About the safety of perfume and cosmetic products

(as amended on March 29, 2019)

Article 1. Scope of application

1. This technical regulation of the Customs Union (hereinafter - the CU) applies to perfume and cosmetic products in consumer containers that are put into circulation on the territory of the CU member states.


2. This technical regulation of the CU does not apply to products intended for ingestion, inhalation, injection or implantation into the human body, tattoo products applied with a violation of the skin, as well as products used for the diagnosis and treatment of diseases.


3. This technical regulation of the Customs Union establishes requirements for products, as well as for related production processes, in order to protect human life and health, property, environmental protection, as well as to prevent actions that mislead consumers about their purpose and safety.

Article 2. Rules for the identification of perfume and cosmetic products

1. For the purpose of applying this technical regulation of the Customs Union, identification is carried out according to the signs characterizing perfume and cosmetic products and established in this technical regulation of the Customs Union.


2. The signs that characterize perfume and cosmetic products are:


- method of application of products-perfume and cosmetic products are intended exclusively for external application to certain parts of the human body;


- place of application of products-perfume and cosmetic products are applied to the skin, hair, nails, lips, teeth, oral mucosa and external genitalia;


- the purposes of using the products (individually or in any combination) - cleansing and / or changing the appearance of the skin, hair, nails, lips, teeth, oral mucosa and external genitalia without violating their integrity, giving them a pleasant smell and/or correcting the smell, maintaining them in a normal functional state.


3. Identification of perfumery and cosmetic products for the purpose of applying this technical regulation of the Customs Union is carried out according to the documentation. Technical documents, and/or supply contracts, and/or specifications, and/or labels, and/or annotations and other documents describing the products can be used as documentation.

Article 3. Terms and definitions

The following terms and their definitions are used in this technical regulation of the Customs Union:

the safety of perfumery and cosmetic products is a set of properties and characteristics of perfumery and cosmetic products that ensure the absence of harmful effects of perfumery and cosmetic products on the consumer when used in accordance with the purpose and method of application during the shelf life;


secondary packaging - packaging in which perfume and cosmetic products are placed in the primary packaging, but not being transport;


release into circulation - the moment (including the first offer), starting from which the products are intended by the manufacturer or seller (importer) for sale or otherwise transferred to consumers on the territory of the CU member states;


manufacturer - a legal entity, an individual entrepreneur who produces perfume and cosmetic products and/or puts into circulation perfume and cosmetic products under its name and / or trademark and is responsible for its compliance with the requirements of this technical regulation of the Customs Union;


an importer-a resident of a CU member state who has concluded a foreign trade agreement with a non-resident of a CU member state for the transfer of perfumery and cosmetic products, sells these perfumery and cosmetic products and is responsible for its compliance with the requirements of this technical regulation of the CU;


an ingredient of perfumery and cosmetic products (ingredient) is a substance or a mixture of substances of synthetic or natural origin used for the production of perfumery and cosmetic products. The ingredients do not include impurities in the ingredients, as well as materials used in the manufacture of perfume and cosmetic products and not present in the finished product;


preservatives are chemicals of natural and / or synthetic origin that ensure the resistance of perfume and cosmetic products to microbial contamination during the shelf life;


decorative cosmetics - perfumery and cosmetic products for making up the face, eyes, lips, eyebrows, body and coloring hair and nails;


children's cosmetics - perfumery and cosmetic products intended for children under the age of 14;


intimate cosmetics - perfumery and cosmetic products for the care of the external genitals and areas of the body around them;


professional cosmetics - perfumery and cosmetic products intended for use by legal entities and individual entrepreneurs in the provision of hairdressing and / or cosmetic services;


cosmetics for tattooing - perfumery and cosmetic products intended for applying a pattern to the skin without injecting;


dyes are chemicals of natural or synthetic origin intended for giving color to perfume and cosmetic products or included in the composition of perfume and cosmetic products intended for coloring skin, hair and nails;


labeling of perfumery and cosmetic products (labeling) - information for the consumer in the form of inscriptions, digital, color and graphic designations applied to consumer containers, labels, labels;


the name of perfumery and cosmetic products is a verbal and / or digital designation of the product assigned to it by the manufacturer;


the purpose of perfumery and cosmetic products is a functional property of perfumery and cosmetic products that specifies the scope of its application;


the name of perfumery and cosmetic products is the designation of the type of homogeneous perfumery and cosmetic products (toothpaste, lotion, perfume, cream, etc.);


nanomaterial is an insoluble or bio-resistant and specially produced material with at least one external size or internal structure in the range from 1 to 100 nm;


homogeneous perfume and cosmetic products - products of the same name, similar in ingredient composition and meeting the same requirements;


perfumery and cosmetic products (PCP) - a substance or mixtures of substances intended for application directly to the external cover of a person (skin, hair, nails, lips and external genitals) or to the teeth and mucous membrane of the oral cavity for the sole or main purpose of cleansing them, changing their appearance, giving a pleasant smell, and / or correcting body odor, and / or protecting and / or keeping them in good condition, and / or caring for them;


perfumery and cosmetic products for artificial tanning - products that give the effect of tanning to the skin due to a chemical reaction without exposing the skin to UV rays (self-tanning, autobronzant, etc.);

primary packaging - packaging that is in direct contact with perfume and cosmetic products;


peeling-perfumery and cosmetic products for the removal of surface cells of the epidermis due to chemical exposure;

consumer packaging of perfumery and cosmetic products - primary or a combination of primary and secondary packaging of perfumery and cosmetic products that comes to the consumer with perfumery and cosmetic products and does not perform the function of a transport container;


a sample is a sample of perfume and cosmetic products presented in small packaging and / or simplified packaging, intended for testing and approbation;


seller - a legal entity or an individual registered as an individual entrepreneur, who is a resident of a member state of the Eurasian Economic Union, which sells perfume and cosmetic products. If the seller is an applicant for the purpose of conformity assessment, he is responsible for the compliance of perfume and cosmetic products with the requirements of this technical regulation, as well as the requirements of other technical regulations of the Eurasian Economic Union (CU), which apply to it;

products with microbiologically low risk - products whose environment excludes physical and chemical conditions for the growth and (or) survival (preservation of viability) of microorganisms;

recipe - a complete list of ingredients that are part of perfume and cosmetic products, established by the manufacturer, indicating the mass fraction of ingredients;


sachet-perfume and cosmetic products in a single consumer soft container;


oral hygiene products - perfumery and cosmetic products of hygienic and / or preventive action intended for direct application to the teeth, gums and mucous membrane of the oral cavity with the sole and / or main purpose of their purification, aromatization, changing their appearance, protecting them, maintaining them in good condition;


shelf life - the period after which perfume and cosmetic products are considered unsuitable for their intended use. The expiration date is set by the manufacturer of the product in the technical documents. During the shelf life of the product, the manufacturer is obliged to guarantee that the product meets the safety requirements for the life and health of the consumer and the preservation of its consumer properties under the storage conditions;


standard storage conditions for perfume and cosmetic products - the storage temperature for liquid products is not lower than 5°C and not higher than 25°C; for toilet solid soap is not lower than minus 5°C, for other perfume and cosmetic products-not lower than 0°C and not higher than 25°C, no direct exposure to sunlight;


sterile perfumery and cosmetic products - perfumery and cosmetic products packaged in a sealed package intended for single use, for which the requirements of sterility are established;

technical documents - documents according to which the manufacture, storage, transportation of perfumery and cosmetic products are carried out (technical specifications, standards, technological instructions, recipes, specifications, etc.);


transport container - a container intended for packaging, storage and transportation of perfume and cosmetic products in consumer containers, forming an independent transport unit;


authorized representative of the manufacturer - a legal entity or individual entrepreneur registered in accordance with the established procedure in a member state of the Customs Union and authorized by the manufacturer to perform actions on his behalf when confirming compliance and releasing perfume and cosmetic products into circulation on the market and responsible for its compliance with the requirements of this technical regulation of the Customs Union;


UV filter (UV filter) - a substance designed to protect the skin from the penetration of ultraviolet radiation by absorption, reflection or scattering;


label - a means of information about packaged perfume and cosmetic products located on consumer containers;


a label is a product of any shape, size and material intended for marking, attached or attached to a unit of perfume and cosmetic products or enclosed in a package.

Article 4. Rules of circulation on the market

1. Perfumery and cosmetic products are put into circulation on the market if they comply with this technical regulation, as well as other technical regulations of the Customs Union, the requirements of which apply to them, without presenting additional requirements for perfumery and cosmetic products contained in this technical regulation of the Customs Union and without conducting additional conformity assessment (confirmation) procedures.


2. Perfume and cosmetic products that do not meet the requirements of this technical regulation should not be marked with a single product circulation mark on the market of the member states of the Customs Union, and are not allowed to be placed on the market.

Article 5. Requirements for perfume and cosmetic products

1. The safety of perfumery and cosmetic products is ensured by a set of requirements:


1) to the composition;


2) to the physical and chemical parameters;


3) to microbiological indicators;


4) to the content of toxic elements;


5) to toxicological indicators;


6) to clinical (clinical and laboratory) indicators;


7) for production;


8) to consumer containers;


9) to the labeling of products.


2. Requirements for the composition of perfume and cosmetic products


2.1. it is prohibited to use substances in perfumery and cosmetic products according to Annex 1;


2.1_1. it is forbidden to use sucrose and other easily fermentable carbohydrates as ingredients in oral hygiene products;

2.2. it is allowed to use substances in perfumery and cosmetic products, taking into account the specified restrictions in accordance with Annex 2;


2.3. it is allowed to use dyes in perfumery and cosmetic products according to Appendix 3;


2.4. it is allowed to use preservatives in perfumery and cosmetic products in accordance with Annex 4;


2.5. it is allowed to use ultraviolet filters in perfumery and cosmetic products in accordance with Annex 5.


2.6. The lists of ingredients of perfumery and cosmetic products, which are given in appendices 1-5, are updated in accordance with the established procedure.


3. Requirements for physical and chemical parameters of perfume and cosmetic products


For perfumery and cosmetic products specified in Annex 6, the value of the hydrogen index (pH) must correspond to the norm established in this annex. The requirements for the value of the hydrogen index (pH) in the following perfume and cosmetic products are not regulated:

waxes and wax strips for depilation;

anhydrous cosmetic products for nail care based on organic solvents;

solid deodorants and solid antiperspirants;

solid bath products;

100% essential oils.

For fluorinated oral hygiene products, the fluoride content (in terms of the molar mass of fluoride) must meet the requirements contained in Annex 2.


4. Requirements for microbiological indicators of perfume and cosmetic products


4.1. Microbiological indicators of perfumery and cosmetic products must comply with the requirements contained in Annex 7.


4.2. Microbiological indicators are not determined for perfume and cosmetic products with a microbiologically low risk, including for:


1) perfume and cosmetic products containing ethyl alcohol and (or) organic solvents in a concentration of more than 20% by volume, used without dilution;


2) nail polishes, except water-based nail polishes;


3) deodorants, antiperspirant deodorants, antiperspirants;


4) oxidizing hair dyes, lightening and highlighting products;


5) products for perming and hair straightening products based on thiol compounds;


6) depilation products;


7) solid toilet soap on a fat basis;


8) dry pencils;


9) bath salts;


10) 100% essential oils;


11) teeth whitening products containing hydrogen peroxide or other components that emit hydrogen peroxide, including carbamide peroxide and zinc peroxide, with a concentration of hydrogen peroxide (as an ingredient or released) of 0.1-6.0%;


12) shaving products (creams, gels, etc.) having a hydrogen pH of more than 10.0.

5. Requirements for the content of toxic elements


In perfumery and cosmetic products, which include raw materials of natural vegetable or natural mineral origin in an amount of more than 1%, the content of toxic elements should not exceed: arsenic-5.0 mg/kg; mercury-1.0 mg/kg; lead-5.0 mg/kg.


6. Requirements for toxicological and clinical (clinical and laboratory) indicators of perfume and cosmetic products


6.1. Perfume and cosmetic products, when used for their intended purpose, must be safe for humans.


6.1.1. Toxicological indicators of perfumery and cosmetic products must comply with the requirements contained in Annex 8.


6.1.2. Clinical (clinical and laboratory) indicators of perfumery and cosmetic products must meet the requirements contained in Annex 9.


6.1.3. Clinical indicators of oral hygiene products must comply with the requirements contained in Annex 10.


6.1.4. Toxicological tests of decorative cosmetics, including nail polishes, as well as coloring and tinting products for hair of the same name and name, made according to a single technical document, but differing in tone, are carried out in full on a sample of at least 30% of the tones declared for the study. The test samples should contain the maximum amount of each specific dye. For the other tones declared for the study, only the sensitizing effect is determined.


6.1.5. Toxicological and clinical (clinical and laboratory) indicators of perfumery and cosmetic products are determined in accredited testing laboratories (centers) after receiving positive results of product tests for physico-chemical and microbiological indicators.


7. Requirements for the production of perfume and cosmetic products


7.1. Requirements for production processes


To ensure the safety of perfume and cosmetic products in the production process, it is necessary:


- to carry out its production in accordance with the requirements of paragraph 7.2 of this technical regulation;


- to carry out the production of products in production facilities that meet the requirements of paragraph 7.3 of this technical regulation;


- use technological equipment and inventory that meets the requirements of paragraph 7.4 of this technical regulation;


- to allow personnel who meet the requirements of paragraph 7.5 of this technical regulation to produce products;


7.2. Ensuring the safety of perfume and cosmetic products in the process of its production


The safety of products in the process of their production and circulation should be ensured by:


- selection of the production processes necessary to ensure the safety of products;


- selection of the sequence and flow of technological processes of production that excludes contamination of raw materials, packaging materials, unpacked products and finished products;


- determination of controlled stages of technological processes and products at the stages of its production in production control programs;


- carrying out control over raw materials, technological means and auxiliary materials used in the production of products, as well as control over unpacked and finished products by means that ensure the necessary reliability and completeness of control;


- establishing requirements for raw materials, packaging, marking materials, acceptance criteria, measures in the presence of defects or minor deviations, transportation and storage conditions. Raw materials, packaging, marking materials that do not meet the acceptance criteria must be appropriately labeled and placed in such a way as to prevent their use in production. Raw materials and materials after the expiration of the established storage period should be checked to determine their suitability for further use. It is forbidden to use raw materials with an expired shelf life in production;

- carrying out control over the functioning of technological and measuring equipment in the manner that ensures the production of products that meet the requirements of this technical regulation;

- providing documentation of information about the controlled stages of technological processes and the results of control of perfumery and cosmetic products at the stages of its production;


- accounting and registration with details of all technological operations for each stage (indication of the added raw materials, temperatures, speeds, mixing time, sampling, cleaning, sanitary treatment of equipment, if necessary, and transfer of unpacked products);


- compliance with the storage conditions of products;


- maintenance of production facilities, technological equipment and inventory used in the production process in a condition that excludes its contamination;


- the choice of ways for employees to comply with the rules of personal hygiene in order to ensure product safety;


- the use of methods that ensure the safety of unpacked and finished products and the establishment of the frequency of cleaning, washing, disinfection, disinsection and deratization of industrial premises, technological equipment and inventory used in the production of perfume and cosmetic products;


- maintaining and storing documentation on paper and (or) electronic media confirming the compliance of the manufactured products with the requirements established by this technical regulation;


- traceability of perfume and cosmetic products at all stages of production;

- control of the finished product, according to the established test methods for compliance with the acceptance criteria, before placing it on the market.


- preservation of archival samples from each batch of perfume and cosmetic products.


7.3. Requirements for production facilities in which the production process of perfumery and cosmetic products is carried out


7.3.1. Production facilities must meet the following requirements:


- ventilation and/or air conditioning systems installed in industrial premises must ensure that air enters the production room, which cannot be a source of product contamination;


- lighting systems installed in industrial premises should ensure that all fragments can be localized and prevented from entering the products, and also should not be a source of contamination of the products;


- changing rooms for personnel for storing personal and industrial (special) clothing of personnel should not be located in industrial premises;


- there should be no toilets in the production premises, the doors of the toilets should not go directly into the production premises;


- the layout of production facilities should allow ensuring the consistency and flow of technological processes that exclude counter or cross flows of raw materials, unpacked and finished products, contaminated and clean inventory, if this is necessary to prevent contamination of products;


- production facilities should be equipped in such a way as to provide protection from the penetration of animals, including rodents and insects;


- production facilities should be equipped in such a way as to exclude areas from which it is impossible to remove dirt, condensation, mold and other similar sources of contamination of products;


- the design of the floors should exclude the accumulation of water in the production room;


- the surfaces of floors, walls and doors must be made of waterproof, washable and non-toxic materials that can be sanitized and disinfected;


- ceilings (in the absence of ceilings - the inner surface of the roof) and structures located above the production premises must exclude the ingress of any particles or condensate into the products;


- opening windows (transoms) must be equipped with protective nets against insects;


- sewage equipment in industrial premises must be designed and executed in such a way as to eliminate the risk of contamination of products.


7.3.2.Storage of any substances and materials that are not used in the production of perfume and cosmetic products, with the exception of detergents and disinfectants, is not allowed in industrial premises. Detergents and disinfectants are allowed to be stored in specially designated areas of the production room.


7.4. Requirements for technological equipment and inventory used in the production of perfume and cosmetic products


7.4.1. Technological equipment and inventory used in the production of perfume and cosmetic products must:


- to make it possible to carry out their sanitary treatment and disinfection;


- be made of materials that are not sources of contamination of products.


7.4.2. Technological equipment, if it is necessary to achieve the goals of this technical regulation, must be equipped with appropriate control devices.


7.5. Requirements for employees engaged in the production of perfume and cosmetic products


7.5.1. Employees engaged in the production of perfumery and cosmetic products by making direct contact with raw materials, unpacked and finished products, materials and inventory in contact with the products (raw materials) must observe personal hygiene, wear clean special production clothes and shoes to the extent necessary so as not to be a source of contamination of the products.


7.5.2. Employees engaged in the production of perfume and cosmetic products are prohibited from bringing objects that are not used in the performance of official duties and may become sources of contamination of products, smoking and eating in these premises.


8. Requirements for consumer packaging of perfume and cosmetic products


8.1. Consumer packaging must ensure the safety and security of perfume and cosmetic products during the shelf life of the products.


9. Requirements for labeling of perfume and cosmetic products


9.1. Labeling of perfumery and cosmetic products is carried out by applying information for the consumer in the form of inscriptions, digital, color and graphic designations on consumer packaging, label, label, taking into account the labeling requirements specified in appendices 2, 3, 4, 5. If information about the composition of products and precautions is placed on a label attached or attached to each unit of products and (or) embedded in secondary packaging, a graphic sign in the form of a hand on an open book is applied to consumer packaging (appendix 11). It is allowed to provide information indicating the place of application of this information instead of a graphic sign (for example: "Ingredients and precautions, see...").

9.2. The labeling of perfume and cosmetic products must contain the following information:


- name, name (if available) of perfume and cosmetic products;


- the purpose of perfume and cosmetic products, if this does not follow from the product name;


- cosmetics intended for children should have the appropriate information in the labeling;


- the name of the manufacturer and its location (legal address, including the country);


- the country of origin of perfume and cosmetic products (if the country where the production of products is located does not coincide with the legal address of the manufacturer);


- the name and location of the organization (legal address) authorized by the manufacturer to accept claims from the consumer (authorized representative of the manufacturer or importer), if the manufacturer does not accept claims himself on the territory of the CU member state;


- the nominal quantity of products in consumer containers (volume, and (or) weight, and (or) pieces). For solid toilet soap, the nominal mass of the piece at the time of packaging. For products with a nominal volume of less than 5 ml (ml) or a nominal weight of less than 5 g (g), as well as for product samples, it is allowed not to specify the nominal quantity;

- color and / or tone (for decorative cosmetics and coloring agents);


- the mass fraction of fluoride in terms of the molar mass of fluorine ( % , or mg / kg, or ppm) for oral hygiene products containing fluorine compounds;

- the expiration date is specified in one of the following ways:

It is allowed to apply the phrase "Shelf life look at..." to consumer packaging, when the shelf life is applied to the bottom of the primary package, the seam of the tube, etc. For products whose consumer packaging has small dimensions or a complex configuration (lipstick, eyeliner, shadows, mascara, etc.), it is allowed to indicate the expiration date as follows: "Until... (date)". The date includes the month and year (mm. yyyy or mm.yy) or day, month and year (dd. mm. yyyy or dd. mm. yy). The expiration date can be specified without a separator or using a separator. The hyphen" -", dot".", slash "/", etc. can be used as a separator. A verbal-digital method of formatting the date is allowed, in this case, the month is written with a word. - special precautions (if necessary) when using the product, including information about the warnings set out in annexes 2-5 of this technical regulation;


- batch number or a special code that allows you to identify a batch of perfume and cosmetic products;


- information about the methods of application of perfumery and cosmetic products, the absence of which may lead to improper use of perfumery and cosmetic products by the consumer;


- the list of ingredients in accordance with paragraph 9.3 of this article.


For aerosol products with propellant, warning labels (warnings) should be given about:

9.3. The list of ingredients must be preceded by the heading "Ingredients" or "Composition".


If the information is presented in accordance with the international nomenclature of cosmetic ingredients (INCI) using letters of the Latin alphabet, then the heading "Ingredients" or "Composition" can be presented together with information indicating the location of the list of ingredients (for example: "Composition / Ingredients look at...").

The ingredients are indicated in order of decreasing their mass fraction in the recipe, while the perfume (aromatic) composition is indicated as a single ingredient without disclosing its composition. If the composition includes the ingredients (N 67-92) specified in Annex 2, and their content exceeds the concentration of 0.01% for flushable products, 0.001% for indelible products, then they must be indicated in the composition.


For products in aerosol packaging with propellant, the composition of the propellant is indicated. The composition of the propellant can be specified either in the list of ingredients or separately.

The ingredients present in the form of nanomaterials should be clearly indicated in the list of ingredients with the words "nano" or "nano" after their names in parentheses if the ingredients are indicated in accordance with the international nomenclature of cosmetics (INCI).


Ingredients with a concentration of less than 1% can be listed in any order after those ingredients with a concentration of more than 1%.


Dyes can be listed in any order after the other ingredients in accordance with the color index or accepted designations.


The list of ingredients can be presented either in the state(s) or the official language (s) of the CU member states in which perfume and cosmetic products are sold, or in accordance with the international nomenclature of cosmetic ingredients (INCI) using the letters of the Latin alphabet.


On decorative cosmetics products produced in the form of a series of different tones, all the dyes used in the series can be listed with the use of the term: "may contain" or the sign (+/ -).


Samples intended for transfer to consumers are marked in accordance with paragraph 9.2 of this article.

It is allowed to indicate this information on consumer containers or on an information carrier located in the immediate vicinity of the probe (label, leaflet, brochure, etc.). In this case, a graphic sign in the form of a hand on an open book is not required to be applied to consumer containers (Appendix 11).

9.4. The information provided for in paragraph 9.2 of this Article must be indelible, clear. The marking must be preserved on consumer containers during storage, transportation, sale and use of products during the shelf life.

9.5. The information on perfume and cosmetic products provided for in paragraph 9.2 of this Article is provided in the state language (s) of the CU Member states in which perfume and cosmetic products are sold.


The name of the manufacturer, the location of the manufacturer and the name of the product, the name of the color and (or) tone (for decorative cosmetics and coloring agents), expressed verbally, the name of the line (series), units of measurement of volume (ml, L) or mass (g, kg) can be written using letters of the Latin alphabet. The country of origin of perfume and cosmetic products is given in the state(s), the official language (s) of the CU member states in which perfume and cosmetic products are sold.

Article 5_1. Ensuring compliance of perfumery and cosmetic products with the requirements of the technical regulations

1. Compliance of products with this technical regulation is ensured by the fulfillment of its safety requirements directly.


2. The methods of research (testing) are established in the standards included in the list of standards containing the rules and methods of research (testing) and measurements, including the rules for sampling, necessary for the application and fulfillment of the requirements of this technical regulation and the assessment of compliance with technical regulation objects.

Article 6. Conformity assessment

1. Before being put into circulation in the customs territory of the Customs Union, perfume and cosmetic products are subjected to the procedure for assessing compliance with the requirements of this technical regulation of the Customs Union.

2. The assessment of compliance of perfumery and cosmetic products with the requirements of this technical regulation of the Customs Union is carried out in the following forms:


confirmation of conformity in the form of declaration of conformity of perfumery and cosmetic products, with the exception of products included in the list according to Annex 12;


state registration of perfumery and cosmetic products included in the list provided for in Annex 12 to this technical regulation of the Customs Union.

3. Declaration of conformity of perfumery and cosmetic products not included in the list provided for in Annex 12 to this technical regulation of the Customs Union is carried out according to one of the following schemes:


3d scheme - for mass-produced perfume and cosmetic products;


scheme 4d - for a batch of perfume and cosmetic products;


scheme 6d-for mass-produced perfume and cosmetic products (if the manufacturer has a certified quality management system or production of products certified for compliance with the principles of good manufacturing practice (GMP)).


The declaration of compliance of perfumery and cosmetic products with the requirements of this technical regulation of the Customs Union is issued for one or more names of perfumery and cosmetic products of the same name.


When declaring the conformity of perfumery and cosmetic products, applicants may be a legal entity or an individual registered in the territory of a CU member state in accordance with its legislation as an individual entrepreneur, who is a manufacturer or importer (seller) or a person authorized by the manufacturer.


When declaring the conformity of perfumery and cosmetic products, applicants can be:


for 3d and 6d schemes-the manufacturer (a person authorized by the manufacturer);


for the 4d scheme - the manufacturer or importer (seller) or a person authorized by the manufacturer.

4. The state registration of perfumery and cosmetic products manufactured on the territory of the Customs Union is carried out at the stage of their production, and perfumery and cosmetic products imported into the territory of the customs territory of the Customs Union-before their import into the customs territory of the Customs Union.


The state registration of perfumery and cosmetic products is carried out by the body of the CU member state authorized to carry out these works in accordance with the legislation of this state (hereinafter referred to as the registration body). The certificate of state registration is issued in respect of one or more names of perfumery and cosmetic products of the same name and is valid until changes are made to this name and (or) the recipe that lead to changes in safety indicators. Applicants for the state registration of perfumery and cosmetic products may be a legal entity or an individual registered in the territory of a CU member state in accordance with its legislation as an individual entrepreneur, who are a manufacturer or importer (seller) or a person authorized by the manufacturer.

To issue a certificate of state registration, the applicant (manufacturer, authorized representative of the manufacturer, importer) must submit the following documents:


- application form;


- copies of the documents according to which the products are manufactured (technical documents and / or a list of ingredients included in the perfume and cosmetic products, indicating the concentration of ingredients listed in appendices 2-5), certified by the applicant;


- a written notification to the manufacturer that the products manufactured by him meet the requirements of the documents in accordance with which they are manufactured. The manufacturer's quality certificate for the products, certified by the manufacturer, or the manufacturer's letter is accepted as a notification;


- copies of documents containing organoleptic and physico-chemical indicators of products, certified by the applicant;


If the manufacturer uses nanomaterials as part of perfume and cosmetic products, it is necessary to provide information about the nanomaterial, including its chemical name, particle size, as well as physical and chemical properties;


- a sample of labeling of consumer packaging of perfumery and cosmetic products, confirming compliance with the requirements of paragraph 9 of Article 5 of this technical regulation of the Customs Union;


- an annotation containing the declared consumer properties (if the manufacturer declares them in the product labeling), special precautions (if necessary) when using the products and information about the methods of using perfume and cosmetic products, the absence of which may lead to improper use of perfume and cosmetic products by the consumer;


- protocols of research (tests) or acts of hygienic examination, or scientific reports, or expert opinions on compliance with the requirements of paragraphs 3-6 of Article 5 of this technical regulation of the Customs Union, obtained in an accredited testing laboratory (center);


- the manufacturer's document on the compliance of production with the requirements of paragraph 7 of Article 5 of this technical regulation (a written notification of the manufacturer on the compliance of production with the requirements of this technical regulation of the Customs Union, or a declaration (statement or written notification) of the manufacturer on compliance with the GMP principles, or a certificate of compliance of the quality management system, or a certificate of compliance of the production of perfumery and cosmetic products with the principles of good manufacturing practice (GMP));


- documents confirming the consumer properties of perfume and cosmetic products declared in the labeling of consumer packaging (antimicrobial effect, anti-wrinkle, SPF-factor, anti-carious, anti-inflammatory effect of oral hygiene products, etc.), certified by the applicant. Statements regarding the consumer properties of perfumery and cosmetic products must be justified taking into account the general criteria given in Annex 13.

- an extract from the Unified State Register of Legal Entities or the Unified State Register of Individual Entrepreneurs.


Translations of the manufacturer's documents from a foreign language into the official language of the CU member state must be notarized or signed by the translator with a copy of the diploma confirming his qualification attached.


The applicant is responsible for the accuracy of the documents provided for the purpose of issuing a document confirming the safety of products.


Information about perfumery and cosmetic products that have passed state registration is entered in the Unified Register of Certificates of State Registration.


State registration may be refused in cases established by the legislation of the Customs Union.


State registration may be terminated by the registration authority in the cases established by the legislation of the Customs Union.


5. In order to adopt a declaration of compliance of perfumery and cosmetic products with the requirements of this technical regulation of the Customs Union, the applicant (manufacturer, authorized representative of the manufacturer or importer) must have the following documents for each product name:


- copies of the manufacturer's documents containing a list of ingredients included in the perfume and cosmetic products, indicating the concentration of ingredients specified in annexes 2-5 to this technical regulation, certified by the applicant;

- copies of documents containing organoleptic and physico-chemical indicators of products, certified by the applicant;


- protocols of research (tests), or acts of hygienic examination, or scientific reports, or expert opinions on compliance with the requirements of paragraphs 3-6 of Article 5 of this technical regulation of the Customs Union, obtained in an accredited testing laboratory (center);


It is allowed to use the authorized representative of the manufacturer or the importer (seller) of the test reports of products carried out on behalf of the manufacturer or the authorized representative of the manufacturer, with their written consent;

- supply agreement (contract) and shipping documentation (scheme 4d);

- a sample of labeling of consumer packaging of perfumery and cosmetic products, confirming compliance with the requirements of paragraph 9 of Article 5 of this technical regulation of the Customs Union;


- a copy of the manufacturer's document on the compliance of production with the requirements of paragraph 7 of Article 5 of this technical regulation (written notification of the manufacturer on the compliance of production with the requirements of this technical regulation) or a declaration (application or written notification) of the manufacturer on compliance with the principles of good manufacturing practice GMP (3d, 4d schemes), certified by the applicant;

- a copy of the certificate of conformity of the quality management system and (or) a copy of the certificate of conformity of the production of perfumery and cosmetic products to the principles of good manufacturing practice (GMP) (scheme 6d), certified by the applicant;

Translations of the manufacturer's documents from a foreign language into the official language of the CU member state must be notarized or signed by the translator with a copy of the diploma confirming his qualification attached.


6. The declaration of compliance of perfumery and cosmetic products with the requirements of this technical regulation is subject to registration in accordance with the procedure established by the Decision of the Board of the Eurasian Economic Commission of March 20, 2018 N 41.


For the registration of the declaration of conformity, the applicant submits:


application for registration of the declaration of conformity signed by the applicant;


declaration of conformity;


copies of documents confirming the state registration of the applicant in accordance with the legislation of the member state of the Eurasian Economic Union;


a copy of the document (contract), according to which the applicant performs actions on behalf of the manufacturer during the conformity assessment and release of products into circulation in the customs territory of the Eurasian Economic Union, and is also responsible for non-compliance of products with the requirements of this technical regulation and accepts claims from the consumer - if the applicant is an authorized representative of the manufacturer;


a copy of the supply contract (contract) and shipping documentation - if the applicant is the importer (seller) (scheme 4d);


copies of the documents specified in paragraph 5 of this article, except for documents confirming consumer properties.


All submitted copies of documents are certified by the applicant. After completing the procedure for registering the declaration of conformity, the applicant shall keep the original declaration of conformity and a set of documents specified in paragraph 5 of this article. The original declaration of conformity and a set of documents for products (in electronic form or on paper) must be stored on the territory of a member state of the Eurasian Economic Union after the termination of production or delivery of the last batch of products during its shelf life and submitted to state control (supervision) bodies at their request.


The documents (a copy of the declaration of conformity with the set of documents specified in paragraph 5 of this Article, certified by the applicant) are stored in an accredited conformity assessment body or in an authorized body of a member state of the Eurasian Economic Union for 5 years after the expiration of the declaration of conformity.

7. The declaration of compliance of perfumery and cosmetic products with the requirements of this technical regulation of the Customs Union when declaring compliance of perfumery and cosmetic products according to the schemes 3d and 6d is valid until changes are made to the name of this product and (or) the recipe that lead to changes in safety indicators, but no more than the validity period established by this technical regulation of the Customs Union.


The validity period of the declaration of compliance of perfumery and cosmetic products with the requirements of this technical regulation of the Customs Union when declaring compliance of perfumery and cosmetic products according to the 3d scheme is no more than 5 years, according to the 6d scheme-no more than 7 years, according to the 4d scheme is set taking into account the shelf life of the products.


The registered declaration of compliance of mass-produced perfume and cosmetic products with the requirements of this technical regulation applies to these products manufactured from the date of manufacture of selected samples of products that have passed research (tests). In this case, in field 8 "Additional information" of the unified declaration of conformity form approved by the Decision of the Board of the Eurasian Economic Commission of December 25, 2012, N 293, an entry is made: "The declaration of conformity applies to products manufactured after ... "(the date of manufacture of the tested product samples is indicated).

It is allowed to adopt a declaration of compliance of perfumery and cosmetic products with the requirements of this technical regulation without conducting additional or repeated studies (tests) in the following cases:

identification of technical errors in the declaration of conformity and (or) its annex;

change of the organizational and legal form, location (address of the legal entity), and (or) phone number, and (or) e-mail address of the applicant (authorized representative of the manufacturer, importer (seller)). Information about such changes must be confirmed by a letter from the applicant;

change of the organizational and legal form, and (or) the phone number, and (or) the e-mail address of the manufacturer, and (or) its location (address of the legal entity) without changing the place of activity for the manufacture of products. If a change is made to the product formulation that does not lead to changes in safety indicators, without changing the product name, the products manufactured according to the new formulation are tested, while the adoption of a new declaration of compliance of perfumery and cosmetic products with the requirements of this technical regulation is not required.

Article 7. Marking with a single sign of the circulation of products on the market of the member states of the Customs Union

1. Perfumery and cosmetic products that meet the requirements of this technical regulation of the CU and have passed the procedure for assessing compliance with this technical regulation in accordance with Article 6 must be marked with a single product circulation mark on the market of the CU member states.


2. Marking with a single sign of the circulation of products on the market of the CU member states is carried out before the release of products into circulation on the market.


3. A single product circulation mark on the market of the CU member states is applied to each product unit (consumer packaging, label, label) and/or shipping documentation.


A single product circulation mark on the market of the CU member states is applied in any way that provides a clear and clear image during the entire shelf life of perfume and cosmetic products.

Article 8. Protective clause

1. The CU member States are obliged to take all measures to restrict, prohibit the release into circulation of perfumery and cosmetic products in the customs territory of the CU Member state, as well as the withdrawal from the market of perfumery and cosmetic products that pose a danger to human life and health.


2. The competent authority of a CU member State is obliged to notify the CU Commission and the competent authorities of other CU member States of the decision taken, indicating the reasons for making this decision and providing evidence explaining the need to take this measure.


3. If the competent authorities of other CU Member States express a protest against the decision referred to in paragraph 1 of this Article, the CU Commission shall immediately consult with the competent authorities of all CU Member States to adopt a mutually acceptable decision.

Article 9. State control (supervision)

The amount of sodium, potassium or lithium hydroxides is expressed in terms of sodium hydroxide. When using a mixture of hydroxides, their total concentration should not exceed the value specified in column 5.


The concentration of sodium, potassium, or lithium hydroxides is expressed as the mass of sodium hydroxide. When using mixtures of hydroxides, the amount should not exceed the value specified in column 5.

2. This list does not include dyes that are part of hair coloring products. In the products intended for hair coloring, it is allowed to use dyes not specified in this list, with the exception of those specified in annex 1 to the technical regulations and subject to restrictions in accordance with annex 2 to the technical regulations.


3. This list takes into account dyes, as well as their salts and varnishes. If the dye is specified in the form of a certain salt, then its other salts and varnishes are also taken into account.

The requirements of paragraphs 39 and 57 of this list are mutually exclusive: in the same product, it is permissible to use only methylisothiazolinone (in accordance with the requirements of paragraph 57 of this list) or only a mixture of methyl chlorisothiazolinone and methylisothiazolinone (in accordance with the requirements of paragraph 39 of this list).

General criteria for the validity of statements made regarding the consumer properties of perfume and cosmetic products

1. Applications must not contain information about the approval by the executive authorities of the member states of the Eurasian Economic Union.

2.Statements that declare the absence of substances prohibited for use in perfumery and cosmetic products by acts included in the law of the Eurasian Economic Union are not allowed.

3. Statements about the properties of ingredients should not apply to the properties of products without justification.

4. The level of evidence or justification should correspond to the type of statements, especially in relation to statements where the absence of a result may be unsafe (for example, in the case of statements about the properties of sunscreens (SPF factor)).

5. Do not require confirmation of the statement of consumer properties of an abstract nature, which are perceived by the consumer as an obvious exaggeration (for example: "These spirits inspire you", etc.).

6. Applications should be based on the data available to the manufacturer (for example, studies conducted on volunteers, including in clinical conditions, and (or) through studies conducted on sample models, and (or) using instrumental methods, and (or) based on scientific data for ingredients included in perfume and cosmetic products).
