On safety of low-voltage equipment

Preface

1. This technical regulation of the Customs Union has been developed in accordance with the Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.



2. This technical regulation of the Customs Union has been developed for the purpose of establishing uniform mandatory requirements for low-voltage equipment in the single customs territory of the Customs Union, ensuring the free movement of low-voltage equipment put into circulation in the single customs territory of the Customs Union.



3. If other technical regulations of the Customs Union, the Eurasian Economic Community (hereinafter referred to as the EurAsEC) have been adopted with respect to low - voltage equipment, which establish requirements for low-voltage equipment, then the low-voltage equipment must comply with the requirements of these technical regulations of the Customs Union, the EurAsEC, which apply to it.

Article 1. Scope of application

1. This technical regulation of the Customs Union applies to low-voltage equipment put into circulation in the single customs territory of the Customs Union.


Low-voltage equipment, which is subject to this technical regulation of the Customs Union, includes electrical equipment intended for use at a rated voltage from 50 to 1000 V (inclusive) of alternating current and from 75 to 1500 V (inclusive) of direct current.


2. This technical regulation of the Customs Union does not apply to:


electrical equipment designed for operation in an explosive environment;


medical devices;


electrical equipment of elevators and cargo lifts (except electric machines);


electrical equipment for defense purposes;


control devices for pasture fences;


electrical equipment intended for use in air, water, ground and underground transport;


electrical equipment intended for safety systems of reactor installations of nuclear power plants.


3. This technical regulation of the Customs Union establishes requirements for low-voltage equipment in order to protect human life and health, property, as well as to prevent actions that mislead consumers (users) regarding its purpose and safety.

Article 2. Definitions

In this technical regulation of the Customs Union, the following terms and their definitions are used:


manufacturer - a legal entity or an individual as an individual entrepreneur who carries out the production and (or) sale of low-voltage equipment on their own behalf and is responsible for its compliance with the safety requirements of the technical regulations of the Customs Union;


an importer-a resident of a member state of the Customs Union who has concluded a foreign trade agreement with a non-resident of the member states of the Customs Union for the transfer of low-voltage equipment, implements this equipment and is responsible for its compliance with the safety requirements of this technical regulation of the Customs Union;


rated voltage of low-voltage equipment - the input and (or) output voltage (voltage range) of low-voltage equipment specified by the manufacturer on this equipment and in the operating documents;


circulation of low-voltage equipment on the market - the processes of transition of low-voltage equipment from the manufacturer to the consumer (user) in the single customs territory of the Customs Union, which low-voltage equipment passes after its manufacture is completed;


intended use - the use of low-voltage equipment in accordance with the purpose specified by the manufacturer on this equipment and (or) in the operational documents;


a person authorized by the manufacturer is a legal entity or an individual registered in accordance with the established procedure by a member state of the Customs Union, which is determined by the manufacturer on the basis of an agreement with him to perform actions on his behalf when confirming compliance and placing products in the single customs territory of the Customs Union, as well as to impose responsibility for non-compliance of products with the requirements of the technical regulations of the Customs Union;


electrical equipment - equipment intended for the generation, conversion, transmission, distribution and use of electrical energy, including both for direct use and built into machines, mechanisms, apparatuses, devices and other products.

Article 3. Rules of circulation on the market

1. Low-voltage equipment is put into circulation on the market if it complies with this technical regulation of the Customs Union, as well as other technical regulations of the Customs Union, EurAsEC, which apply to it, and provided that it has passed the confirmation of compliance in accordance with Article 7 of this technical regulation of the Customs Union, as well as in accordance with other technical regulations of the Customs Union, EurAsEC, which apply to it.


2. Low-voltage equipment, whose compliance with the requirements of this technical regulation of the Customs Union is not confirmed, should not be marked with a single product circulation mark on the market of the member states of the Customs Union and is not allowed to be put into circulation on the market.


3. Low-voltage equipment that is not marked with a single circulation mark on the market of the member states of the Customs Union is not allowed to be put into circulation on the market.

Article 4. Safety requirements

Low-voltage equipment must be designed and manufactured in such a way that, when used for its intended purpose and meeting the requirements for installation, operation (use), storage, transportation (transportation) and maintenance, this equipment provides:


the required level of protection against direct or indirect exposure to electric current;


there is no unacceptable risk of high temperatures, arc discharges or radiation that can lead to hazards;


the necessary level of protection against injury by rotating and stationary parts of low-voltage equipment;


the necessary level of protection against non-electrical hazards arising from the use of low-voltage equipment, including those caused by physical, chemical or biological factors;


the required level of insulation protection;


the required level of mechanical and switching wear resistance;


the necessary level of resistance to external factors, including non-mechanical ones, under appropriate climatic conditions of the external environment;


absence of unacceptable risk in case of overloads, emergency modes and failures caused by the influence of external and internal influencing factors;


no unacceptable risk during connection and / or installation.


Low-voltage equipment must be designed and manufactured in such a way that it is not a source of fire in normal and emergency operating conditions.


The consumer (user) must be provided with the necessary level of information for the safe use of low-voltage equipment for its intended purpose.

Article 5. Requirements for marking and operational documents

1. The name and (or) designation of low-voltage equipment (type, brand, model), its main parameters and characteristics affecting safety, the name and (or) trademark of the manufacturer, the name of the country where the low-voltage equipment is manufactured, must be applied to the low-voltage equipment and indicated in the operational documents attached to it.


In this case, the name of the manufacturer and (or) its trademark, the name and designation of low-voltage equipment (type, brand, model) must also be applied to the packaging.


2. If the information given in paragraph 1 of this article cannot be applied to low-voltage equipment, they can only be indicated in the operational documents attached to this equipment. In this case, the name of the manufacturer and (or) its trademark, the name and designation of low-voltage equipment (type, brand, model (if available)) they must be applied to the packaging.


3. The marking of low-voltage equipment should be legible, easy to read and applied to low-voltage equipment in a place accessible for inspection without disassembly with the use of a tool.


4. The operational documents for low-voltage equipment must contain: the information listed in paragraph 1 of this article;


information about the purpose of low-voltage equipment;


characteristics and parameters;


rules and conditions of safe operation (use);


rules and conditions of installation, storage, transportation( transportation), sale and disposal (if necessary, the establishment of requirements for them);


information about the measures to be taken when a malfunction of this equipment is detected;


the name and location of the manufacturer (the person authorized by the manufacturer), the importer, information for contacting them;


the month and year of manufacture of low-voltage equipment and (or) information about the place of application and the method of determining the year of manufacture.


5. Operational documents are executed in Russian and in the state language (s) of the member state of the Customs Union, if there are relevant requirements in the legislation of the member state(s) of the Customs Union.


Operational documents are executed on paper. A set of operational documents on electronic media can be attached to them. Operational documents included in the set of low-voltage equipment for non-household purposes can only be performed on electronic media.

Article 5. Requirements for marking and operational documents

1. The name and (or) designation of low-voltage equipment (type, brand, model), its main parameters and characteristics affecting safety, the name and (or) trademark of the manufacturer, the name of the country where the low-voltage equipment is manufactured, must be applied to the low-voltage equipment and indicated in the operational documents attached to it.


In this case, the name of the manufacturer and (or) its trademark, the name and designation of low-voltage equipment (type, brand, model) must also be applied to the packaging.


2. If the information given in paragraph 1 of this article cannot be applied to low-voltage equipment, they can only be indicated in the operational documents attached to this equipment. In this case, the name of the manufacturer and (or) its trademark, the name and designation of low-voltage equipment (type, brand, model (if available)) they must be applied to the packaging.

the name and location of the manufacturer (the person authorized by the manufacturer), the importer, information for contacting them;


the month and year of manufacture of low-voltage equipment and (or) information about the place of application and the method of determining the year of manufacture.


5. Operational documents are executed in Russian and in the state language (s) of the member state of the Customs Union, if there are relevant requirements in the legislation of the member state(s) of the Customs Union.


Operational documents are executed on paper. A set of operational documents on electronic media can be attached to them. Operational documents included in the set of low-voltage equipment for non-household purposes can only be performed on electronic media.

Article 6. Ensuring compliance with safety requirements

1. Compliance of low-voltage equipment with this technical regulation of the Customs Union is ensured by meeting its safety requirements directly or by meeting the requirements of standards included in the List of Standards, as a result of the application of which compliance with the requirements of the technical regulations of the Customs Union is ensured on a voluntary basis.


2. The methods of research (testing) and measurement of low-voltage equipment are established in the standards included in the List of Standards containing the rules and methods of research (testing) and measurement, including the rules of sampling necessary for the application and fulfillment of the requirements of the technical regulations of the Customs Union and the assessment (confirmation) of product conformity.

Article 7. Confirmation of conformity

1. Before putting into circulation on the market, low-voltage equipment must pass a confirmation of compliance with the safety requirements of this technical regulation of the Customs Union.


Confirmation of compliance of low-voltage equipment is carried out according to the schemes in accordance with the Regulation on the procedure for applying standard conformity assessment (confirmation) schemes in the technical regulations of the Customs Union, approved by the Commission of the Customs Union (hereinafter - the Commission).


2. Low-voltage equipment included in the List given in the annex to this technical regulation of the Customs Union is subject to conformity assessment in the form of certification (schemes 1c, 3c, 4c).


Low-voltage equipment not included in the specified List is subject to conformity assessment in the form of declaration of conformity (schemes 1d, 2d, 3d, 4d, 6d). The choice of a scheme for declaring compliance with low-voltage equipment not included in the List is carried out by the manufacturer (a person authorized by the manufacturer), the importer.


According to the decision of the manufacturer (the person authorized by the manufacturer), the importer, confirmation of compliance of low-voltage equipment not included in the List may be carried out in the form of certification in accordance with paragraph 5 of this article.


In case of non-application of the standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union, or in their absence, confirmation of compliance of low-voltage equipment is carried out in the form of certification (schemes 1c, 3c, 4c) in accordance with paragraph 10 of this article.


3. Certification of low-voltage equipment produced in series is carried out according to the 1c scheme. Low-voltage equipment for certification is provided by the manufacturer (a person authorized by the manufacturer).


Certification of a batch of low-voltage equipment is carried out according to scheme 3c, a single product - according to scheme 4c. A batch of low-voltage equipment (a single product) manufactured in the single customs territory of the Customs Union is represented by the manufacturer, a batch of low-voltage equipment (a single product) imported into the single customs territory of the Customs Union is represented by the importer or manufacturer (a person authorized by the manufacturer).


4. Certification of low-voltage equipment is carried out by an accredited certification body (assessment (confirmation) of conformity) included in the Unified Register of Certification Bodies and Testing laboratories (centers) of the Customs Union.


Tests for certification purposes are carried out by an accredited testing laboratory (center) included in the Unified Register of Certification Bodies and Testing Laboratories (Centers) of the Customs Union.


5. During the certification of low-voltage equipment (schemes 1c, 3c, 4c):


5.1. the manufacturer (the person authorized by the manufacturer), the importer provides the certification body (assessment (confirmation) of compliance) with a set of documents for low-voltage equipment confirming the compliance of low-voltage equipment with the safety requirements of this technical regulation of the Customs Union, which includes:


technical specifications (if available);


operational documents;


the list of standards, the requirements of which this low-voltage equipment must meet from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union;


contract (supply contract) or shipping documentation (for a batch of low-voltage equipment (a single product) (schemes 3c, 4c);


5.2. The manufacturer takes all necessary measures to ensure that the production process is stable and ensures that the manufactured low-voltage equipment meets the requirements of this technical regulation of the Customs Union;


5.3. certification body (conformity assessment (confirmation)):


5.3.1. performs the selection of a sample (samples);


5.3.2. carries out the identification of low-voltage equipment by establishing the identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs Union, the provisions established in Article 5 of this technical regulation of the Customs Union, and the documents listed in subparagraph 5.1 of paragraph 5 of this Article;


5.3.3. organizes testing of a sample (samples) of low-voltage equipment for compliance with the requirements of standards from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union, and analyzes the test protocol (protocols) ;


5.3.4. analyzes the state of production (scheme 1c).


If the manufacturer has a certified quality management system for the production or development and production of low-voltage equipment, assesses the ability of this system to ensure the stable production of certified low-voltage equipment that meets the requirements of this technical regulation of the Customs Union;


5.3.5. issues a certificate of conformity according to a single form approved by the Commission. The validity period of the certificate of conformity for low-voltage equipment produced in series is not more than 5 years, for a batch of low-voltage equipment (a single product), the validity period of the certificate of conformity is not set;


5.4. manufacturer (a person authorized by the manufacturer), importer:


5.4.1. applies a single sign for the circulation of products on the market of the member states of the Customs Union;


5.4.2. forms a set of documents for low-voltage equipment after completion of the confirmation of compliance, which includes:


the documents provided for in subparagraph 5.1 of paragraph 5 of this article;


test report (s) ;


the results of the analysis of the state of production;


certificate of conformity.


5.5. the certification body (conformity assessment (confirmation)) conducts inspection control over certified low-voltage equipment by testing samples in an accredited testing laboratory (center) and (or) analyzing the state of production (scheme 1c).


6. Declaration of conformity of low-voltage equipment (schemes 1d, 2d, 3d, 4d, 6d) is carried out on the basis of:


6.1. own proofs (schemes 1d, 2d):


- conducting tests of low-voltage equipment (for a batch of low-voltage equipment (a single product) (scheme 2d);


- testing of low-voltage equipment and production control by the manufacturer (for low-voltage equipment produced in series) (scheme 1d);


6.2. evidence obtained with the participation of an accredited testing laboratory( center), a certification body for quality management systems included in the Unified Register of Certification Bodies and Testing Laboratories (centers) of the Customs Union (3d, 4d, 6d schemes):


- testing of low-voltage equipment, certification of the quality management system of production or development and production of low-voltage equipment and production control by the manufacturer (for low-voltage equipment produced in series) (scheme 6d).


- conducting tests of low-voltage equipment (for a batch of low-voltage equipment (a single product) (scheme 4d);


- testing of low-voltage equipment and production control by the manufacturer (for low-voltage equipment produced in series) (3d scheme);

6.3. The declaration of conformity of low-voltage equipment produced in series is carried out by the manufacturer (a person authorized by the manufacturer) according to the schemes 1d, 3d, 6d.


The declaration of conformity of a batch of low-voltage equipment (a single product) is carried out by the manufacturer (a person authorized by the manufacturer), the importer according to the schemes 2d, 4d.


7. When declaring the compliance of low-voltage equipment according to the schemes 1d, 2d:


7.1. manufacturer (a person authorized by the manufacturer), importer:


7.1.1. forms a set of documents confirming the compliance of low-voltage equipment with the requirements of this technical regulation of the Customs Union, which includes:


technical specifications (if available);


operational documents;


the list of standards, the requirements of which this low-voltage equipment meets, from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union;


the protocol (protocols) of tests carried out in the testing laboratory (center) at the choice of the manufacturer (the person authorized by the manufacturer), the importer;


certificate of conformity (if available);


declaration of conformity of the manufacturer (if available) (for a batch of low-voltage equipment (a single product) (scheme 2d);


contract (supply contract) or shipping documentation (for a batch of low-voltage equipment (a single product) (scheme 2d);


7.1.2. carries out the identification of low-voltage equipment by establishing the identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs Union, the provisions established in Article 5 of this technical regulation of the Customs Union, and the documents listed in subparagraph 7.1.1. of paragraph 7.1 of this Article;


7.2. manufacturer:


performs production control and takes all necessary measures to ensure that the production process ensures compliance of low-voltage equipment with the requirements of this technical regulation of the Customs Union (scheme 1d).


The requirements for the production and control processes, as well as the results of their control, must be documented (in the form established by the manufacturer);


7.3. manufacturer (a person authorized by the manufacturer), importer:


7.3.1. accepts a written declaration of compliance of low-voltage equipment with these technical regulations of the Customs Union in a single form approved by the Commission, and applies a single sign of product circulation on the market of the member states of the Customs Union;


7.3.2. after the completion of the conformity assessment, it includes a declaration of conformity in the set of documents for low-voltage equipment specified in subparagraph 7.1.1. of paragraph 7.1 of this Article.


8. When declaring the compliance of low-voltage equipment according to the schemes 3d, 4d, 6d:


8.1. manufacturer (a person authorized by the manufacturer), importer:


8.1.1. forms a set of documents for low-voltage equipment, which includes:


technical specifications (if available);


operational documents;


the list of standards, the requirements of which this low-voltage equipment must meet from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union;


contract (supply contract) or shipping documentation (for a batch of low-voltage equipment (a single product) (3d, 4d schemes);


certificate of conformity (a copy of the certificate) for the quality management system of production or development and production of low-voltage equipment (scheme 6d);


8.1.2. carries out the identification of low-voltage equipment by establishing the identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs Union, the provisions established in Article 5 of this technical regulation of the Customs Union, and the documents listed in subparagraph 8.1.1. of paragraph 8.1. of this Article;


8.1.3. organizes testing of a sample (samples) of low-voltage equipment for compliance with the requirements of standards from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union;


8.2. manufacturer:


performs production control and takes all necessary measures to ensure that the production process ensures compliance of low-voltage equipment with the requirements of this technical regulation of the Customs Union (schemes 3d, 6d). The requirements for the production and control processes, as well as the results of their control, must be documented (in the form established by the manufacturer);


takes all necessary measures to ensure that the production process and the stable functioning of the quality management system for the production or development and production of low-voltage equipment ensure that the low-voltage equipment meets the requirements of this technical regulation of the Customs Union (scheme 6d);


8.3. manufacturer (a person authorized by the manufacturer), importer:


8.3.1. accepts a written declaration of compliance of low-voltage equipment with these technical regulations of the Customs Union in a single form approved by the Commission, and applies a single sign of product circulation on the market of the member states of the Customs Union;


8.3.2. forms, after completion of the conformity assessment procedures, a set of documents for low-voltage equipment, which includes:


documents provided for in subparagraph 8.1.1 of paragraph 8.1 of this article;


test report (s) ;


declaration of conformity.


9. The declaration of conformity is subject to registration in accordance with the legislation of the Customs Union. The validity of the declaration begins from the date of its registration.


The validity period of the declaration of conformity for low - voltage equipment produced in series is not more than 5 years, for a batch of low-voltage equipment (a single product), the validity period of the declaration of conformity is not established.


10. When carrying out certification of low-voltage equipment, in case of non-application of standards from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union, or in their absence (schemes 1c, 3c, 4c):


10.1. the manufacturer (the person authorized by the manufacturer), the importer provides the certification body (assessment (confirmation) of conformity) with a set of documents for low-voltage equipment confirming the compliance of low-voltage equipment with the safety requirements of this technical regulation of the Customs Union, which includes:


technical specifications (if available);


operational documents;


description of the adopted technical solutions and risk assessment confirming compliance with the safety requirements of this technical regulation of the Customs Union;


contract (supply contract) or shipping documentation (for a batch of low-voltage equipment (a single product) (schemes 3c, 4c);


10.2. The manufacturer takes all necessary measures to ensure that the production process is stable and ensures that the manufactured low-voltage equipment meets the requirements of this technical regulation of the Customs Union;


10.3. certification body (conformity assessment (confirmation)):


10.3.1. performs the selection of a sample (samples);


10.3.2. carries out the identification of low-voltage equipment by establishing the identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs Union, the provisions established in Article 5 of this technical regulation of the Customs Union, and the documents listed in subparagraph 10.1 of paragraph 10 of this Article;


10.3.3. carries out confirmation of compliance of low-voltage equipment directly with the safety requirements of this technical regulation of the Customs Union.


At the same time, the certification body (assessment (confirmation) of conformity):


determines, on the basis of the safety requirements of this technical regulation of the Customs Union, specific safety requirements for certified low-voltage equipment;


analyzes the adopted technical solutions and assesses the risks confirming the fulfillment of the safety requirements of this technical regulation of the Customs Union, carried out by the manufacturer;


determines from the List of standards specified in paragraph 2 of Article 6 of this technical regulation of the Customs Union, standards that establish methods of measurement and testing, or in their absence, determines methods of control, measurement and testing to confirm the compliance of low-voltage equipment with specific safety requirements;


organizes testing of low-voltage equipment and analyzes the test protocol (protocols) ;


10.3.4. analyzes the state of production (scheme 1c);


If the manufacturer has a certified management system for the production or development and production of low-voltage equipment, assesses the ability of this system to ensure the stable production of certified low-voltage equipment that meets the requirements of this technical regulation of the Customs Union;


10.3.5. issues a certificate of conformity according to a single form approved by the Commission.


The validity period of the certificate of conformity for low-voltage equipment produced in series is not more than 5 years, for a batch of low-voltage equipment (a single product), the validity period of the certificate of conformity is not set;


10.4. manufacturer (a person authorized by the manufacturer), importer:


10.4.1. applies a single product circulation mark on the market of the member states of the Customs Union;


10.4.2. forms a set of documents for low-voltage equipment after completion of the confirmation of compliance, which includes:


documents provided for in subparagraph 10.1 of this paragraph;


test report (s) ;


the results of the analysis of the state of production;


certificate of conformity;


10.5. the certification body (conformity assessment (confirmation)) conducts inspection control over certified low-voltage equipment by testing samples in an accredited testing laboratory (center) and (or) analyzing the state of production (scheme 1c).


11. A set of documents for low-voltage equipment must be stored on the territory of the member states of the Customs Union for:


low-voltage equipment-from the manufacturer (a person authorized by the manufacturer) for at least 10 years from the date of removal (termination) from the production of this low-voltage equipment;


a batch of low-voltage equipment - from the importer or a person authorized by the manufacturer for at least 10 years from the date of sale of the last product from the batch.



Article 8. Marking with a single sign of the circulation of products on the market of the member states of the Customs Union

1. Low-voltage equipment that meets the safety requirements of this technical regulation of the Customs Union and has been confirmed in accordance with Article 7 of this technical regulation of the Customs Union must be marked with a single product circulation mark on the market of the member states of the Customs Union.


2. Marking with a single sign of the circulation of products on the market of the member states of the Customs Union is carried out before the release of low-voltage equipment into circulation on the market.


3. A single product circulation mark on the market of the member states of the Customs Union is applied to each unit of low-voltage equipment in any way that provides a clear and clear image during the entire service life of low-voltage equipment, and is also provided in the operational documents attached to it.


4. It is allowed to apply a single product circulation mark on the market of the member states of the Customs Union only on the packaging and in the operational documents attached to it, if it is impossible to apply it directly to low-voltage equipment.


5. Low-voltage equipment is marked with a single product circulation mark on the market of the member states of the Customs Union if it meets the requirements of all technical regulations of the Customs Union, the EurAsEC, which apply to it and provide for the application of this mark.

Article 9. Protective clause

The member States of the Customs Union are obliged to take all measures to restrict, prohibit the release into circulation of low-voltage equipment in the single customs territory of the Customs Union, as well as the withdrawal from the market of low-voltage equipment that does not meet the safety requirements of this technical regulation of the Customs Union.
