1. This technical regulation has been developed in accordance with the Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.
2. This technical regulation has been developed for the purpose of establishing uniform mandatory requirements for the application and execution of packaging (closures) in the customs territory of the Customs Union, ensuring the free movement of packaging (closures) released into circulation in the customs territory of the Customs Union.
3. If other technical regulations of the Customs Union have been adopted with respect to packaging (capping agents), which establish requirements for packaging (capping agents), then the packaging (capping agents) must comply with the requirements of all technical regulations of the Customs Union, the effect of which applies to it.
1. This technical regulation applies to all types of packaging, including closures in accordance with Annex 5 (hereinafter referred to as packaging (closures)), which are finished products put into circulation in the customs territory of the Customs Union, regardless of the country of origin.

2. All types of packaging (closures) that are manufactured by the manufacturer of products packaged during the production of such products that are put into circulation in the customs territory of the Customs Union are subject only to the requirements of Articles 2, 4, 5, paragraphs 1 and 2 of Article 6 in terms of information about the possibility of recycling used packaging (closures) with the indication of a digital code and (or) a letter designation (abbreviation) the material from which the packaging is made (capping agents), and article 9 of this technical regulation.

3. This technical regulation establishes mandatory requirements for the application and execution in the customs territory of the Customs Union for packaging (closures) and related requirements for the processes of storage, transportation and disposal, in order to protect human life and health, property, the environment, the life or health of animals, plants, as well as to prevent actions misleading consumers of packaging (closures) regarding its purpose and safety.
4. The packaging is divided according to the materials used into the following types:
metal;
polymer;
paper and cardboard;
glass;
wooden;
made of combined materials;
made of textile materials;
ceramic.
5. Capping means are divided according to the materials used into:
metal, cork, polymer, combined and made of cardboard.
6. This technical regulation does not apply to packaging (closures) for medical devices, medicines, pharmaceutical products, tobacco products and dangerous goods, as well as to cargo containers and pallets for the transportation of goods by road, rail, sea and air transport.

In this technical regulation of the Customs Union, the following terms and their definitions are used:
identification is the procedure for assigning packaging (closures) to the scope of this technical regulation and establishing compliance of the actual characteristics of the packaging (closures) with the data contained in the technical documentation (including accompanying documents) to it;
manufacturer (manufacturer) - a legal entity or an individual as an individual entrepreneur who carries out on their own behalf the production and (or) release into circulation of packaging (closures) and are responsible for its compliance with the safety requirements of this technical regulation;
an importer is a resident of a member state of the Customs Union who has concluded a foreign trade agreement with a non-resident of a member state of the Customs Union for the transfer of packaging (closures), implements and (or) uses packaging (closures) and is responsible for its compliance with the safety requirements of this technical regulation of the Customs Union;
a combined material is a two-layer or multi-layer material, the layers of which cannot be separated without losing the functional or physical properties of such a material;

marking of packaging (capping agents) - information in the form of signs, inscriptions, pictograms, symbols applied to the packaging (capping agents) and (or) accompanying documents to ensure identification, informing consumers;
multi-turn packaging - packaging intended for its repeated use;
model environment - an environment that simulates the properties of food products;
circulation on the market - the processes of transition of packaging (capping agents) from the manufacturer to the consumer (user), which the packaging (capping agents) passes after the completion of its manufacture;
consumer packaging - packaging intended for sale or primary packaging of products sold to the final consumer;
intended use - the use of packaging (capping agents) in accordance with its purpose, established by the manufacturer;
accompanying documentation - documentation containing information about the products when they are put into circulation (documentation on the quality and (or) quantity of products, calculated and complex);

storage period - the period during which the product, subject to the storage conditions established by the manufacturer (manufacturer), meets the requirements of this technical regulation;

type of packaging (capping agents) - a classification unit that defines the packaging (capping agent) by material and design;
a standard sample is a sample of a package (capping agent) selected from a group of homogeneous products made of the same materials, using the same technology, the same design and meeting the same safety requirements;
transport package - a package intended for storage and transportation of products in order to protect it from damage during movement and forming an independent transport unit;
capping agent - a product designed to seal the package and preserve its contents;
packaging is a product that is used for placement, protection, transportation, loading and unloading, delivery and storage of raw materials and finished products.
packaging material - the material intended for the manufacture of packaging.
1. Packaging (capping agents) is put into circulation in the customs territory of the Customs Union, provided that it has passed the necessary conformity assessment (confirmation) procedures established by this technical regulation, as well as other technical regulations of the Customs Union, which apply to packaging (capping agents).
2. Packaging (capping agents), the compliance of which with the requirements of this technical regulation is not confirmed, should not be marked with a single product circulation mark on the market of the member states of the Customs Union and is not allowed for circulation in the customs territory of the Customs Union.
1. Compliance of packaging (closures) with this technical regulation is ensured by meeting its requirements directly or by meeting the requirements of standards, as a result of which compliance with the requirements of this technical regulation is ensured on a voluntary basis, and standards containing rules and methods of research (testing) and measurements, including the rules of sampling necessary for the application and fulfillment of the requirements of this technical regulation and the assessment (confirmation) of conformity of products (hereinafter referred to as standards).
Compliance with the requirements of these standards on a voluntary basis indicates that the packaging (closures) meets the requirements of this technical regulation.
2. The lists of standards specified in paragraph 1 of this Article are approved by the Customs Union Commission.
1. Packaging (capping agents) and the processes of its storage, transportation and disposal must comply with the safety requirements of this article.
2. The packaging (closures) must be designed and manufactured in such a way that, when used for its intended purpose, the risk caused by the design of the packaging (closures) and the materials used is minimized.
3. The safety of packaging must be ensured by a set of requirements for:
used materials in contact with food products, in terms of sanitary and hygienic indicators;
mechanical indicators;
chemical resistance;
tightness.
4. Packaging in contact with food products, including baby food, must comply with the sanitary and hygienic indicators specified in Annexes 1 and 1_1.

The conditions for modeling sanitary and chemical studies of packaging are specified in Annex 2.
5. Packaging intended for packaging food products, including baby food, perfume and cosmetic products, toys, children's assortment products, should not emit substances in quantities harmful to human health exceeding the maximum permissible amounts of chemical migration into the model and air environments in contact with them.
6. The packaging according to mechanical parameters, chemical resistance and tightness (if they are provided for by the design and purpose of the package) must comply with the safety requirements set out in paragraphs 6.1-6.8 of this Article:

6.1. metal packaging:
- must ensure tightness at internal overpressure of the air;
- must withstand the compressive force in the direction of the vertical axis of the package body;
- the inner coating must be resistant to the packaged products and (or) withstand sterilization or pasteurization in model environments;
- it must be resistant to corrosion.
6.2. glass packaging:
- must withstand internal hydrostatic pressure, depending on the main parameters and purpose;
- must withstand temperature changes without destruction;
- must withstand the compressive force in the direction of the vertical axis of the packaging body (except for bottles);

- the water resistance of the glass should not be lower than class 3/98 (for food products, including baby food, perfume and cosmetic products);
- must be acid-resistant (for cans and bottles for canning, food acids and baby food products);
- should not be reused for contact with baby food.

6.3. polymer packaging:
- must ensure tightness; - must withstand a set number of impacts during a free fall from a height without destruction (for sealed products, except for perfume and cosmetic products);
- must withstand the compressive force in the direction of the vertical axis of the package body (except bags and bags);
- it should not deform and crack when exposed to hot water (except bags and bags);
- the handles of the package must be firmly attached to it and withstand the installed load;
- the welded and adhesive seams of the package should not allow water to pass through;
- must withstand the established static tensile load (for bags and bags);
- the inner surface of the package must be resistant to the impact of the packaged products.
6.4. cardboard and paper packaging:
- must withstand a set number of impacts during free fall and (or) during a horizontal impact test;

- must withstand the compressive force in the direction of the vertical axis of the package body and (or) provide strength when stacking;

- the handles of the package (if available) must be firmly attached to the package and must withstand the installed load.

6.5. packaging made of combined materials:
- it must be sealed (if there are capping agents) or provide the established strength of the connecting seams;

- the surface of the inner coating should not be oxidized;
- the inner surface of the package must be resistant to the impact of the packaged products.
6.6. packaging made of textile materials:
- must withstand a set number of impacts during a free fall from a height without destruction;
- must withstand the established breaking load.
6.7. wooden packaging:
- must withstand a set number of impacts during a free fall from a height without destruction;
- must withstand a set number of impacts on horizontal or inclined planes;
- must withstand the compressive force in the direction of the vertical axis of the package body;
- the moisture content of the wood must correspond to the established one.
6.8. ceramic packaging:
- must be waterproof;

- it must be sealed when capping.

7. The safety of closures must be ensured by a set of requirements for:
used materials in contact with food products, in terms of sanitary and hygienic indicators;
tightness;
chemical resistance; safe opening;
physical and mechanical parameters.
8. Closures that come into contact with food products, including baby food, must comply with the sanitary and hygienic indicators specified in Annex 1.
The conditions for modeling sanitary and chemical studies of capping agents are specified in Annex 2.
Closures that come into contact with food products, including baby food, perfume and cosmetic products, should not release substances in quantities harmful to human health that exceed the permissible amounts of chemical migration into the model media that come into contact with them.
9. Capping agents for physical and mechanical parameters and chemical resistance must comply with the safety requirements set out in paragraphs 9.1-9.4 of this Article:
9.1. metal closures:
- must ensure the tightness of the packaging (except caps for perfume and cosmetic products, muslets, staples);
- lids for canning should be resistant to hot processing;
- the torque when opening screw closures must meet the established requirements;
- the adhesive seam of the crimping and wrapping caps must be strong;
- crown plugs must withstand internal pressure;

- crown plugs must be resistant to corrosion;

- the paint coating of the inner surface of the lid and the sealing gasket during pasteurization and sterilization must be resistant to the effects of model environments.
9.2. polymer capping agents:

- must ensure the tightness of the packaging (except for heat-shrinkable, wrapping caps, valves, dispenser-limiters, dividers, sealing gaskets, covers for closing) under the established operating conditions;
- the torque when opening the screw caps and caps must meet the established requirements;
- capping agents intended for capping sparkling (champagne) and carbonated wines must withstand internal pressure;

- the sealing gaskets should not be delaminated;
- the amount of polymer dust should not be higher than the established;
- lids for canning should be resistant to hot processing;
- caps for canning should be resistant to acid solutions.
9.3. cortical capping agents:
- must ensure the tightness of the package;
- the humidity of the plugs and sealing gaskets must meet the established requirements;
- the torsional strength of agglomerated and prefabricated plugs must meet the established requirements;
- prefabricated plugs must withstand boiling in water without destruction and the appearance of cracks;

- the capillarity of the side surface must meet the established requirements;
- the amount of cork dust of natural, colmated, agglomerated and prefabricated plugs should not be higher than the established one.
9.4. cardboard closures:
- must be resistant to the effects of model environments;
- they should not be stratified into components.
9.5 combined capping agents:
- the adhesive seam of heat-shrinkable and wrapping caps must be strong;
- the sealing gaskets should not be delaminated.

10. Test reports confirming the compliance of the types of packaging (closures) manufactured by the manufacturer of packaged products during the production of such products with the requirements of paragraphs 1-9 of this article shall be included in the set of evidentiary materials formed when confirming the conformity of packaged products.
11. Requirements for the processes of handling packaging (closures) on the market (storage, transportation, disposal):
11.1. the packaging (capping agents) is stored in accordance with the requirements of regulatory and (or) technical documents for specific types of packaging (capping agents).
11.2. transportation of packaging (closures) is carried out by all types of transport in accordance with the rules of cargo transportation;
11.3. in order to save resources and eliminate environmental pollution, used packaging (capping agents) must be disposed of in accordance with the procedure established by the legislation of the member state of the Customs Union;

1. The marking must contain the information necessary to identify the material from which the package is made (closures), in order to facilitate the collection and reuse of the package. The marking must be strong, resistant to abrasion and durable. The marking necessary for the identification of the material from which the packaging is made (capping agents) must be applied directly to the packaging and (or) the accompanying documentation. If there is no appropriate marking on the package, the manufacturer of the product that packs this product in the package must put on the label (label) the marking necessary to identify the material from which the package is made, in accordance with the accompanying documentation for the package. In the presence of technological and design capabilities determined by the manufacturer, the marking is applied directly to the closures, in their absence, the relevant information is indicated in the accompanying documentation for the closures.

2. The marking must contain a digital code and (or) a letter designation (abbreviation) the material from which the packaging (capping agents) is made, in accordance with Annex 3 and must contain the symbols in accordance with Annex 4: figure 1 (packaging (capping agents) intended for contact with food products), Figure 2 (the possibility of recycling used packaging (capping agents) - the Mobius loop).

3. Information about the packaging (capping agents) must be provided in the accompanying documents and contain:
name of the package (capping agents);
information about the purpose of packaging (capping agents);
conditions of storage, transportation, possibility of disposal;
processing method (for multi-turn packaging);
the name and location of the manufacturer( manufacturer), information for contacting him;
the name and location of the person authorized by the manufacturer, the importer, information for contacting him (if any);
date of manufacture (month, year);
shelf life (if set by the manufacturer (manufacturer).
4. The information must be presented in Russian and in the state language (s) of the member state of the Customs Union, if there are relevant requirements in the legislation of the member state(s) of the Customs Union.
1. Before being put into circulation in the customs territory of the Customs Union, the packaging (capping agents) must be subjected to the procedure for confirming compliance with the requirements of this technical regulation.
2. Confirmation of the conformity of packaging (closures) with the requirements of this technical regulation is mandatory and is carried out in the form of a declaration of conformity according to one of the following schemes:
2.1 schemes 3d, 4d, 6d-in relation to packaging (closures) intended for packaging food products, including baby food, perfume and cosmetic products that have direct contact with packaged products, toys and children's products that have direct contact with the child's mouth (in the case of packaging (closures) that have different materials, standard sizes, thickness of the materials used, tests can be carried out on standard samples, including features of the type of packaging (closures);

2.2 schemes 1D and 2D - with respect to packaging (closures) not specified in subparagraph 2.1 of this paragraph (in the case of packaging (closures) having different materials, standard sizes, thickness of the materials used, tests can be carried out on standard samples, including the features of the type of packaging (closures).
3. The declaration of conformity of mass-produced packaging (closures) is carried out by the manufacturer or a person authorized by the manufacturer.
The declaration of conformity of the batch of packaging (capping agents) is carried out by the manufacturer (a person authorized by the manufacturer), the importer.
4. The identification of packaging (closures) when declaring its compliance with the requirements of this technical regulation is carried out by the manufacturer (a person authorized by the manufacturer), the importer.
5. The adoption of the declaration of conformity includes the following procedures:
- formation and analysis of regulatory and technical documentation;
- conducting tests;
- formation of a set of evidentiary materials;
- acceptance and registration of the declaration of conformity;
- application of a single product circulation mark on the market of the member states of the Customs Union;
- implementation of production control (for schemes 1d, 3d and 6d).

6. When declaring conformity, the manufacturer (a person authorized by the manufacturer), the importer independently forms evidentiary materials in order to confirm the compliance of the packaging (capping agents) with the requirements of this technical regulation.
7. Evidentiary materials for the adoption of a declaration of conformity should include:
- the protocol (protocols) of tests carried out by the manufacturer (a person authorized by the manufacturer), the importer and (or) an accredited testing laboratory (center) included in the Unified Register of Certification Bodies and Testing Laboratories (centers) of the Customs Union, confirming compliance with the declared requirements (provided that no more than one year has passed since the registration of the protocol (protocols));
- a list of standards, the requirements of which must meet the packaging (closures), from the List of standards specified in paragraph 2 of Article 4;
- a description of the adopted technical solutions confirming the fulfillment of the requirements of this technical regulation, if the standards specified in paragraph 2 of Article 4 are absent or have not been applied;
- certificate for the management system (a copy of the certificate) (scheme 6d);

- supply contract (contract) and accompanying documentation (on the quantity of products) (schemes 2d, 4d);

- other documents confirming the compliance of the packaging (closures) with the requirements of this technical regulation, including a certificate (certificates) of conformity for a specific type of packaging (closures) (if available), a certificate (certificates) of conformity or test reports for materials (if available).

8. The declaration of conformity is drawn up in a single form approved by the decision of the Customs Union Commission.
The declaration of conformity is subject to registration in accordance with the legislation of the Customs Union.
9. The declaration of conformity is issued for a specific name of the package (closures) or for a group of packages (closures) made of the same materials and having the same design, and meeting the same safety requirements.
10. The set of evidentiary materials provided for in paragraph 7 of this article, together with the declaration of conformity, must be kept by the manufacturer (a person authorized by the manufacturer), the importer for the period established by the legislation of the Customs Union.
11. The declaration of conformity of packaging (closures) is accepted for a period of no more than 5 years for mass-produced products. The declaration of conformity for a batch of packaging (capping agents) is accepted without specifying its validity period.
The declaration of conformity of a batch of packaging (capping agents) is valid only for packaging (capping agents) related to a specific batch.
12. At the request of the manufacturer (the person authorized by the manufacturer), the importer, the declaration of conformity according to the schemes 1d and 2d can be replaced by the declaration of conformity according to the schemes 3d, 4d, 6d.

13. Used packaging (closures) is not subject to confirmation of compliance with the requirements of this technical regulation.

1. Packaging (closures) that meets the requirements of this technical regulation and has passed the conformity assessment procedure in accordance with Article 7 of this technical regulation must be marked with a single product circulation mark on the market of the member states of the Customs Union, which is affixed in the accompanying documentation.
2. Marking with a single sign of the circulation of products on the market of the member states of the Customs Union is carried out by the manufacturer, the person authorized by the manufacturer, the importer before placing the products on the market.
3. Packaging (capping agents) is marked with a single product circulation mark on the market of the member states of the Customs Union if it meets the requirements of this technical regulation, as well as other technical regulations of the Customs Union, which apply to it.
1. The member States of the Customs Union are obliged to take all measures to restrict, prohibit the release into circulation of packaging (capping agents) in the customs territory of the Customs Union, as well as the withdrawal from the market of packaging (capping agents) that do not meet the requirements of this technical regulation and other technical regulations of the Customs Union, which apply to packaging (capping agents).

2. When evaluating materials and products intended for packaging baby food products for young children, the migration of chemicals belonging to hazard classes 1 and 2 is not allowed.
3. Studies of the migration of harmful substances into model environments are carried out in relation to packaging intended for storing products with a humidity of more than 15%, in the air model environment - in relation to products with a humidity of less than 15%.

Requirements for the organoleptic characteristics of packaging (closures) in contact with food products, including baby food
List of model media used in the study of packaging (capping agents)
Note:
1. Packaging (capping agents) used in conditions other than those described above is processed as close as possible to the operating modes with some aggravation.
2. In the study of packaging (capping agents) made of plastics containing nitrogen and aldehydes, a 0.3% and 3% solution of citric acid is used as a model medium instead of lactic acid.
3. When studying the packaging (capping agents) for canned fish in its own juice, only distilled water is used as a model medium.
4. For the determination of lead and cadmium from packaging (capping agents) made of glass, ceramics, porcelain and earthenware, a 4% solution of acetic acid is used as a model medium
The duration of contact of the packaging (capping agents) with the model media is set depending on its operating conditions with some aggravation:
a) if the time of the intended contact of food products with packaging (capping agents) does not exceed 10 minutes, the exposure during the study is 2 hours;
b) if the time of contact of food products with packaging (capping agents) does not exceed 2 hours, the exposure during the study is 1 day;
c) if the time of contact of food products with packaging (capping agents) is from 2 to 48 hours, the exposure during the study is 3 days;
d) if the time of contact of food products with packaging (capping agents) is more than 2 days, the exposure during the study is 10 days;
e) metal cans covered with varnish are filled with a model medium, hermetically rolled up, autoclaved for an hour and left at room temperature for 10 days;

Notes:
1. Identification signs are affixed as follows: inside the Mobius loop - a digital code and (or) a letter designation, under the Mobius loop-Figure 2 in accordance with Annex 4 to the technical regulations of the Customs Union "On Packaging Safety" (TR CU 005/2011).
2. The digital code or letter designation is not affixed in the absence of a Mobius loop.
3. The numeric code and the letter designation can be used in any of the proposed options.
4. The dimensions of the symbols are set by the packaging manufacturer depending on the technical capabilities. The symbols can be made in any color that contrasts with the color of the package or in relief.
