in Annex N 4 to this technical regulation.


60. For the permissive state registration of chemical products, the applicant sends the following documents to the authorized body:


a) an application for the permissive state registration of chemical products in the form provided for in annex N 5 to this technical regulation;


b) a safety data sheet issued in accordance with paragraphs 36-43 of this technical regulation;


c) protocols of studies (tests) conducted in testing (research) laboratories (centers), and (or) documents containing information obtained from official information sources. Research (test) reports are not submitted for chemical products, information about which is included in the register of chemical substances and mixtures of the Union, as well as for chemical products that can be classified using calculation methods;


d) the information specified in paragraph 48 of this technical regulation.


61. Consideration of the documents submitted by the applicant, making a decision on the permissive state registration of chemical products or on refusal thereof, assigning an individual registration number to chemical products, entering information about the name of chemical products, its chemical composition and properties in the register of chemical substances and mixtures of the Union, issuing a permit for the use of chemical products in accordance with annex N 7 are carried out by the authorized body within 45 working days from the date of receipt of the documents, specified in paragraph 60 of this technical regulation.


62. The validity period of a permit for the use of chemical products is 5 years from the date of its issuance.


If there are no comments from the authorized body on the non-compliance of chemical products with the requirements of this technical regulation within 5 years from the date of issuing a permit for the use of chemical products, the authorized body automatically re-registers these products.


63. Registration and issuance of a certificate of notification state registration of chemical products and a permit for its use are carried out by the authorized body in accordance with the procedure for forming and maintaining the register of chemicals and mixtures of the Union and the procedure for notifying new chemicals.


64. Notification and permissive state registration of chemical products may be refused if:


a) submission by the applicant of incomplete or unreliable information specified in paragraphs 54 and 60 of this technical regulation;


b) non-compliance of chemical products with the requirements of this technical regulation.


65. Chemical products, when changing their component composition, are subject to repeated notification state registration or permissive state registration, if, with such a change, the concentration of dangerous chemicals included in its composition in relation to their initial concentration exceeded the permissible deviations specified in Annex N 2 to this technical regulation.


66. The release of chemical products into circulation in the customs territory of the Union may be suspended by the authorized body if:


a) chemical products in circulation in the customs territory of the Union do not meet the requirements of this technical regulation;


b) new safety requirements have been established for chemical products.

XIII. Marking of chemical products with a single product circulation mark on the Union market

67. Chemical products that meet the requirements of this technical regulation and other technical regulations of the Union (Customs Union), which apply to it, and have passed the conformity assessment procedure in accordance with the provisions of this technical regulation, are marked with a single product circulation mark on the Union market.


68. Marking with a single sign of circulation of products on the Union market is carried out before the release of chemical products into circulation in the customs territory of the Union.


69. A single product circulation mark on the Union market is applied to each unit of chemical products (consumer and transport packaging, or label, or label) in any way that provides a clear and clear image of it during the entire shelf life of such chemical products.


If it is impossible to apply a single product circulation mark on the Union market to consumer and transport packaging, or a label, or a label, it is allowed to apply it to the accompanying documents.


70. The marking of chemical products with a single product circulation mark on the Union market indicates the compliance of chemical products with the requirements of this technical regulation and other technical regulations of the Union (Customs Union), which apply to it.

XIV. State control (supervision) over compliance with the requirements of the technical regulations

71. State control (supervision) over compliance with the requirements of this technical regulation in relation to chemical products is carried out in accordance with the legislation of the Member states.

2. Minerals in the state of occurrence, as well as the following products, if they have not been chemically modified: minerals, ores, ore concentrates, cement clinker, natural gas, liquefied gas, gas condensate, process gas and its components, dehydrated, desalinated and stabilized oil, associated petroleum gas, coal, coke.


3. Medicinal products and veterinary medicinal products.


4. Perfume and cosmetic products.


5. Chemical products that are a source of ionizing radiation (including waste of such products), in terms of classification, labeling and informing about the dangers caused by the presence of radiation in it.


6. Food products, including biologically active food additives and food additives, as well as ready-made animal feed.


7. Products in the composition of products that do not change their chemical composition and aggregate state during circulation in the customs territory of the Eurasian Economic Union, are not subject to degradation and oxidation processes, do not form dust, vapors and aerosols containing chemicals that pose a danger to human life and health, the life and health of animals and plants, the environment, property.


8. Waste from the production and consumption of chemical products, if they are subject to disposal (processing).


9. Chemical products subject to the customs transit procedure through the customs territory of the Eurasian Economic Union.
