1. This technical regulation of the Customs Union " On Grain Safety "(hereinafter referred to as the technical regulation) has been developed in accordance with the Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.
2. This technical regulation has been developed for the purpose of establishing uniform mandatory requirements for grain in the single customs territory of the Customs Union, ensuring the free movement of grain released into circulation in the single customs territory of the Customs Union.
3. If other technical regulations of the Customs Union have been adopted with respect to grain, establishing requirements for grain, then the grain must comply with the requirements of all technical regulations of the Customs Union, the effect of which applies to it.
1. This technical regulation applies to grain put into circulation in the single customs territory of the Customs Union, used for food and feed purposes.
This technical regulation does not apply to grain intended for seed purposes, grain processing products.
2. This technical regulation establishes mandatory requirements for grain and related requirements for the processes of production, storage, transportation, sale and disposal of grain for the purpose of protecting human life and health, property, the environment, the life and health of animals and plants in the single customs territory of the Customs Union, as well as preventing actions that mislead grain consumers.
3. Identification of grain is carried out on the basis of the information specified in the shipping documents, marking, visual inspection of the botanical characteristics of grain characteristic of this type of culture, as well as the distinctive features specified in Annex 1 to this technical regulation.
If the grain cannot be identified on the basis of the information specified in the shipping documents, marking, visual inspection, identification is carried out by an analytical method - by checking the compliance of the physical and chemical parameters of the grain in accordance with the standards specified in Article 5 of this technical regulation.
The following terms and their definitions are used in this technical regulation:
grain moisture is the water that is physically, chemically and mechanically bound to the grain tissues, removed under standard conditions of determination;
harmful admixture - an admixture of plant origin, which in quantities exceeding the permissible levels can have a toxic, harmful, damaging or dangerous effect on the health of humans and (or) animals and (or) plants;
putting into circulation of grain - purchase and sale and other methods of transferring grain in the single customs territory of the Customs Union, starting with the manufacturer or importer;
genetically modified (transgenic) organisms - organisms obtained using genetic engineering methods;
smut grain - grain partially or completely contaminated with smut spores;
contamination of grain by pests - the presence of dead pests or their parts, as well as products of their vital activity, in the intergranular space;
pest infestation of grain - the presence of live pests in the intergranular space or inside individual grains at any stage of their development;
grain - the fruits of cereals, legumes and oilseeds used for food and feed purposes;
identification of grain - the procedure for assigning grain to the objects of technical regulation of this technical regulation;
feed purposes - the use of grain as animal feed and the production of mixed feeds;
insects-pests of grain - grain grinder, bread grinder, barn weevil, rice weevil, fireworms, barn moth, trogoderma changeable, Moorish booger, carpet beetle, kaprov beetle, flour crushers, bulavous small crushers, pretenders, skin eaters, flour eaters, mushroom eaters, spangles, skrytniki, skrytnoedy, hay eaters, zernovki, leaf wrappers;
grain disinfection - chemical, radiation or physical impact on grain in order to destroy pests and microorganisms;
grain processing - cleaning and (or) drying, and (or) disinfection of grain in order to ensure its safety;
grain cleaning - removal of impurities in order to ensure the safety of grain;
grain batch - the quantity of grain of the same name (type), homogeneous in quality, intended for simultaneous acceptance, shipment and (or) storage;
grain transportation - movement of grain shipments during its circulation;
food purposes - the use of grain for processing into food products;
delivered grain - grain that has been processed and sent for food or feed purposes;
foreign smell of grain - an odor that is not peculiar to the grain of this name (type), which appears as a result of sorption of odorous foreign substances by the grain;
grain production is a complex of agrotechnological measures aimed at growing grain;
pink-colored grain - a grain made, shiny, with pink pigmentation of the shells mainly in the area of the embryo;
ergot is a grain affected by the fungus Claviceps purpurea in the form of elongated dense formations in a dark purple spike;
drying of grain - lowering the moisture content of grain in order to ensure its safety;
the authorized body of a member state of the Customs Union is the authorized state body of a member state of the Customs Union that exercises state control (supervision) over compliance with the requirements of this technical regulation;
grain utilization is the use of grain that does not meet the requirements of this technical regulation for purposes other than the purposes for which the grain is intended and for which it is usually used, or bringing grain that does not meet the requirements of this technical regulation into a state that is not suitable for any of its use and application, as well as excluding its adverse effects on humans, animals, plants and the environment;
fusarium grain - a grain affected during its maturation by fungi of the genus fusarium (puny, lightweight, wrinkled, whitish, sometimes with spots of orange-pink color);
grain storage is a technological process of creating conditions in the granary to ensure the safety of grain;
grain expertise-determination of grain safety indicators in order to make a decision on the possibility of its disposal.
1. Grain supplied for food and feed purposes is put into circulation in the single customs territory of the Customs Union, provided that it has passed the necessary conformity assessment (confirmation) procedures established by this technical regulation, as well as other technical regulations of the Customs Union, which apply to grain.
2. Each batch of delivered grain, when it is released into circulation in the single customs territory of the Customs Union, is accompanied by shipping documents that must contain information about the declaration of compliance of the grain batch with the requirements of this technical regulation.
When grain intended for storage and (or) processing in the territory of the producing country is put into circulation in the single customs territory of the Customs Union, it is accompanied by shipping documents without information about the declaration.
3. The supplied grain, whose compliance with the requirements of this technical regulation is not confirmed, cannot be marked with a single product circulation mark on the market of the member states of the Customs Union and is not allowed to be put into circulation in the single customs territory of the Customs Union.
1. Indicators of toxic elements, mycotoxins, benz (a)pyrene, pesticides, radionuclides, pest infestation and harmful impurities in grain supplied for food purposes should not exceed the maximum permissible levels specified in annexes 2, 3 to this technical regulation.
2. Indicators of toxic elements, mycotoxins, pesticides, radionuclides, pest infestation and harmful impurities in grain supplied for feed purposes should not exceed the maximum permissible levels specified in annexes 4, 5 to this technical regulation.
3. Determination of residual amounts of pesticides, with the exception of pesticides specified in Annexes 2, 4 to this technical regulation, is carried out on the basis of information on their application provided by the manufacturer (supplier) of grain when it is released into circulation in the single customs territory of the Customs Union. The indicators of their content in grain should not exceed the maximum permissible levels specified in Annex 6 to this technical regulation.
4. It is not allowed to release grain into circulation in the single customs territory of the Customs Union if the content of residual amounts of active substances of pesticides registered in accordance with the procedure established by the legislation of the member state of the Customs Union and specified in annexes 2, 4, 6 to this technical regulation exceeds the permissible levels.
5. Fertilizers used in the production of grain must comply with the requirements of the legislation of the Customs Union, and before the entry into force of the relevant technical regulations of the Customs Union - the requirements of the legislation of the member state of the Customs Union.
6. Grain storage is carried out in grain storage facilities that ensure the safety of grain and the safety of its consumer properties, subject to the requirements for grain storage processes established by this technical regulation, as well as storage conditions established by the national legislation of the member state of the Customs Union.
7. The surfaces of walls, ceilings, load-bearing structures, doors, floors of industrial premises, as well as silos and bunkers should be accessible for their cleaning and disinfection. The condition of the roof and walls of granaries, the design of the entrance openings of active ventilation channels should ensure that atmospheric precipitation and foreign objects get into them.
8. The technological process of grain processing in granaries should ensure drying, cleaning and disinfection of grain to a level that ensures a safe and stable condition for storage.
9.It is not allowed to store toxic, combustible chemicals, fuels and lubricants and petroleum products, as well as other types of food products and non-food products together with grain, if this may lead to contamination of grain.
10. The process of disinfection of grain infected with pests must ensure the safety of grain in accordance with the requirements established by this technical regulation.
11.During the entire period of grain storage, a check of its storage conditions (humidity, temperature), as well as indicators of pest infestation, grain color and the presence of foreign odor should be organized in the granary.
12. When storing grain in granaries, conditions must be provided that exclude the possibility of spontaneous combustion of grain, as well as conditions that ensure explosion and fire safety.
13. Grain transportation is carried out by vehicles that ensure the safety and security of grain during its transportation.
14. The design of cargo compartments of vehicles and containers must ensure the protection of grain from contamination, prevent spillage of grain, the penetration of animals, including rodents and insects, as well as ensure cleaning and (or) washing, and (or) disinfection, and (or) disinsection, and (or) deratization.
15. Cargo compartments of vehicles and containers should not be a source of grain contamination.
16. Grain is transported by the bulk method, in transport containers or consumer packaging.
Grain transported by the bulk method must be accompanied by shipping documents that ensure its traceability, containing information about:
1) the type of grain, the year of harvest, the place of origin, the purpose of grain (for food or feed purposes, for storage and (or) processing, for export);
2) the amount of grain, in units of mass;
3) the name and location of the applicant;
4) on the presence of genetically modified (transgenic) organisms (hereinafter referred to as GMOs) in the grain if the content of these organisms in the grain is more than 0.9 percent.
For grain obtained with the use of GMOs, the following information should be provided: "genetically modified grain" or "grain obtained using genetically modified organisms" or "grain contains components of genetically modified organisms", indicating the unique identifier of the transformation event.
The labeling of grain placed in consumer packaging (grain for feed purposes) and grain in transport containers must contain the information specified in subparagraphs 1-4 of this paragraph, and information about the shelf life and storage conditions of grain (for grain intended for feed purposes and packed in consumer packaging).
It is allowed to supplement the marking of grain with the inscription: "The shelf life is not limited if the storage conditions are met."
The marking of grain placed in transport containers and (or) consumer packaging must be in Russian. It is allowed to apply the marking in the state language (s) of the member state of the Customs Union.
Information on the name of the location of the grain manufacturer located outside the unified customs territory of the Customs Union may be indicated in Latin letters and Arabic numerals or in the state language (s) of the country at the location of the grain manufacturer, provided that it is indicated in Russian.
The information for the buyer (consumer) indicated on the label should be clear, easy to read, reliable and not mislead him. Inscriptions, signs, symbols should be contrasting with the background on which the marking is applied.
The marking of grain packed in consumer packaging (grain for feed purposes) must be applied to the consumer packaging and (or) to the label, and (or) counter-label, and (or) to the leaflet placed in each packaging unit or attached to each packaging unit.
The marking of grain placed directly in the transport container must be applied to the transport container, and (or) on the label, and (or) on the counter label, and (or) on the leaflet placed in each transport container or attached to each transport container, or contained in the shipping documents.
The packaging must comply with the requirements of the technical regulations of the Customs Union "On packaging Safety".
17. A batch of delivered grain that does not meet the requirements of this technical regulation is subject to return or disposal.
The authorized body of a member state of the Customs Union, on the territory of which grain that does not meet the requirements of this technical regulation is detected, makes a decision to conduct an examination of grain and forms a commission consisting of representatives of the authorized body, the manufacturer (owner) and recipient of grain, which selects a sample and sends it to an accredited testing laboratory (center) included in the Unified Register of Certification Bodies and Testing Laboratories (centers) of the Customs Union for testing. The selection of an accredited laboratory (center) is carried out by the commission.
18. Grain for the period necessary for carrying out the examination and making a decision on the possibility of its return or disposal is subject to storage in separate rooms, indicating the volume of the batch and observing the conditions that exclude access to grain, as well as its clogging and pest infestation.
19. Based on the test results, the commission makes a decision on the return or disposal of grain.
20. The return and disposal of grain is carried out in accordance with the requirements of the national environmental legislation and the national legislation in the field of plant quarantine of the member state of the Customs Union.
21. When disposing of grain that does not meet the requirements of this technical regulation, the manufacturer (owner) is obliged to submit to the authorized body of the member state of the Customs Union a document confirming the fact of disposal of such grain, in accordance with the procedure established by the national legislation of the member state of the Customs Union.
1. The compliance of grain with this technical regulation is ensured by the fulfillment of its requirements and the fulfillment of the requirements of other technical regulations of the Customs Union, the effect of which applies to it.
Methods of research (tests) and measurements are established in the standards included in the List of Standards containing rules and methods of research (tests) and measurements, including the rules for sampling necessary for the application and fulfillment of the requirements of this technical regulation and the assessment (confirmation) of conformity of products, approved by the Customs Union Commission.
1. The assessment of the compliance of the supplied grain with the requirements of this technical regulation is carried out in the following forms:
1) confirmation (declaration) of grain conformity;
2) state control (supervision) over compliance with the requirements of this technical regulation in relation to grain and the processes of production, storage, transportation, sale and disposal of grain related to the requirements for it.
1. Grain released into circulation in the single customs territory of the Customs Union, supplied for food and feed purposes, is subject to conformity assessment in the form of a declaration of conformity.
Grain released into circulation in the single customs territory of the Customs Union, sent for storage and (or) processing in the territory of the producing country, is not subject to conformity assessment.
2. Confirmation of the conformity of grain produced in the single customs territory of the Customs Union and grain imported into the single customs territory of the Customs Union is carried out according to the uniform rules and schemes established by this technical regulation.
3. When declaring compliance, the applicant may be registered in accordance with the national legislation of the state - a member of the Customs Union on its territory is a legal entity or an individual as an individual entrepreneur, or who is a manufacturer or seller, or performs the functions of a foreign manufacturer on the basis of an agreement with him in terms of ensuring that the supplied grain meets the requirements of the technical regulations of the Customs Union and in terms of responsibility for non-compliance of the supplied grain with the requirements of the technical regulations of the Customs Union (a person performing the functions of a foreign manufacturer).
4. Depending on the scheme of declaration of conformity, confirmation of conformity in the form of declaration of conformity is carried out on the basis of its own evidence and (or) evidence obtained with the participation of a third party: a product certification body, a management system certification body, an accredited testing laboratory included in the Unified Register of Certification Bodies and Testing Laboratories (centers) of the Customs Union.
5. Declaration of grain conformity is carried out according to the schemes 1d, 2d, 3d, 4d and 6d.
When declaring compliance according to the schemes 1d, 3d, 6d, the applicant may be a legal entity or an individual who is a manufacturer or performs the functions of a foreign manufacturer registered in accordance with the legislation of a member state of the Customs Union on its territory.
When declaring compliance according to the schemes 2d, 4d, the applicant may be a legal entity or an individual registered in accordance with the legislation of a member state of the Customs Union on its territory, who is a manufacturer or seller, or performs the functions of a foreign manufacturer.
6. The 1d declaration scheme includes the following procedures:
- formation and analysis of technical documentation;
- implementation of production control;
- testing of grain samples;
- acceptance and registration of the declaration of conformity;
- the application of a single sign of treatment.
The applicant takes all necessary measures to ensure that the production process is stable and ensures that the grain meets the requirements of this technical regulation, forms technical documentation and analyzes it.
The applicant ensures that production control is carried out.
In order to control the compliance of grain with the requirements of this technical regulation, the applicant conducts tests of grain samples. Grain samples are tested at the applicant's choice in a testing laboratory or an accredited testing laboratory.
The applicant draws up a declaration of conformity and registers it according to the notification principle in accordance with the procedure established by the Customs Union Commission.
The validity period of the declaration of conformity of grain produced in series is not more than 3 years.
7. The 2d declaration scheme includes the following procedures:
- formation and analysis of technical documentation;
- testing of grain samples;
- acceptance and registration of the declaration of conformity;
- the application of a single sign of treatment.
The applicant forms technical documentation and analyzes it.
The applicant conducts tests of grain samples to ensure confirmation of the declared compliance of the grain batch with the requirements of this technical regulation. Grain samples are tested at the applicant's choice in a testing laboratory or an accredited testing laboratory included in the Unified Register of Certification Bodies and Testing Laboratories (centers) of the Customs Union.
The applicant draws up a declaration of conformity and registers it according to the notification principle in accordance with the procedure established by the Customs Union Commission.
The validity period of the declaration of conformity for a batch of grain is at the applicant's choice.
8. The 3d declaration scheme includes the following procedures:
- formation and analysis of technical documentation;
- implementation of production control;
- testing of grain samples;
- acceptance and registration of the declaration of conformity;
- the application of a single sign of treatment.
The applicant takes all necessary measures to ensure that the production process is stable and ensures that the grain meets the requirements of this technical regulation, forms technical documentation and analyzes it.
The applicant ensures that production control is carried out.
In order to control the compliance of grain with the requirements of this technical regulation, the applicant conducts tests of grain samples. Grain samples are tested in an accredited testing laboratory included in the Unified Register of Certification Bodies and Testing Laboratories (centers) of the Customs Union.
The applicant draws up a declaration of conformity and registers it according to the notification principle in accordance with the procedure established by the Customs Union Commission.
The validity period of the declaration of conformity of grain produced in series is not more than 3 years.
9. The 4d declaration scheme includes the following procedures:
- formation and analysis of technical documentation;
- testing of grain samples;
- acceptance and registration of the declaration of conformity;
- the application of a single sign of treatment.
The applicant forms technical documentation and analyzes it.
The applicant conducts tests of grain samples to ensure confirmation of the declared compliance of the grain batch with the requirements of this technical regulation. Grain samples are tested in an accredited testing laboratory included in the Unified Register of Certification Bodies and Testing Laboratories (centers) of the Customs Union.
The applicant draws up a declaration of conformity and registers it according to the notification principle in accordance with the procedure established by the Customs Union Commission.
The validity period of the declaration of conformity for the batch is at the choice of the applicant.
10. The 6d declaration scheme includes the following procedures:
- formation and analysis of technical documentation, which necessarily includes a certificate for a management system (a copy of the certificate) issued by the management systems certification body;
- implementation of production control;
- testing of grain samples;
- acceptance and registration of the declaration of conformity;
- application of a single address sign;
- control over the stability of the functioning of the management system.
The applicant takes all necessary measures to ensure the stability of the management system and grain production conditions that meet the requirements of this technical regulation, forms technical documentation and analyzes it.
The applicant ensures that production control is carried out and informs the management system certification body about all planned changes in the management system.
In order to control the compliance of grain with the requirements of this technical regulation, the applicant conducts tests of grain samples.
Grain samples are tested in an accredited testing laboratory.
The applicant draws up a declaration of conformity and registers it according to the notification principle in accordance with the procedure established by the Customs Union Commission.
The management system certification body carries out inspection control over the functioning of the certified management system.
In case of negative results of the inspection control, the applicant makes one of the following decisions:
- suspends the validity of the declaration of conformity;
- cancels the declaration of conformity.
A corresponding entry is made in the Unified Register of Issued certificates of conformity and registered declarations of conformity issued in a single form.
The validity period of the declaration of conformity of grain produced in series is not more than 5 years.
11. Technical documentation confirming the compliance of grain with the requirements of this technical regulation may include:
test reports carried out by the applicant and / or accredited testing laboratories (centers) confirming the grain's compliance with the requirements of this technical regulation;
documents confirming the safety of grain in accordance with the legislative acts of the Customs Union and the member states of the Customs Union;
certificates of conformity for management systems;
other documents confirming the safety of grain.
12. The declaration of conformity is drawn up in a single form approved by the Customs Union Commission.
13. The declaration of conformity is subject to renewal in the following cases:
when changing the requirements of this technical regulation;
in case of changes in the composition of technical documentation or the technological process of production and / or storage, which have affected or may affect the compliance of grain with the established requirements.
The reissue of the declaration of conformity is carried out in the order of its adoption.
14. Technical documentation, including documents confirming compliance in the territory of a member state of the Customs Union, must be stored:
1) for grain produced in series - from the applicant for at least 10 years from the date of withdrawal (termination) of grain production;
2) for a batch of grain - from the applicant for at least 10 years from the date of sale of the batch of grain.
Evidentiary materials confirming the results of management system certification are stored in the management system certification body that issued the certificate of conformity for at least 5 years after the expiration of the certificate of conformity of the management system.
The above-mentioned documents must be provided to the state control (supervision) bodies upon their request.
15. State control (supervision) over compliance with the requirements of this technical regulation in relation to grain and related production, storage, transportation, sale and disposal processes related to it is carried out in accordance with the national legislation of the member state of the Customs Union.
1. Grain that meets the safety requirements and has passed the conformity assessment procedure in accordance with Article 7 of this technical regulation must be marked with a single product circulation mark on the market of the member states of the Customs Union.
Grain is marked with a single product circulation mark on the market of the member states of the Customs Union if it meets the requirements of this technical regulation, as well as other technical regulations of the Customs Union, which apply to it.
2. A single product circulation mark on the market of the member states of the Customs Union is applied to the packaging or to the attached documents in the case of grain transportation in bulk.
A single product circulation mark on the market of the member states of the Customs Union is applied in any way that provides a clear and clear image during the entire shelf life of the grain.
3. Marking with a single sign of circulation of products on the market of the member states of the Customs Union is carried out by the applicant before the release of grain into circulation on the single customs territory of the Customs Union.
1. The member states of the Customs Union are obliged to take all measures to restrict, prohibit the release into circulation of the supplied grain in the single customs territory of the Customs Union, as well as the withdrawal from the market of the supplied grain that does not meet the requirements of this technical regulation.
2. The authorized body of a member state of the Customs Union is obliged to notify the Commission of the Customs Union and the authorized bodies of other member states of the Customs Union of the decision taken, indicating the reasons for making this decision and providing evidence explaining the need to take this measure.
3. In case of disagreement of the authorized bodies of other member states of the Customs Union with the adopted decision referred to in paragraph 1 of this Article, the authorized bodies of all member states of the Customs Union shall hold consultations with a view to making a mutually acceptable decision.
