1. This technical regulation of the Customs Union has been developed in accordance with the Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.
2. This technical regulation of the Customs Union is designed to ensure the establishment in the single customs territory of the Customs Union of uniform mandatory requirements for the application and implementation of electromagnetic compatibility of technical means, to ensure the free movement of technical means put into circulation in the single customs territory of the Customs Union.
3. If other technical regulations of the Customs Union have been adopted with respect to technical means that establish requirements for technical means, then the technical means must comply with the requirements of these technical regulations of the Customs Union, the effect of which applies to them.
1. This technical regulation of the Customs Union applies to technical means put into circulation in the single customs territory of the Customs Union that are capable of creating electromagnetic interference and (or) the quality of their functioning depends on the impact of external electromagnetic interference.
2. This technical regulation of the Customs Union does not apply to technical means:
- used by manufacturers of other technical means as their components and not intended for independent use;
- passive with respect to electromagnetic compatibility;
- not included in the Unified List of products for which mandatory requirements are established within the Customs Union, approved by the Customs Union Commission (hereinafter referred to as the Commission).
If the technical regulations of the Customs Union are adopted for certain classes, groups and types of technical means, establishing fully or partially with greater certainty the requirements for electromagnetic compatibility, then from the date of entry into force of these technical regulations of the Customs Union, this technical regulation of the Customs Union with respect to these technical means and requirements for electromagnetic compatibility is terminated.
3. This technical regulation of the Customs Union establishes requirements for electromagnetic compatibility of technical means in order to ensure the protection of human life and health, property in the single customs territory of the Customs Union, as well as to prevent actions that mislead consumers (users) of technical means.
4. This technical regulation of the Customs Union does not regulate relations related to the use of the radio frequency spectrum, which is regulated by the national legislation of the member states of the Customs Union in the field of communications.
In this technical regulation of the Customs Union, the following terms and their definitions are used:
the device is a structurally completed technical means having a housing (shell) and, if necessary, devices (ports) for external connections, intended for use by the consumer (user);
manufacturer - a legal entity or an individual as an individual entrepreneur who carries out the production or production and sale of technical means on their own behalf and is responsible for their compliance with the requirements for electromagnetic compatibility of the technical regulations of the Customs Union;
an importer-a resident of a member state of the Customs Union who has concluded a foreign trade agreement with a non - resident of the member states of the Customs Union for the transfer of technical means, implements these technical means and is responsible for their compliance with the requirements for electromagnetic compatibility of the technical regulations of the Customs Union;
component - a structurally completed part of a technical means intended for inclusion by the consumer (user) in the composition of the device;
circulation of a technical means on the market - the processes of transition of a technical means from the manufacturer to the consumer (user) in the single customs territory of the Customs Union, which the technical means passes after the completion of its manufacture;
intended use - the use of a technical means in accordance with the purpose specified by the manufacturer on this technical means and (or) in the operational documents;
technical means - any electrical, electronic and radio-electronic product, as well as any product containing electrical and (or) electronic components, which can be classified into the following categories: component, apparatus and installation;
technical means that are passive with respect to electromagnetic compatibility - a technical device that, due to its design and functional characteristics, when used for its intended purpose without the use of additional means of protection against electromagnetic interference, such as shielding or filtering, is unable to create electromagnetic interference that disrupts the functioning of communications and other technical means in accordance with their purpose, and is able to function without deterioration in quality when exposed to electromagnetic interference corresponding to an electromagnetic environment, for use in which a technical means is intended (the types of technical means that are passive with respect to electromagnetic compatibility are given in Annex 1 to this technical regulation of the Customs Union);
a person authorized by the manufacturer is a legal entity or an individual registered in accordance with the established procedure by a member state of the Customs Union, which is determined by the manufacturer on the basis of an agreement with him to perform actions on his behalf when confirming compliance and placing products in the single customs territory of the Customs Union, as well as to impose responsibility for non-compliance of products with the requirements of the technical regulations of the Customs Union;
installation (mobile or stationary) - a set of interconnected devices and, if necessary, other products intended for use by the consumer (user) as a product with a single functional purpose and having a single technical documentation;
resistance to electromagnetic interference (noise immunity) - the ability of a technical means to maintain a given quality of functioning when exposed to external electromagnetic interference with regulated parameter values;
electromagnetic compatibility - the ability of a technical means to function with a given quality in a given electromagnetic environment and not to create unacceptable electromagnetic interference to other technical means;
electromagnetic environment - a set of electromagnetic phenomena and processes in a given area of space;
electromagnetic interference is an electromagnetic phenomenon or process that reduces or may reduce the quality of the functioning of a technical means.
1. A technical means is put into circulation on the market if it complies with this technical regulation of the Customs Union, as well as other technical regulations of the Customs Union, the effect of which applies to it, and provided that it has passed the confirmation of compliance in accordance with Article 7 of this technical regulation of the Customs Union, as well as in accordance with other technical regulations of the Customs Union, the effect of which applies to it.
2. A technical means whose compliance with the requirements of this technical regulation of the Customs Union is not confirmed must not be marked with a single product circulation mark on the market of the member states of the Customs Union and is not allowed to be put into circulation on the market.
3. A technical means that is not marked with a single product circulation mark on the market of the member states of the Customs Union is not allowed to be put into circulation on the market.
The technical means must be designed and manufactured in such a way that, when used for its intended purpose and meeting the requirements for installation, operation( use), storage, transportation (transportation) and maintenance:
- the electromagnetic interference created by the technical means did not exceed the level ensuring the functioning of communication means and other technical means in accordance with their purpose;
- the technical means had a level of resistance to electromagnetic interference (noise immunity), ensuring its functioning in the electromagnetic environment for which it is intended to be used.
The types of electromagnetic interference created by a technical means and (or) affecting a technical means are listed in Annex 2 to this technical regulation of the Customs Union.
1. The name and (or) designation of the technical means (type, brand, model-if available), its main parameters and characteristics, the name and (or) trademark of the manufacturer, the name of the country where the technical means is manufactured, must be applied to the technical means and indicated in the operational documents attached to it.
In this case, the name of the manufacturer and (or) its trademark, the name and designation of the technical means (type, brand, model-if available) must also be applied to the packaging.
2. If the information given in paragraph 1 of this article cannot be applied to a technical means, then they can be indicated only in the operational documents attached to this technical means. In this case, the name of the manufacturer and (or) its trademark, the name and designation of the technical means (type, brand, model-if available) must be applied to the packaging.
3. The marking of the technical means must be legible, easy to read and applied to the technical means in a place accessible for inspection without disassembly with the use of a tool.
4. The operational documents for the technical means must contain:
- the information listed in paragraph 1 of this article;
- information about the purpose of the technical means;
- characteristics and parameters;
- rules and conditions for the installation of a technical means, its connection to the electrical network and other technical means, start-up, regulation and commissioning, if the fulfillment of these rules and conditions is necessary to ensure compliance of the technical means with the requirements of this technical regulation of the Customs Union;
- information about restrictions on the use of technical equipment, taking into account its purpose for working in residential, commercial and industrial zones;
- rules and conditions of safe operation (use);
- rules and conditions for storage, transportation( transportation), sale and disposal (if necessary, the establishment of requirements for them);
- information about the measures to be taken when a malfunction of the technical means is detected;
- the name and location of the manufacturer (the person authorized by the manufacturer), the importer, information for contacting them;
- the month and year of manufacture of the technical means and (or) information about the place of application and the method of determining the year of manufacture.
5. Operational documents are executed in Russian and in the state language (s) of the member state of the Customs Union, if there are relevant requirements in the legislation of the member state(s) of the Customs Union.
Operational documents are executed on paper. A set of operational documents on electronic media can be attached to them. Operational documents included in the set of non-commercial technical equipment can be executed only on electronic media.
1. The compliance of a technical means with this technical regulation of the Customs Union is ensured by the fulfillment of its requirements for electromagnetic compatibility directly or by the fulfillment of the requirements of standards included in the List of Standards, as a result of the application of which compliance with the requirements of the technical regulations of the Customs Union is ensured on a voluntary basis.
2. The methods of research (testing) and measurement of technical equipment are established in the standards included in the List of Standards containing the rules and methods of research (testing) and measurement, including the rules of sampling necessary for the application and fulfillment of the requirements of the technical regulations of the Customs Union and the assessment (confirmation) of conformity of products.
1. Before putting into circulation on the market, a technical means must pass a confirmation of compliance with the requirements for electromagnetic compatibility of this technical regulation of the Customs Union.
Confirmation of conformity of a technical means is carried out according to the schemes established in this technical regulation of the Customs Union, in accordance with the Regulations on the procedure for applying standard conformity assessment (confirmation) schemes in the technical regulations of the Customs Union, approved by the Commission.
2. The technical means included in the List given in Annex 3 to this technical regulation of the Customs Union are subject to conformity assessment in the form of certification (schemes 1c, 3c, 4c).
Technical means not included in the specified List are subject to conformity assessment in the form of declaration of conformity (schemes 1d, 2d, 3d, 4d, 6d). The choice of the scheme of declaration of conformity of technical means not included in the List is carried out by the manufacturer (a person authorized by the manufacturer), the importer.
By the decision of the manufacturer (the person authorized by the manufacturer), the importer, the confirmation of conformity of technical means not included in the List may be carried out in the form of certification in accordance with paragraph 5 of this article.
In case of non-application of the standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union, or in their absence, confirmation of compliance of the technical means is carried out in the form of certification (schemes 1c, 3c, 4c) in accordance with paragraph 10 of this article.
3. The certification of a mass-produced technical means is carried out according to the 1c scheme. The technical means for certification is provided by the manufacturer (a person authorized by the manufacturer).
Certification of a batch of technical means is carried out according to scheme 3c, a single product - according to scheme 4c. A batch of technical means (a single product) manufactured in the single customs territory of the Customs Union is represented by the manufacturer, a batch of technical means (a single product) imported into the single customs territory of the Customs Union is represented by the importer or manufacturer (a person authorized by the manufacturer).
4. Certification of technical means is carried out by the certification body (assessment (confirmation) of conformity) included in the Unified Register of Certification Bodies and Testing laboratories (centers) of the Customs Union.
Tests for certification purposes are carried out by an accredited testing laboratory (center) included in the Unified Register of Certification Bodies and Testing Laboratories (Centers) of the Customs Union.
5. When certifying a technical means (schemes 1c, 3c, 4c): 5.1. the manufacturer (a person authorized by the manufacturer), the importer provides the certification body (assessment (confirmation) of compliance) with a set of documents for a technical means confirming the compliance of the technical means with the requirements for electromagnetic compatibility of this technical regulation of the Customs Union, which includes:
- technical specifications (if available);
- operational documents;
- a list of standards, the requirements of which this technical means must meet from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union;
- contract (supply contract) or shipping documentation (for a batch of technical means (a single product) (schemes 3c, 4c);
5.2. the manufacturer takes all necessary measures to ensure that the production process is stable and ensures that the manufactured technical means comply with the requirements of this technical regulation of the Customs Union;
5.3. certification body (conformity assessment (confirmation)):
5.3.1. performs the selection of a sample (samples);
5.3.2. carries out the identification of a technical means by establishing the identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs Union, the provisions established in Article 5 of this technical regulation of the Customs Union, and the documents listed in paragraph 5.1 of paragraph 5 of this Article;
5.3.3. organizes testing of a sample (samples) of a technical means for compliance with the requirements of standards from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union, and analyzes the test protocol (protocols) ;
5.3.4. analyzes the state of production (scheme 1c).
If the manufacturer has a certified quality management system for the production or development and production of technical means, assesses the ability of this system to ensure the stable production of certified technical means that meet the requirements of this technical regulation of the Customs Union;
5.3.5. issues a certificate of conformity according to a single form approved by the Commission. The validity period of the certificate of conformity for mass-produced technical means is not more than 5 years, for a batch of technical means (a single product), the validity period of the certificate of conformity is not established;
5.4. manufacturer (a person authorized by the manufacturer), importer:
5.4.1. applies a single sign of the circulation of products on the market of the member states of the Customs Union;
5.4.2. forms, after completion of the conformity assessment, a set of documents for the technical means, which includes:
- the documents provided for in subparagraph 5.1 of this paragraph;
- test report (s) ;
- the results of the analysis of the state of production;
- certificate of conformity.
5.5. the certification body (conformity assessment (confirmation)) conducts inspection control over the certified technical means by testing samples in an accredited testing laboratory (center) and (or) analyzing the state of production (scheme 1c);
6. Declaration of conformity of technical means (schemes 1d, 2d, 3d, 4d, 6d) is carried out on the basis of:
6.1. own proofs (schemes 1d, 2d):
- conducting tests of technical means (for a batch of technical means, a single product) (scheme 2d);
- testing of technical equipment and production control by the manufacturer (for mass-produced technical equipment) (scheme 1d);
6.2. evidence obtained with the participation of an accredited testing laboratory( center), a certification body for quality management systems included in the Unified Register of Certification Bodies and Testing Laboratories (centers) of the Customs Union (3d, 4d, 6d schemes):
- conducting tests of technical means (for a batch of technical means, a single product) (scheme 4d);
- testing of technical equipment and production control by the manufacturer (for mass-produced technical equipment) (3d scheme);
- testing of technical equipment, certification of the production quality management system or the development and production of technical equipment and production control by the manufacturer (for mass-produced technical equipment) (scheme 6d).
6.3. The declaration of conformity of mass-produced technical means is carried out by the manufacturer (a person authorized by the manufacturer) according to the schemes 1d, 3d, 6d.
Declaration of conformity of a batch of technical means (a single product) is carried out by the manufacturer (a person authorized by the manufacturer), the importer according to the schemes 2d, 4d.
7. When declaring the conformity of a technical means according to the schemes 1d, 2d:
7.1. manufacturer (a person authorized by the manufacturer), importer:
7.1.1. forms a set of documents confirming the compliance of the technical means with the requirements of this technical regulation of the Customs Union, which includes:
- technical specifications (if available);
- operational documents;
- a list of standards, the requirements of which this technical means meets, from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union;
- the protocol (protocols) of tests carried out in the testing laboratory (center) at the choice of the manufacturer (the person authorized by the manufacturer), the importer;
- certificate of conformity (if available);
- declaration of conformity of the manufacturer (if available) (for a batch of technical means (a single product) (scheme 2d);
- contract (supply contract) or shipping documentation (for a batch of technical means, a single product) (scheme 2d);
7.1.2. carries out the identification of a technical means by establishing the identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs Union, the provisions established in Article 5 of this technical regulation of the Customs Union, and the documents listed in paragraph 7.1.1. of paragraph 7.1 of this Article;
7.2. the manufacturer carries out production control and takes all necessary measures to ensure that the production process ensures compliance of the technical means with the requirements of this technical regulation of the Customs Union (scheme 1d).
The requirements for the production and control processes, as well as the results of their control, must be documented (in the form established by the manufacturer);
7.3. manufacturer (a person authorized by the manufacturer), importer:
7.3.1. accepts a written declaration of compliance of the technical means with the present technical regulations of the Customs Union in a single form approved by the Commission, and applies a single sign of the circulation of products on the market of the member states of the Customs Union;
7.3.2. after the completion of the conformity assessment, it includes a declaration of conformity in the set of documents for the technical means specified in subparagraph 7.1.1. of this paragraph.
8. When declaring the conformity of the technical means according to the schemes 3d, 4d, 6d:
8.1. manufacturer (a person authorized by the manufacturer), importer:
8.1.1. forms a set of documents for a technical means, which includes:
- technical specifications (if available);
- operational documents;
- a list of standards, the requirements of which this technical means must meet from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union;
- contract (supply contract) or shipping documentation (for a batch of technical means, a single product) (scheme 4d);
- certificate of conformity for the quality management system of production or development and production of technical means (scheme 6d);
8.1.2. carries out the identification of a technical means by establishing the identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs Union, the provisions established in Article 5 of this technical regulation of the Customs Union, and the documents listed in paragraph 8.1.1. of paragraph 8.1. of this Article;
8.1.3. organizes testing of a sample (samples) of a technical means for compliance with the requirements of standards from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union;
8.2. manufacturer:
performs production control and takes all necessary measures to ensure that the production process ensures compliance of the technical means with the requirements of this technical regulation of the Customs Union (schemes 3d, 6d). The requirements for the production and control processes, as well as the results of their control, must be documented (in the form established by the manufacturer);
takes all necessary measures to ensure that the production process and the stable functioning of the quality management system of production or development and production ensure that the technical means comply with the requirements of this technical regulation of the Customs Union (scheme 6d);
8.3. manufacturer (a person authorized by the manufacturer), importer:
8.3.1. accepts a written declaration of compliance of the technical means with the present technical regulations of the Customs Union in a single form approved by the Commission, and applies a single sign of the circulation of products on the market of the member states of the Customs Union;
8.3.2. forms, after completion of the conformity assessment, a set of documents for the technical means, which includes:
- the documents provided for in subparagraph 8.1.1 of paragraph 8.1 of this article;
- test report (s) ;
- declaration of conformity.
9. The declaration of conformity is subject to registration in accordance with the legislation of the Customs Union. The validity of the declaration begins from the date of its registration.
The validity period of the declaration of conformity for mass - produced technical means is not more than 5 years, for a batch of technical means (a single product), the validity period of the declaration of conformity is not established.
10. During the certification of a technical means, in case of non-application of standards from the List of standards specified in paragraph 1 of Article 6 of this technical regulation of the Customs Union, or in their absence (schemes 1c, 3c, 4c):
10.1. the manufacturer (the person authorized by the manufacturer), the importer provides the certification body (assessment (confirmation) of conformity) with a set of documents for the technical means confirming the compliance of the technical means with the requirements for electromagnetic compatibility of this technical regulation of the Customs Union, which includes:
- technical specifications (if available);
- operational documents;
- a description of the technical solutions adopted, confirming the fulfillment of the requirements for electromagnetic compatibility of this technical regulation of the Customs Union;
- contract (supply contract) or shipping documentation (for a batch of technical means (a single product) (schemes 3c, 4c);
10.2. the manufacturer takes all necessary measures to ensure that the production process is stable and ensures that the manufactured technical means comply with the requirements of this technical regulation of the Customs Union;
10.3. certification body (conformity assessment (confirmation)):
10.3.1. performs the selection of a sample (samples);
10.3.2. carries out the identification of a technical means by establishing the identity of its characteristics to the signs established in Article 1 of this technical regulation of the Customs Union, the provisions established in Article 5 of this technical regulation of the Customs Union, and the documents listed in subparagraph 10.1 of paragraph 10 of this Article;
10.3.3. carries out confirmation of compliance of the technical means directly with the requirements for electromagnetic compatibility of this technical regulation of the Customs Union.
At the same time, the certification body (assessment (confirmation) of conformity):
- on the basis of the requirements for electromagnetic compatibility of this technical regulation of the Customs Union and the conditions of the electromagnetic environment in which the technical means is intended for use, determines the specific requirements for electromagnetic compatibility for the certified technical means;
- analyzes the adopted technical solutions confirming the fulfillment of the requirements for electromagnetic compatibility of this technical regulation of the Customs Union, carried out by the manufacturer;
- determines from the List of standards specified in paragraph 2 of Article 6 of this technical regulation of the Customs Union, standards that establish methods of measurement and testing, or in their absence, determines methods of control, measurement and testing to confirm the compliance of a technical means with specific requirements for electromagnetic compatibility;
- organizes the testing of technical equipment and analyzes the test protocol (protocols) ;
10.3.4. analyzes the state of production (scheme 1c);
If the manufacturer has a certified quality management system for the production or development and production of technical means, assesses the ability of this system to ensure the stable production of certified technical means that meet the requirements of this technical regulation of the Customs Union;
10.3.5. issues a certificate of conformity according to a single form approved by the Commission.
The validity period of the certificate of conformity for mass-produced technical means is not more than 5 years, for a batch of technical means (a single product), the validity period of the certificate of conformity is not established;
10.4. manufacturer (a person authorized by the manufacturer), importer:
10.4.1. applies a single sign of the circulation of products on the market of the member states of the Customs Union;
10.4.2. forms, after completion of the conformity assessment, a set of documents for the technical means, which includes:
- the documents provided for in subparagraph 10.1 of this paragraph;
- test report (s) ;
- the results of the analysis of the state of production;
- certificate of conformity;
10.5. the certification body (conformity assessment (confirmation)) conducts inspection control over the certified technical means by testing samples in an accredited testing laboratory (center) and (or) analyzing the state of production (scheme 1c).
11. When confirming the conformity of stationary installations, according to the manufacturer's decision, an examination of the technical documentation for ensuring electromagnetic compatibility is carried out, and calculation and experimental methods are also used, the documented results of which are subject to inclusion in the set of documents for the technical means.
12. The set of documents for the technical means must be stored on the territory of the member states of the Customs Union for:
- technical means-from the manufacturer (a person authorized by the manufacturer) for at least 10 years from the date of withdrawal (termination) from the production of this technical means;
- a batch of technical means-from the importer or a person authorized by the manufacturer for at least 10 years from the date of sale of the last product from the batch.
1. A technical device that meets the requirements for electromagnetic compatibility of this technical regulation of the Customs Union and has passed the conformity assessment procedure in accordance with Article 7 of this technical regulation of the Customs Union must be marked with a single product circulation mark on the market of the member states of the Customs Union.
2. Marking with a single sign of the circulation of products on the market of the member states of the Customs Union is carried out before the release of the technical means into circulation on the market.
3. A single product circulation mark on the market of the member states of the Customs Union is applied to each technical means in any way that provides a clear and clear image during the entire service life of the technical means, and is also provided in the operational documents attached to it.
4. It is allowed to apply a single product circulation mark on the market of the member states of the Customs Union only on the packaging of the technical means and in the operational documents attached to it, if it is impossible to apply it directly to the technical means.
5. A technical means is marked with a single product circulation mark on the market of the member states of the Customs Union if it meets the requirements of all technical regulations of the Customs Union, the effect of which applies to it, and provides for the application of this mark.
The member States of the Customs Union are obliged to take all measures to restrict, prohibit the release into circulation of technical means in the single customs territory of the Customs Union, as well as the withdrawal from the market of technical means that do not meet the requirements for electromagnetic compatibility of this technical regulation of the Customs Union.

6. High-voltage equipment in which possible sources of electromagnetic interference are caused only by localized insulation defects (for example, high-voltage inductors, high-voltage transformers), provided that the specified equipment does not contain active electronic parts.

- frequency deviations in power supply systems;
- voltage of signals transmitted in power supply systems;
- constant components in AC power supply networks;
- induced low-frequency voltages.
2. Low-frequency radiated electromagnetic interference:
- magnetic fields;
- electric fields.
