Technical Regulations of the Eurasian Economic Union "On the safety of oil prepared for transportation and (or) use" (TR EAEU 045/2017)

I. Scope of application

1. This technical regulation has been developed in accordance with Article 52 of the Treaty on the Eurasian Economic Union of May 29, 2014 and establishes mandatory oil safety requirements for application and enforcement in the customs territory of the Eurasian Economic Union (hereinafter referred to as the Union) in order to ensure the protection of human life and (or) health, property, environmental protection and prevention of actions misleading consumers, as well as to ensure energy efficiency and resource conservation.


2. The object of technical regulation of this technical regulation is oil prepared for transportation and (or) use, put into circulation and being in circulation on the Union market.


3. This technical regulation does not apply to oil supplied for export outside the customs territory of the Union, supplied under a state defense order, stored in organizations that ensure the safety of the state material reserve, as well as used by the manufacturer (producer) of oil exclusively for their own needs.

II. Basic concepts

4. For the purposes of applying this technical regulation, the concepts that mean the following are used:


"oil safety" - the state of oil in which there are no unacceptable risks associated with the possibility of causing harm and (or) causing damage;


"release into circulation of oil" - the primary transfer of oil from the manufacturer (producer) of oil to the seller and (or) the consumer (including sending from the warehouse of the manufacturer (producer) of oil or shipping without warehousing) or the import of oil for distribution in the customs territory of the Union in the course of commercial activity on a gratuitous or paid basis;


"producer (producer) of oil" - a legal entity, including a foreign person, engaged in the production or production and sale of oil on its own behalf and responsible for its compliance with the requirements of this technical regulation, as well as other technical regulations of the Union, which apply to it;


"oil" is a liquid natural fossil mixture of hydrocarbons of a wide physical and chemical composition, prepared for transportation by main pipeline, rail, road and water transport and (or) for use as raw materials in oil refining and petrochemical industries;


"oil circulation on the market" - the movement of oil from the manufacturer (producer) of oil to the consumer;


"oil shipment" - the quantity of oil accompanied by one document on the quantity (a route order, or an act of acceptance and delivery of oil, or a consignment note for shipment, or a bill of lading) and one passport;


"consumer" - a legal entity or an individual registered as an individual entrepreneur who intends to order or purchase or who orders, purchases or uses oil;


"seller (including importer)" - a legal entity or an individual registered as an individual entrepreneur who is a resident of a member state of the Union, who sells oil to the consumer in accordance with the legislation of a member state of the Union and is responsible for placing oil on the Union market and its compliance with the requirements of this technical regulation, as well as other technical regulations of the Union, which apply to it;


"a person authorized by the manufacturer (producer) of oil" - registered in accordance with the legislation of the state - a legal entity or an individual registered as an individual entrepreneur on its territory, who, on the basis of an agreement with an oil manufacturer (producer), including a foreign oil manufacturer (producer), perform actions on behalf of this oil manufacturer (producer) during the assessment of compliance and release of oil into circulation on the Union market, and are also responsible for oil compliance with the requirements of this technical regulation, as well as other technical regulations of the Union, which apply to it.

III. Rules for the circulation of oil on the Union market

5. Oil that is put into circulation and is in circulation on the Union market must comply with the requirements of this technical regulation, as well as the requirements of other technical regulations of the Union, the effect of which applies to it.


6. Each batch of oil that is put into circulation and is in circulation on the Union market must be accompanied by a passport that contains the following information:


a) the name, location (address) of a legal entity or the surname, first name and patronymic (if any), the place of residence of an individual registered as an individual entrepreneur who is a manufacturer (producer) of oil or a seller (including an importer) or a person authorized by the manufacturer (producer) of oil who has issued a passport;


b) the trademark of the manufacturer (producer) of oil (if available);


c) the designation and name of the document according to which the oil was produced (if available), and its name and designation in accordance with this document;


d) the normative values of oil indicators established in the requirements for oil indicators in accordance with the annex and in the document in accordance with which the oil was manufactured( produced), as well as the actual results of laboratory tests indicating the name of its own testing laboratory or an accredited testing laboratory included in the Unified Register of Conformity Assessment Bodies of the Eurasian Economic Union (hereinafter-the Unified Register);


e) batch number;


f) a single sign for the circulation of products on the Union market;


g) the number and date of issue of the passport;


h) surname, initials and signature of the person who issued the passport.


7. The passport is issued in Russian and, if there are relevant requirements in the legislation of the member state of the Union, in the state (state) language (s) of the member state of the Union on the territory of which oil is sold.


8. When selling oil, the seller (including the importer) is obliged to provide a copy of the passport at the request of the consumer.


9. The passport is issued when receiving (handing over) oil for the purposes of transportation, storage, processing and sale.

IV. Oil safety requirements

10. Oil released into circulation and being in circulation on the Union market must meet the requirements for the indicators specified in the annex to this technical regulation.


11. In the manufacture (production) and transportation of oil, the use of chemical reagents containing organochlorine compounds is not allowed.

V. Ensuring oil compliance with safety requirements

12.The safety of oil is ensured by compliance with the requirements established by this technical regulation, as well as the requirements of other technical regulations of the Union, which apply to it.


13. The test methods carried out in the assessment of oil compliance with the requirements of this technical regulation are established in the standards included in the list of international and regional (interstate) standards, and in their absence-national (state) standards containing rules and methods of research (testing) and measurements, including the rules of sampling necessary for the application and fulfillment of the requirements of this technical regulation and the assessment of compliance of objects of technical regulation.

VI. Oil conformity assessment

14. Before oil is put into circulation on the Union market, it is subject to an assessment of compliance with the requirements of this technical regulation, which is carried out in the form of tests with a passport.


15. The assessment of oil compliance with the requirements of this technical regulation is carried out by an applicant (a legal entity or an individual registered as an individual entrepreneur) registered in the territory of a member state of the Union in accordance with its legislation, who is a manufacturer (producer) of oil or a seller (including an importer) or a person authorized by the manufacturer (producer) of oil, using measuring instruments that meet the requirements established by the legislation of the states - members of the Union in the field of ensuring the uniformity of measurements.

VII. Marking of oil with a single sign of product circulation on the Union market

18. Oil that meets the requirements of this technical regulation, as well as the requirements of other technical regulations of the Union, which apply to it, and has passed the conformity assessment procedure in accordance with section VI of this technical regulation, is marked with a single product circulation mark on the Union market.


19. Marking with a single sign of the circulation of products on the Union market is carried out before the release of oil into circulation on the Union market.


20. A single sign of the circulation of products on the Union market is affixed in the passport.
