About the requirements for lubricants, oils and special liquids

Preface

This technical regulation of the Customs Union (hereinafter referred to as the technical Regulation) was developed in accordance with the Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.


This technical regulation is developed with the aim of establishing in the single customs territory of the Customs Union uniform mandatory requirements for the application and execution of lubricants, oils and special liquids, used lubricants, oils and special liquids and products obtained as a result of processing (disposal) of spent products at the stages of the life cycle of products put into circulation in the single customs territory of the Customs Union.


If other technical regulations of the Customs Union are adopted with respect to lubricants, oils and special liquids, products obtained as a result of processing (recycling) of spent products, then lubricants, oils and special liquids, products obtained as a result of processing (recycling) of spent products must comply with the requirements of the technical regulations of the Customs Union, which apply to them.

Article 1. Scope of application

1.1. This technical regulation establishes requirements for lubricants, oils and special liquids (hereinafter referred to as products), for spent lubricants, oils and special liquids (hereinafter referred to as spent products), for products obtained as a result of processing of spent products, in order to protect human life and health, property, the environment, life and (or) health of animals and plants, to prevent actions misleading consumers (users), as well as for resource conservation.


This technical regulation applies to:


a) lubricants, including:


- lubricating oils of organic origin, including:


1) engine oils (universal, carburetor, diesel, for aircraft piston engines);


2) transmission oils;


3) hydraulic oils;


4) industrial oils;


5) compressor oils;


6) turbine oils;


7) anticorrosive oils;


8) electrical insulating oils;


9) base oils.


- plastic lubricants;


b) special liquids:


- cooling fluids (including lubricating and cooling fluids);


- brake fluids;


c) waste products.


1.2. The main dangerous factors (risks) arising during the release into circulation, handling, use (operation) and processing (disposal) of products are:


fire and explosion hazard of products;


the content of water and mechanical impurities in an amount exceeding the established norms;


environmental impact of waste products when they enter the environment;


harmful effects on the human body.


1.3. This technical regulation applies to products that are put into circulation, are in circulation in the single customs territory of the Customs Union and used products.


1.4. This technical regulation does not apply to the following products:


delivered under the state defense order;


exported outside the single customs territory of the Customs Union;


stored in organizations that ensure the safety of the state material reserve;


vegetable and animal oils;


obtained as a result of high-temperature distillation of coal tar (including creosote);


does not fall under the concepts of "oil", "lubricant", "special liquid", established by Article 2 of this technical regulation;


oils used for the manufacture of perfumery and cosmetic products, medical products and medicines.

Article 2. Definitions

The following terms and their definitions are used in this technical regulation:


product safety - the absence of an unacceptable risk associated with harm to life, human health, the environment, including flora and fauna, taking into account the combination of the probability of the implementation of a dangerous factor and the severity of its consequences;


release into circulation - the primary transfer of products from the manufacturer (importer) to the seller and (or) consumer;


product identification - establishing the identity of the characteristics of the products submitted for mandatory confirmation of compliance with the characteristics specified in the accompanying documents for the products;


identification of waste products - determining whether the spent products belong to a particular type of waste and establishing data on its hazardous, resource, technological and other characteristics;


manufacturer - a legal entity, including a foreign one, or an individual entrepreneur who carries out the production and sale of products on their own behalf and (or) on behalf of the manufacturer, responsible for its compliance with the requirements of this technical regulation;


an importer is a resident of a member state of the Customs Union who enters into a foreign trade agreement with a non-resident of the Customs Union state for the transfer of products( spent products), stores and sells (wholesale and (or) retail trade) of these products (spent products) and is responsible for its compliance with the requirements of this technical regulation;


life cycle - the stages (stages) of the state of products when they are put into circulation, handled, used (operated) and processed (disposed of);


product brand - a verbal and (or) alphabetic, digital designation of the product;


oil is a liquid of petroleum or synthetic (semi-synthetic) origin, used as a lubricant and (or) a special liquid;


anticorrosive oils - oils used for temporary protection of ferrous and non-ferrous metals from corrosion;


base oils - oils used as raw materials for the production of commercial lubricating oils;


industrial oils - lubricating oils used in machines and mechanisms of industrial equipment;


compressor oils - lubricating oils used for the lubrication of reciprocating and rotary compressors;


motor oils - lubricating oils used for reciprocating internal combustion engines;


transmission oils - oils used for lubricating transmission units of various machines and mechanisms;


turbine oils are lubricating oils used for the lubrication of turbine units: steam gas turbines, turbochargers, hydraulic turbines, marine steam turbine installations;


electrical insulating oils - oils used for insulation and cooling of electrical devices and devices: transformers, capacitors, cables;


product circulation on the market - the stages of product movement from the manufacturer to the consumer (user), which the product passes after its release into circulation;


treatment of waste products - the stages of collection and processing (disposal) of waste products;


used products - used lubricants, used oils and used special liquids that have lost their operational properties, including those drained from working systems, classified as waste and subject to recycling (disposal) in order to obtain lubricants, oils and special liquids;


batch of products - the number of products of the same brand, accompanied by one quality document (passport);


chemical product safety data sheet - a document of the established form containing information about the hazardous properties of chemical products, information about manufacturers (suppliers, importers) of such products, preventive measures and safety requirements to ensure the safe handling of chemical products;


product quality passport (spent products) is a document that establishes the compliance of numerical values of product quality indicators (spent products) obtained as a result of laboratory tests with the requirements of regulatory documentation issued by the manufacturer;


consumer - a natural or legal person who has the intention to order or purchase, or who orders, purchases or uses products exclusively for their own needs;


seller - a legal entity or individual entrepreneur who is a resident of a member state of the Customs Union, who carries out wholesale (retail) sales of products to the consumer (user) and is responsible for the circulation of products (used products) on the market that meet the requirements of this technical regulation;


a waste product collection point is an engineering and technical complex designed for receiving, storing, accounting, preparing and shipping spent products;


collection of waste products - activities related to the withdrawal of waste products from the places of its formation, for its subsequent processing (disposal);


a lubricant is a substance of petroleum or synthetic origin that facilitates the process of friction on the working surfaces of contacting parts, as a result of which the friction force and surface wear are reduced;


special liquid - a liquid of petroleum or synthetic origin intended for use as a working fluid;


recycling (utilization) of spent products - the processes of completing the life cycle of spent products in order to obtain new products.

Article 3. Rules for the circulation of products on the market

3.1. Products put into circulation in the single customs territory of the Customs Union must comply with the requirements of this technical regulation, as well as other technical regulations of the Customs Union, which apply to it.


3.2. It is allowed to release into circulation and circulation of products whose compliance is confirmed by the requirements of this technical regulation.


3.3. The identification of lubricants, oils and special liquids for the purpose of applying this technical regulation is carried out according to the documentation. Technical documents, and/or quality certificates, test reports, and/or supply contracts, and/or specifications, and/or labels, and/or annotations and other documents describing the products can be used as documentation. The signs that characterize oils, lubricants and special liquids are the use of products as a lubricant or a special liquid.


Identification of spent products is carried out according to the following criteria:


it is intended exclusively for processing (recycling) in order to obtain commercial petroleum products;


obtained as a result of using the product for its intended purpose;


it is used as a feedstock for the production of commercial petroleum products.


3.4. Each batch of lubricants, oils and special liquids put into circulation and (or) in circulation must be accompanied by a product quality certificate.


The quality passport must contain:


name, brand designation and purpose of the product;


the name of the manufacturer (the person authorized by the manufacturer) or the importer, or the seller, its trademark (if any), location (indicating the country), information for contacting him;


normative values of product safety indicators in accordance with Annex 1 to this technical regulation and actual test results;


designation of the document according to which the products are manufactured (if available);


the normative values of product indicators established by the normative document in accordance with which the products are manufactured, and the actual test results;


terms and conditions of storage;


date of manufacture (month, year);


batch number;


passport number;


signature of the person who issued the passport.


3.5. The products must have a chemical product safety data sheet (hereinafter referred to as the safety data sheet).


3.6. The seller, at the request of the consumer, is obliged to provide the consumer with a copy of the quality passport and/or a copy of the safety passport.


3.7. The quality certificate and the safety passport are executed in Russian and/or the state language of the member state of the Customs Union, on the territory of which this product will be sold.


3.8. Requirements for the handling of waste products.


3.8.1. The spent products are subject to delivery to the collection points of spent products for preparation for subsequent processing (disposal).


Storage of waste products is carried out by brands or groups in accordance with Annex 2 to this technical regulation.


3.8.2. Spent products delivered from the collection points of spent products for processing (disposal) or prepared for independent processing (disposal) by the manufacturer of spent products must be accompanied by a quality certificate and comply with the requirements set out in Annex 3 to this technical regulation. The requirements of this technical regulation, set out in Annex 3 to this technical regulation, do not apply to spent products delivered to waste collection points.


3.8.3. When handling waste products, it is prohibited:


discharge (discharge) into reservoirs, on the soil and into public sewer networks;


removal to landfills for household and industrial waste with subsequent disposal;


mixing with oil( gas condensate), gasoline, kerosene, fuel (diesel, marine, boiler-furnace, fuel oil) in order to obtain fuel intended for power plants, except for cases permitted by the competent authorities of the Customs Union member states in the field of environmental management and environmental protection;


mixing with products containing organohalogen compounds;


application as anti-adhesive materials and means for impregnation of building materials.


3.8.4 Activities for the collection and disposal of waste products are carried out in accordance with the legislation of the member states of the Customs Union.

Article 4. Safety requirements

4.1. Products and products obtained as a result of processing (disposal) of spent products (lubricants, oils and special liquids obtained as a result of processing (disposal) of spent products) must comply with the requirements specified in Annex 1 to this technical regulation.


4.2. The packaged products must be labeled. The marking must contain:


name and location (legal address, including country) of the manufacturer, its trademark (if any);


name, brand designation and purpose of the product;


the designation of the document in accordance with which it is produced (if available);


storage period and conditions;


date of manufacture;


batch number;


bar identification code (if necessary).


4.3. Products that are capable of having a harmful effect on human health, the environment, having fire-hazardous properties, must have an appropriate warning label.


4.4. The marking must be stated in the official and state language of the member state of the Customs Union, on the territory of which this product is sold to the consumer, if there are relevant requirements in the legislation of the member state(s) of the Customs Union, with the exception of the manufacturer's name and the name of the product, as well as other text included in the registered trademark. Additional use of foreign languages is allowed provided that the content is completely identical with the text.


4.5. The marking must be clear and legible, made in a way that ensures its safety to packaged products and environmental influences.


4.6. When delivering unpacked products, information about it is provided in the quality certificate.

Article 5. Ensuring compliance

5.1. The compliance of products with this technical regulation is ensured by the fulfillment of its safety requirements directly or by the fulfillment of the requirements of the standards included in the list of standards, as a result of the application of which compliance with the requirements of this technical regulation is ensured on a voluntary basis.


5.2. The rules and methods of research (testing) and measurements, including the sampling rules necessary for the application and fulfillment of the requirements of this technical regulation and the assessment (confirmation) of product conformity, are established in interstate standards, and in their absence (before the adoption of interstate standards) - national (state) standards of the member states of the Customs Union.

Article 6. Confirmation of conformity

6.1. Before being put into circulation on the market, the products must be subjected to a conformity assessment procedure in the form of a declaration of conformity. When confirming compliance, the applicant may be a legal entity or an individual as an individual entrepreneur who is a manufacturer (a person authorized by the manufacturer) or an importer (seller).


6.2. Before confirming compliance, the product identification procedure is carried out.


6.3. Declaration of conformity of products to the requirements of this technical regulation is carried out according to the schemes 1D or 2D in accordance with Annex 4 to this technical regulation.


6.4. Tests for the purpose of declaring conformity are organized by the manufacturer (a person authorized by the manufacturer), the importer (seller) in a testing laboratory or an accredited testing laboratory (center) included in the Unified Register of Certification Bodies and Testing Laboratories (centers) of the Customs Union.


6.5. When confirming the conformity of products, the applicant forms a set of documents confirming the compliance of this product with the safety requirements of this technical regulation, which includes:


technical specifications (if available);


contract (supply contract) and shipping documentation (when declaring compliance according to the 2D scheme);


certificate for the manufacturer's quality management system (if available);


product quality certificate;


product safety data sheet;


test reports confirming the conformity of products with the safety requirements of this technical regulation;


a copy of the document confirming that the applicant is registered in accordance with the established procedure in a member state of the Customs Union as a legal entity or individual entrepreneur;


certificates of conformity issued, including by foreign certification bodies (if available).


6.6. When declaring conformity according to scheme 1D, the applicant forms a set of documents specified in paragraph 6.5 of this technical regulation, carries out production control and takes all necessary measures to ensure that the production process ensures compliance with the requirements of this technical regulation, tests samples, accepts and registers a declaration of conformity and applies a single product circulation mark on the market of the member states of the Customs Union.


6.7. When declaring conformity according to the 2D scheme, the applicant forms a set of documents specified in paragraph 6.5 of this technical regulation, tests samples, accepts and registers a declaration of conformity and applies a single product circulation mark on the market of the member states of the Customs Union.


6.8. The declaration of conformity is subject to registration in accordance with the procedure established by the legislation of the Customs Union.


The validity period of the declaration of conformity begins from the date of its registration:


for mass-produced products-no more than three years; for a batch of products-for the shelf life of the products.


6.9. A set of documents for products, including a declaration of conformity, must be stored on the territory of the member states of the Customs Union:


for products produced in series-from the manufacturer (authorized person) for at least ten years from the date of withdrawal (termination) from the production of products;


for a batch of products-from the importer( seller), manufacturer (authorized person) for at least ten years from the date of registration of the declaration of conformity.

Article 7. Marking with a single sign of the circulation of products on the market of the member states of the Customs Union

7.1. Lubricants, oils and special liquids that meet the requirements of this technical regulation and have passed the conformity assessment procedures in accordance with Article 8 of this technical regulation must be marked with a single product circulation mark on the market of the member states of the Customs Union.


7.2. Marking with a single product circulation mark on the market of the member states of the Customs Union is carried out before the release of lubricants, oils and special liquids into circulation on the market.


7.3. Lubricants, oils and special liquids are marked with a single product circulation mark on the market of the member states of the Customs Union if they comply with the requirements of all technical regulations of the Customs Union, which apply to them and provide for the application of this mark.


7.4. A single product circulation mark on the market of the member states of the Customs Union is applied to each unit of packaging, and is also given in the quality certificate.

Article 8. Protective clause

8.1. Responsibility for non-compliance with the requirements of this technical regulation, as well as for violation of the procedures for confirming the conformity of products with the requirements of this technical regulation is established by the legislation of each Party. If products are found that do not meet the requirements of this technical regulation or are subject to confirmation of compliance with the mandatory requirements established for it and are received or are in circulation without a document confirming compliance and (or) without marking with a single product circulation mark on the market of the member states of the Customs Union, the authorized bodies of each Party shall take measures to prevent the release of this product into circulation, to withdraw it from circulation in accordance with the legislation of the Party, as well as to inform other Parties about this.


8.2. State control (supervision) over compliance with the requirements of this technical regulation is carried out in accordance with the procedure established by the legislation of the member states of the Customs Union.
