Food products in terms of their labeling

(as amended on September 14, 2018)

Preface

1. This technical regulation of the Customs Union has been developed in accordance with the Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.


2. This technical regulation of the Customs Union has been developed for the purpose of establishing uniform mandatory requirements for food products in the single customs territory of the Customs Union in terms of their labeling, ensuring the free movement of food products put into circulation in the single customs territory of the Customs Union.

Article 1. Scope of application

1. This technical regulation of the Customs Union applies to food products put into circulation in the single customs territory of the Customs Union in terms of their labeling.


2. This technical regulation of the Customs Union does not apply to food products, the production of which is carried out by public catering organizations in the process of providing public catering services for consumption at the place of production, as well as to food products, the production of which is carried out by individuals in personal subsidiary farms not for the purposes of entrepreneurial activity.


3. This technical regulation of the Customs Union establishes requirements for food products in terms of their labeling in order to prevent actions that mislead consumers regarding ensuring the implementation of consumers ' rights to reliable information about food products.


4. When applying this technical regulation of the Customs Union, additional requirements of the technical regulations of the Customs Union for certain types of food products in terms of their labeling that do not contradict this technical regulation must be taken into account.

Article 2. Definitions

In this technical regulation of the Customs Union, the following terms and their definitions are used:


date of manufacture of food products - the end date of the technological process of food production;


information about the distinctive features of food products - information about food products that indicate the presence of properties of food products that allow it to be distinguished from other food products (including nutritional value, place of origin, composition, other properties);


a leaflet is an information carrier on which the marking is applied and which is placed in the consumer packaging and (or) transport packaging or is attached to the consumer packaging and (or) to the transport packaging;


label - a carrier of information on which the marking is applied and which is attached to consumer packaging and (or) transport packaging, including by pasting;


labeling of food products - information about food products applied in the form of inscriptions, drawings, signs, symbols, other designations and (or) their combinations on consumer packaging, transport packaging or on another type of information carrier attached to consumer packaging and (or) to transport packaging, or placed in them or attached to them;


consumer - an individual who intends to order or purchase or orders, purchases or uses food products exclusively for personal, family, household and other needs not related to the implementation of entrepreneurial activity;


the invented name of food products is a word or phrase that can complement the name of food products. The invented name of food products may not reflect its consumer properties and should not replace the name of food products;


the buyer of food products is a legal entity or an individual, including a consumer, who purchases food products for use for any purpose;


packaged food products - food products placed in consumer packaging;


Terms not defined by this article are used in this technical regulation of the Customs Union in the meanings defined by the legislation of the Customs Union.

Article 3. Rules of circulation on the market

Food products are put into circulation on the market if their labeling complies with this technical regulation of the Customs Union, as well as other technical regulations of the Customs Union, which apply to it.

Article 4. Requirements for labeling of food products

4.1. Requirements for labeling of packaged food products


1. The labeling of packaged food products must contain the following information:


1) name of food products;


2) the composition of food products, except for the cases provided for in paragraph 7 of part 4.4 of this article and unless otherwise provided by the technical regulations of the Customs Union for certain types of food products;


3) the quantity of food products;


4) the date of manufacture of food products;


5) shelf life of food products;


6) storage conditions of food products, which are established by the manufacturer or provided for by the technical regulations of the Customs Union for certain types of food products. For food products, the quality and safety of which changes after opening the packaging that protected the products from spoilage, the storage conditions after opening the package are also indicated;


7) the name and location of the manufacturer of food products or the surname, name, patronymic and location of the individual entrepreneur-manufacturer of food products (hereinafter-the name and location of the manufacturer), as well as in the cases established by this technical regulation of the Customs Union, the name and location of the person authorized by the manufacturer, the name and location of the importing organization or the surname, name, patronymic and location of the individual entrepreneur-importer (hereinafter-the name and location of the importer);


8) recommendations and (or) restrictions on the use, including the preparation of food products, if its use without these recommendations or restrictions is difficult, or may cause harm to the health of consumers, their property, lead to a decrease or loss of the taste properties of food products;


9) indicators of the nutritional value of food products, taking into account the provisions of part 4.9 of this article;


10) information on the presence in food products of components obtained with the use of genetically modified organisms (hereinafter-GMOs).


11) a single sign for the circulation of products on the market of the member states of the Customs Union.


2. The labeling of packaged food products provided for in paragraph 1 of part 4.1 of this Article and applied in the form of inscriptions must be applied in Russian and in the state language (s) of the member state of the Customs Union, if there are relevant requirements in the legislation of the member state(s) of the Customs Union, except for the cases specified in paragraph 3 of part 4.8 of this Article.


3. The labeling of packaged food products may contain additional information, including information about the document according to which the food products are produced and can be identified, the invented name of food products, the trademark, information about the owner of the exclusive right to the trademark, the name of the place of origin of food products, the name and location of the licensor, signs of voluntary certification systems.


4. Additional requirements for the labeling of packaged food products that do not contradict the requirements of this technical regulation of the Customs Union may be established in the technical regulations of the Customs Union for certain types of food products.


5. Soft drinks containing caffeine in an amount exceeding 150 mg / l, and (or) medicinal plants and their extracts in an amount sufficient to provide a tonic effect on the human body should be marked with the inscription "It is not recommended to use children under the age of 18, during pregnancy and lactation, as well as persons suffering from increased nervous excitability, insomnia, arterial hypertension".


4.2. General requirements for labeling of food products placed in transport packaging


1. The marking of the transport package in which the food products are placed must contain the following information:


1) name of food products;


2) the amount of food products;


3) the date of manufacture of food products;


4) shelf life of food products;


5) storage conditions of food products;


6) information that allows you to identify a batch of food products (for example, the batch number);


7) the name and location of the manufacturer of food products or the surname, first name, patronymic and location of the individual entrepreneur-manufacturer of food products.


If the transport package contains food products without consumer packaging intended by the manufacturer for further packaging (sweets, granulated sugar and other food products), the marking of the transport package in which such food products are placed must comply with the requirements provided for in paragraph 1 of part 4.1 of this article.


2. The labeling of food products placed in transport packaging provided for in paragraph 1 of Part 4.2 of this Article and applied in the form of inscriptions must be applied in Russian and in the state language (s) of the member state of the Customs Union, if there are relevant requirements in the legislation of the member state(s) of the Customs Union, except for the cases specified in paragraph 3 of part 4.8 of this Article.


3. If the marking provided for in paragraph 1 of part 4.1 of this article and applied to the consumer packaging of food products placed in a transport package can be brought to the attention of consumers of such products without violating the integrity of the transport package, the specified marking may not be applied to the transport package.


4.Additional information may be indicated in the labeling of food products placed in transport packaging, including information about the document according to which food products are produced and can be identified, the invented name of food products, the trademark, information about the owner of the exclusive right to the trademark, the name of the place of origin of food products, the name and location of the licensor, signs of voluntary certification systems.


5. Additional requirements for the labeling of food products packed in transport packaging that do not contradict the requirements of this technical regulation of the Customs Union may be established in the technical regulations of the Customs Union for certain types of food products.


4.3. General requirements for the formation of the name of food products


1. The name of food products indicated in the labeling must allow the product to be classified as food products, reliably characterize it and allow it to be distinguished from other food products.


The invented name of the food product (if available) must be included in the name of the food product and located in the immediate vicinity of it.

2. When the technical regulations of the Customs Union for certain types of food products enter into force, the name of food products must meet their requirements.


3. Information about the physical properties and (or) special methods of processing food products (reconstituted, smoked, pickled, ground, processed with ionizing radiation, freeze-dried food products and similar information about it) is included in the name of food products or placed in close proximity to the name, if the absence of such information may mislead the consumer (buyer). The requirements for such information in relation to certain types of food products are established by the technical regulations of the Customs Union for certain types of food products.


4. It is not allowed to specify components in the name of food products if they or their processed products are not part of food products.


5. If a flavoring agent is used in the composition of food products, the name of the component replaced by this flavoring agent and not included in the composition of food products may be included in the name of food products using the words: with taste and (or) with aroma.


6. Additional requirements for the indication of the name of food products that do not contradict the requirements of this technical regulation of the Customs Union may be established in the technical regulations of the Customs Union for certain types of food products.


4.4. General requirements for the indication of the composition of food products in the labeling


1. The components included in the composition of food products are indicated in descending order of their mass fraction at the time of production of food products, unless otherwise established by the requirements of the technical regulations of the Customs Union for certain types of food products. Immediately before specifying these components, the inscription "Composition"should be placed.


2. If there is a composite component (consisting of two or more components) in the food product, the list of all components that are part of such a composite component is indicated in compliance with the requirements of paragraph 1 of part 4.4 of this article, or the composite component is indicated with an addition to it in parentheses of the components in descending order of their mass fraction. If the mass fraction of a composite component is 2 percent or less, it is allowed not to specify the components included in it, with the exception of food additives, flavorings and food additives included in them, biologically active substances and medicinal plants, components obtained with the use of GMOs and components specified in paragraph 14 of part 4.4 of this article.


3. In the case of the content of components in food products, the mass fraction of which is 2 or less percent, it is allowed to indicate them in any sequence after the components, the mass fraction of which is more than 2 percent, unless otherwise established by the technical regulations of the Customs Union for certain types of food products.


4. The name of the component representing a food product is indicated in the composition of food products in accordance with the requirements of part 4.3 of this article. The names of the components provided for in Annex 1 to this technical regulation of the Customs Union may be indicated in the composition of food products under the names of the corresponding types of food products, except in cases where the names of such components are used in the name of food products.


5. If there is a flavoring agent in the food product, the labeling of the composition must contain the word " flavoring agent(s)". It is allowed not to specify the invented name of food products in relation to flavorings in the composition of food products.


6. If there is a food additive in the composition of food products, the functional (technological) purpose (acidity regulator, stabilizer, emulsifier, other functional (technological) purpose) and the name of the food additive must be indicated, which can be replaced by the index of the food additive according to the International Digital System (INS) or the European Digital System (E). If a food additive has a different functional purpose, the functional purpose corresponding to the purpose of its use is indicated. Carbon dioxide used as a component in the production of food products is not required to be indicated in the composition of food products when the label "Carbonated" or similar is included in the labeling of food products.


7. The composition of food products does not need to be specified in relation to:


1) fresh fruits (including berries) and vegetables (including potatoes) that are not peeled, sliced or processed in a similar way;


2) vinegar obtained from one type of food raw materials (without the addition of other components);


3) food products consisting of one component, provided that the name of the food product allows you to establish the presence of this component.


8. Except for the case specified in paragraph 14 of part 4.4 of this article, they do not belong to the components and are not subject to indication in the composition of food products:


1) substances that are removed from the components specified in the composition of food products during the production of food products and are added to food products at a subsequent stage of the technological production process without exceeding the amount of these starting substances;


2) substances that are part of one or more components and do not change the properties of food products containing such components;


3) technological auxiliary means used in the production of specific food products;


4) substances that are part of flavorings or food additives as solvents, carriers of flavoring substances;


9. Water may not be indicated in the composition of food products in cases where it:


1) used in the food production process to restore concentrated, condensed or dry food products;


2) it is part of a liquid component (including broth, marinade, brine, syrup, brine) specified in the composition of food products.


10. Components that have been recovered from concentrated, condensed or dry food products during the production of food products may be indicated in accordance with their mass fraction after their recovery.


11. Fruits (including berries), vegetables (including potatoes), nuts, cereals, mushrooms, spices, spices included in the corresponding mixtures and not significantly differing in mass fraction may be indicated in the composition of food products in any sequence with the indication of the entry "in variable proportions".


12. The labeling of food products containing sweeteners-sugar alcohols, immediately after specifying the composition of food products, should be supplemented with the inscription: Contains sweetener (sweeteners). With excessive use, it can (may) have a laxative effect.


13. Components (including food additives, flavorings), biologically active additives, the use of which may cause allergic reactions or is contraindicated in certain types of diseases and which are listed in paragraph 14 of part 4.4 of this article, are indicated in the composition of food products, regardless of their quantity.


14. The most common components, the use of which can cause allergic reactions or is contraindicated in certain types of diseases, include:


1) peanuts and its processed products;


2) aspartame and aspartame-acesulfame salt;


3) mustard and its processed products;


4) sulfur dioxide and sulfites, if their total content is more than 10 milligrams per kilogram or 10 milligrams per liter in terms of sulfur dioxide;


5) cereals containing gluten and products of their processing;


6) sesame and its processed products;


7) lupin and its processed products;


8) shellfish and products of their processing;


9) milk and its processed products (including lactose);


10) nuts and their processed products;


11) crustaceans and products of their processing;


12) fish and its processed products (except fish gelatin, used as a base in preparations containing vitamins and carotenoids);


13) celery and its processed products;


14) soy and its processed products;


15) eggs and products of their processing.


15. Information about the allergenic properties of the components defined in paragraph 14 of part 4.4 of this article is not required to be indicated in the labeling of food products, with the exception of information about aspartame and aspartame-acesulfame salts, in the case of use of which in the production of food products, after indicating its composition, the inscription "Contains a source of phenylalanine"should be placed.


16. For food products containing grain components, after specifying the composition of the product, it is allowed to place the inscription "Does not contain gluten", if grain components containing gluten were not used or gluten was removed.


17. In cases where the components defined in paragraph 14 of part 4.4 of this article have not been used in the production of food products, but their presence in food products cannot be completely excluded, information about the possible presence of such components is placed immediately after specifying the composition of food products.


18.For food products containing dyes (azorubin E122, yellow quinoline E104, yellow "sunset" FCF E110, red charming AC E129, ponceau 4R E124 and tartrazine E102), a warning label should be applied: Contains a dye (dyes) that (may) have a negative effect on the activity and attention of children.


The exception is alcoholic beverages and food products in which these dyes are used for labeling slaughter products and meat products or for labeling or decorative coloring of Easter eggs.


4.5. General requirements for the indication of the quantity of packaged food products in the labeling


1. The quantity of packaged food products is indicated in the labeling of these products in units of volume (milliliters, centiliters or liters), mass (grams or kilograms) or count (pieces). In this case, it is allowed to use abbreviated names of these units. The mass or volume of eggs, fruits, and vegetables sold individually is not allowed to be specified.


2. The choice of the value for indicating the quantity of packaged food products, with the exception of food products sold by the piece, is carried out taking into account the following rules, unless otherwise established by the technical regulations of the Customs Union for certain types of food products:


- if the food product is liquid, then its volume is indicated;


- if the food products are pasty, viscous or of a viscoplastic consistency, then either its volume or mass is indicated;


- if the food product is solid, loose, is a mixture of solid and liquid substances, then its mass is indicated.


It is allowed to use two values simultaneously to indicate the quantity of food products, for example, weight and number of pieces, weight and volume.


3. The indication of the quantity of food products in a group package must be carried out as follows:


3.1. if food products of the same name are packed in several consumer packages, the total number of products and the number of consumer packages are indicated on the group packaging of food products;


3.2. if the properties of the group packaging for packaged food products allow you to clearly see information about the quantity of food products and easily calculate the number of consumer packages, then it is allowed not to indicate them on the group packaging;


3.3. if packaged food products consist of several consumer packages with products of different types and names and (or) individual products of different names, then the name and quantity of products of each consumer package and (or) the name, number of pieces, or weight of each product are indicated on the group packaging of packaged food products.


4. The quantity of food products placed in a transport package is indicated in units of volume (milliliters, centiliters or liters) or mass (grams or kilograms) or in the number of packaging units in a transport package (pieces) indicating the amount of food products placed in each packaging unit. In this case, it is allowed to use abbreviated names of these units.


5. If food products are placed in a liquid medium, for example, water, aqueous solutions of sugar, aqueous solutions of food acids, aqueous solutions of salt, brines, vinegar, fruit or vegetable juices, along with the indication of the volume or mass of food products together with the liquid medium, the volume or mass of food products placed in a liquid medium must be additionally indicated. This requirement also applies to food products placed in a liquid medium with subsequent freezing.


6.An indefinite indication of the quantity of packaged food products and an indication of the range of values of the quantity of packaged food products is not allowed.


4.6. General requirements for specifying the date of manufacture of food products in the labeling


1. The indication in the labeling of food products of the date of its manufacture, depending on its shelf life, is carried out using the following words:


1) "date of manufacture" indicating the hour, date, month with an expiration date of up to 72 hours;


2) "date of manufacture" indicating the date, month, year with an expiration date of 72 hours to three months;


3) "date of manufacture" indicating the month, year or date, month, year with an expiration date of three months or more;


4) "year of preparation" - for sugar.


2. After the words "date of manufacture", the date of manufacture of food products or the place of application of this date on consumer packaging is indicated.


3. The words "date of manufacture" in the labeling of food products may be replaced by the words "date of production" or similar words.


4. In the technical regulations of the Customs Union for certain types of food products, instead of the words "date of manufacture", other concepts may be established that determine the end date of the technological process of production of certain types of food products, for example, the date of bottling of beverages, the date of sorting eggs, the year of harvest of agricultural crops, the year of harvest of wild fruits, nuts, beekeeping products.


Additional requirements for specifying the date of manufacture of food products that do not contradict the requirements of this technical regulation of the Customs Union may be established in the technical regulations of the Customs Union for certain types of food products.


4.7. General requirements for the indication of the shelf life of food products in the labeling


1. The indication of the expiration date in the labeling of food products is carried out using the following words:


1) "valid until" with an indication of the hour, date, month with a shelf life of up to 72 hours;


2) "valid until" with an indication of the date, month, year with a shelf life of 72 hours to three months;


3) "valid until the end" with an indication of the month, year or "valid until" with an indication of the date, month, year with a shelf life of at least three months.


2. In order to indicate the shelf life of food products, the word "good" may be used with an indication of the number of days, months or years, or if the shelf life is up to 72 hours, the word "good" with an indication of the number of hours.


3. After the words "good to", "good to", "good to the end", either the shelf life of food products or the place of application of this period on the packaging is indicated.


4. The labeling of food products, in respect of which the manufacturer establishes an unlimited shelf life, must be supplemented with the inscription "The shelf life is not limited if the storage conditions are met".


5. The words "fit to", "fit to", "fit to the end" in the labeling of food products can be replaced by the words "shelf life", "use to" or similar words.


6. Additional requirements for the indication of the shelf life of food products that do not contradict the requirements of this technical regulation of the Customs Union may be established in the technical regulations of the Customs Union for certain types of food products.


4.8. General requirements for the indication in the labeling of the name and location of the manufacturer of food products, the person authorized by the manufacturer, the importer


1. The name and location of the manufacturer of food products are indicated in the labeling of food products, regardless of the production of food products on the territory of the member states of the Customs Union or supplied from third countries. The location of the manufacturer of food products is determined by the place of state registration of the organization or individual entrepreneur.


2. In the information provided to the consumer (buyer), the officially registered name and location (address, including the country) of the manufacturer should be used. If there is a discrepancy with the manufacturer's address, the address(a) of the production facilities(a) and the person authorized by the manufacturer to accept claims from consumers (purchasers) on its territory (if available) are also indicated.


3. Information about the name and location of the manufacturer of food products supplied from third countries may be indicated in Latin letters and Arabic numerals or in the state language (s) of the country at the location of the manufacturer of food products, provided that the name of the country is indicated in Russian.

4. In the labeling of food products, the production of which is carried out by several manufacturers, the name and location of each manufacturer may be indicated, provided that the method of communicating information about each manufacturer to consumers (purchasers), for example, the use of letters, numbers, symbols, selections in a different font, should allow unambiguously identifying the manufacturer of a specific food product.


5. Products packaged not at the place of their manufacture (except for cases when food products are packaged in consumer packaging by retail organizations) must contain the information provided for in paragraph 1 of part 4.8 of this article about the manufacturer and the legal entity or individual entrepreneur who are packaging food products not at the place of its manufacture for its subsequent sale or by order of another legal entity or individual entrepreneur.


6. If the manufacturer has a person authorized by the manufacturer, the name and location of such a person authorized by the manufacturer must be indicated in the labeling of food products.


7. The labeling of food products supplied from third countries indicates the name and location of the importer.


4.9. General requirements for the indication of the nutritional value of food products in the labeling


1. The nutritional value of food products indicated in its labeling includes the following indicators:


1) energy value (caloric content);


2) the amount of proteins, fats, carbohydrates;


3) the amount of vitamins and minerals.


2. The nutritional value of flavorings, chewing gum, coffee, natural mineral water, bottled drinking water, food additives, raw food products (mushrooms, slaughter products of productive animals and poultry, fish, vegetables (including potatoes), fruits (including berries), table salt, spices, spices, vinegar, tea may not be indicated, unless otherwise established by the technical regulations of the Customs Union for these types of food products. The nutritional value of other types of food products may not be indicated in cases provided for by the technical regulations of the Customs Union for certain types of food products.


3. The nutritional value of food products must be given per 100 grams or 100 milliliters and (or) per serving (a certain amount of food products indicated in its labeling as one serving with mandatory indication of the amount of such a portion) of food products.


4. The energy value (caloric content) of food products should be indicated in joules and calories or in multiples or fractional units of these values.


5. The amount of food substances, including proteins, fats, carbohydrates in food products should be indicated in grams or in multiples or fractional units of the specified values.


6. The amount of vitamins and minerals in food products must be indicated in units of the International System of Units (SI) (milligrams or micrograms) or in other units of quantities approved for use in the member states of the Customs Union in accordance with the legislation of the member states of the Customs Union in the field of ensuring the uniformity of measurements.


7. The amount of proteins, fats, carbohydrates and energy value (caloric content) of food products should be indicated in relation to proteins, fats, carbohydrates and energy value (caloric content), for which such an amount in 100 grams or 100 milliliters or in one serving of food products (in the case of bringing the nutritional value per serving) is 2 or more percent of the values reflecting the average daily need of an adult for proteins, fats, carbohydrates and energy. In other cases, the amount of proteins, fats, carbohydrates and the energy value (caloric content) of food products may be specified at the discretion of the manufacturer.


8. The amount of vitamins and minerals in food products should be indicated if vitamins and minerals are added to food products during its production. In other cases, the amount of vitamins and minerals in food products may be indicated in relation to vitamins and minerals for which such an amount in 100 grams or 100 milliliters or in one serving of food products (in the case of bringing the nutritional value per serving) is 5 or more percent of the values reflecting the average daily need of an adult for vitamins and minerals.


9. The values reflecting the average daily need of an adult in proteins, fats, carbohydrates and energy, vitamins, minerals and other substances are determined in accordance with Annex 2 to this technical regulation of the Customs Union.


To indicate the indicators of nutritional value in the labeling of food products specified in paragraphs 7, 8, 9 of part 4.9 of this article and intended for certain categories of consumers, the calculation is based on the average daily requirement for this category of consumers.


10. For biologically active food additives, in respect of substances whose source is these biologically active additives, and for fortified food products - in respect of substances used to enrich such food products, the nutritional value must additionally be indicated as a percentage of the values determined in accordance with the procedure established by paragraph 9 of part 4.9 of this article.


11. The values of indicators of the nutritional value of food products, the preparation of which should be carried out by consumers, are indicated in the labeling of such food products without taking into account its further preparation.


12. Indicators of the nutritional value of food products are determined by the manufacturer of food products analytically or by calculation.


13. When specifying the energy value (caloric content) of food products and the content of proteins, fats, carbohydrates in it, the rules for rounding the values of the indicators of the nutritional value of food products may be applied in accordance with Annex 3 to this technical regulation of the Customs Union, unless otherwise established by the technical regulations of the Customs Union for certain types of food products.


14. In relation to the indicators of the nutritional value of food products, the marking may be supplemented with the inscription: "Average values".


When determining the energy value (caloric content) of food products, the conversion coefficients of the main food substances of food products into the energy value (caloric content) of food products should be used in accordance with Annex 4 to this technical regulation of the Customs Union.


15. When determining the content of carbohydrates in food products, their amount contained in food products (with the exception of dietary fibers) and participating in the metabolism in the human body, as well as the amount of sweeteners-sugar alcohols, is taken into account.


16. When determining the amount of vitamin A and provitamin A, a conversion factor is used based on the calculation that one microgram of retinol or retinol equivalent corresponds to six micrograms of beta-carotene.


17. Additional requirements for the indication of the nutritional value of food products that do not contradict the requirements of this technical regulation of the Customs Union may be established in the technical regulations of the Customs Union for certain types of food products.


4.10. General requirements for the indication of information about the distinctive features of food products in the labeling


1. Information about the distinctive features of food products is indicated when labeling on a voluntary basis.


2. Information about the distinctive features of food products, including the absence of components derived from GMOs (or) using GMOs in food products, must be confirmed by evidence formed by the person who indicated this statement in the labeling of food products independently or obtained by him with the participation of other persons. Evidence of the presence of distinctive features of food products shall be stored in organizations or individual entrepreneurs that produce these food products for circulation in the single customs territory of the Customs Union, and shall be presented in cases provided for by the legislation of the Customs Union.


3. Information on the distinctive features of food products specified in Annex 5 to this technical regulation of the Customs Union may be used only if the conditions specified in this annex are met, unless otherwise established by the technical regulations of the Customs Union for certain types of food products. The information not specified in Annex 5 to this technical regulation of the Customs Union on the distinctive features of food products may be used in the labeling of food products in compliance with the requirements of paragraph 2 of part 4.10 of this Article or the requirements established by the technical regulations of the Customs Union for certain types of food products.


4. Information about the distinctive features of food products in terms of their nutritional value must be accompanied by an indication in the labeling of food products of the amount of relevant food substances that determine the nutritional value of food products.


4.11. Requirements for the indication in the labeling of information about the presence in food products of components obtained with the use of genetically modified organisms


1. For food products obtained with the use of GMOs, including those that do not contain deoxyribonucleic acid (DNA) and protein, the following information should be provided: "genetically modified products", or "products obtained from genetically modified organisms", or "products contain components of genetically modified organisms".

At the same time, next to the single sign of the circulation of products on the market of the Eurasian Economic Union, the same sign of labeling products obtained with the use of GMOs is applied in the form of the inscription "GMO".

If the manufacturer did not use genetically modified organisms in the production of food products, then the GMO content in food products of 0.9 percent or less is an accidental or technically unavoidable impurity and such food products do not belong to food products containing GMOs. When labeling such food products, information about the presence of GMOs is not indicated.

2. For food products obtained from genetically modified microorganisms (bacteria, yeast and mycelial fungi, the genetic material of which has been modified using genetic engineering methods) (hereinafter-GMM) or with their use, the following information is required:


- for those containing live GMOs - "The product contains live genetically modified microorganisms";


- for those containing non-viable GMOs - "The product was obtained using genetically modified microorganisms";


- for those exempt from technological GMOs or for those obtained using components exempt from GMOs - "The product contains components obtained using genetically modified microorganisms".


3. In the labeling of food products, information about the presence of GMOs is not indicated in relation to the technological aids used, made from or using GMOs.


4.12. Requirements for methods of bringing the marking


1. The labeling of food products provided for in paragraph 1 of Part 4.1 and paragraph 1 of Part 4.2 of this article must be understandable, easy to read, reliable and not mislead consumers (purchasers), while inscriptions, signs, symbols must be contrasting with the background on which the labeling is applied. The method of marking must ensure its safety during the entire shelf life of food products, subject to the storage conditions established by the manufacturer.


The criteria for legibility are the clarity and legibility of the font used in the marking, the size of which must meet the requirements specified in paragraphs four and five of this paragraph, as well as the contrast between the background color and the color of the information applied to it, which make it possible to read the information without the use of optical devices, except for those used for correcting vision defects (glasses, contact lenses, etc.).

The criterion of clarity is the unambiguity of transmitting the meaning of information about food products in the form of text or text and image.

Information provided for in sub-paragraphs 1, 3, 4 (except for words used to indicate the date of manufacture and (or) information about the place of application of the date of manufacture (if such information is available)) and 5 (except for words used to indicate the expiration date and (or) information about the place of application of the expiration date (if such information is available)) paragraph 1 of part 4.1 of this article, are indicated in a font with a height of at least 2 mm (lowercase letters).

The information provided for in sub-paragraphs 2, 6, 7, 8 (regarding recommendations and (or) restrictions on use) and 9 (for specialized food products) of paragraph 1 of part 4.1 of this article, as well as the words used to indicate the date of manufacture, expiration date and (or) information about the place of application of the date of manufacture, expiration date (if such information is available), are indicated in a font with a height of at least 0.8 mm (lowercase letters).

2. The information provided for in subparagraphs 1, 4-6 of paragraph 1 of Part 4.1 and paragraph 13 of part 4.4 of this article must be applied to the consumer packaging and (or) to the label, the removal of which from the consumer packaging is difficult.


3. The information provided for in sub-paragraphs 2, 3, 7-11 of paragraph 1 of Part 4.1 of this article must be applied to the consumer packaging and (or) to the label, and (or) the leaflet, and (or) to the leaflet placed in each packaging unit or attached to each packaging unit.


4. If the area of the larger side of the consumer packaging of food products does not exceed 10 square centimeters, the information provided for in paragraph 2 (except for the information provided for in paragraph 13 of part 4.4 of this article) and sub-paragraphs 3, 7-11 of paragraph 1 of part 4.1 of this article must be applied to the consumer packaging and (or) on the label, and (or) a leaflet placed in each consumer packaging, or in each transport package, or attached to each consumer packaging or to each transport package.


5. When packaging food products by retail trade organizations in the absence of a consumer, the name of the food product, the date of its manufacture, its shelf life and storage conditions must be indicated on the consumer packaging or on the label attached to it. Other information provided for in paragraph 1 of part 4.1 and paragraph 13 of part 4.4 of this article shall be communicated to the consumer in any way that ensures the possibility of a reasonable choice of this food product (including by applying it to consumer packaging and (or) label, and (or) on a leaflet placed in each packaging unit or attached to each packaging unit of products).


6. The information provided for in paragraph 1 of Part 4.1 and paragraph 13 of part 4.4 of this article in respect of food products placed directly in transport packaging, as well as food products packaged by retail trade organizations in the presence of the consumer, shall be communicated to the consumer in any way that provides the possibility of a reasonable choice of this food product.


7. The labeling of food products placed directly in the transport package, provided for in part 4.2 of this article, must be applied to the transport package, and (or) on the label, and (or) a leaflet placed in each transport package or attached to each transport package, or contained in the documents accompanying the food products.


8. The labeling of food products must not contain an image or a text description of food products that are not contained in consumer packaging or have not been used in the production of food products or components of food products contained in consumer packaging, or the taste and (or) aroma of which are not imitated by components that are part of food products contained in consumer packaging, except for the cases provided for in paragraph 9 of part 4.12 of this article.

9. The labeling of food products applied in the form of an image or a text description of the dish, in the preparation of which this food product is used, must be accompanied by the words "variant of the prepared dish" or similar words.

Article 5. Ensuring compliance with the requirements for food products in terms of their labeling

1. The conformity of the labeling of food products to this technical regulation of the Customs Union is ensured by the fulfillment of its labeling requirements directly and by the fulfillment of the requirements of the technical regulations of the Customs Union for certain types of food products that establish additional requirements for its labeling.
